13th Section of the aforesaid Act I am directed
to do, That all persons, excepting Justices of the
Peace, who shall hold any ofiice or appointment
C'f profit or trust under the government of the
United States, or of this btate, or auy City or
incorporated District, whether u commissioned
officer or otherwise, a subordinate or agent, who
is or shall be employed under the legislative, ju
diciary or executive department of tins State or
the United States, or any City or incorporated
District; aloo, that every member of Congress
and the State Legislature, and of the select or
common councils of any incorporated district, is
by law incapable of holding or exerci. ing, at the
same time, the office or appointment of Judge,
Insjector, or Clerk of. any election of this Com
monwealth, aud that no Inspector, or Judge, or
other officer of any such election shall be eligible
to any ofiice then to be voted for. Also, in the
4th section of the Act of Assembly, entitlad "An
Act relating to elections and fir other purposes,"
approved tl'.e 10th day of April, 135G, it is en
acted that the foregoing 13th section shall notbj
so construed as to preveut any military ofaeer or
borough ofiicer from serving as Judge or Inspec
tor at anv general or special election in this Com
monwealth.
Also, that in the 8 1st section of said Act it is
enacted that "every general and Special Election
shall be opened between the hours of eight an J
ten o'clock in the forenoon, nnd shall continue
without interruption or adjournment, until seven
o'clock in the evening, when the polls shall be
closed. .
The general, special, city, incorporated district,
and township elections, and all elections for elec
tors of President aud Vice President of the Uui
ted S'ates, shall beheld and conducted by the
Inspectors and Judges elected as aforesaid, and
by clerks appointed as hereinafter provided.
No person shall be permitted to vote at any
election, as aforesaid, but a white freeman of the
aca of twenty one vara or more, who shall have
u aided in this State at Ieart on year, and in tha
election district where ho offers t j olj at least
ten days immediately precccding such election,
aud within two years paid a Stnte or Canity
tax wh!ch shall have been assesstx! at 1-at tei.

Unit! States, win had previously been a quali

and returned, aud who shall have resided iu the
election district, and paid taxes as aforesaid, shall

citizens of tL-c-Jnited States, between the ages
of twenty one and twenty-two years, and have
resided in the election district ten days as
aforesaid, shall be entitled to vote, although
they shall not have paid Taxes.
No person shall be permitted o vote whose
name is not contained in the list of taxable in
habitants, furnished by the Commissioner, unltss
first he produce a receipt for the payment within
two years of a State or CoiitAy tax, assessed
agreeably to the C institution fend give satisfac
toiy evidence, either on hi j own oath or afiirma
tion, or that of another, that he has paid such
tax, or ou failure to produce a receipt, shall make
oath of the payment theieof, or, second, if he
claim a right to vote by being au elector between
the age of twenty-one and twenty-two years, he
shall depose on oath or affirmation that he has
resided in the State at least cne year before his
application, and make such proof of his residence
in the district as is required by this Act and that
he does verily believe, from the accounts given
him, that he is of age aforesaid, aD-d give such
other evidence as is required by this act. where
upn the name of the person so admitted to vote,
shall be inserted in the Alphabetical list by the
Inspectors, and a note made opposite thereto by
writing the won! Tax" if he shaU be permitted
to vote by reason of having paid tax; cr the word
"Age" if he shall be admitted to vote by reason
of such age shall be called oat to the Clerks,
who shall make like notes in the list of voters
kept by them.
"In all cases where Ihe name of a person claim
ing to vote as found on the list furnish 'd by the
Commissioners and Assessor; or his right to vote,
whether found thereon or not is objected to by
any qualilk-d citizen, it shall be the duty of the
Inspectors to examine srtch persou on oath a-s to
his qualifications, and if he c!airr.s to have re

oath shall not be sufficient pfo-f thereof, but
shall make proof thereof by at least one compe
tent witness, who shall be a qualified elector,

be fined in any sum not exceeding JoOO, be im
prisoned for any time not less than one month,
