lying on the eastern side of the division line divi
ding said township into two election districts, said
division line beginning at a ci mcr of a tract of
hind warranted in the names of Alexander Car
lisle and Samuel Griffin, thence north 16J degrees
'west 970 perches to the Gidbraith road, it being
iho dividing line between Sumn- rhill and Cam
bria townships. Again commem ii,g at the corn

will act as Judge aud Francis K. Herlinger and
Sanuicl S. Paul, inspectors of said election.
And I further give notice, ns in and by the 13th
Section of the aforesaid Act I am directed to do,
That all persons, except Justices of the Peace,
whobLaii hold any office or appointment of profit
or trust under the government t f the United States
or of this State, or any City or,:incoTporated dis
trict, whether a commissioned officer or otherwise
a subordinate or agent, who is or shall" be employ
ed under the legislative, judiciary or executive de
partment of this State or the United States, or of
anj City cr incorporated district ; and alxi, that
every member of Congress or the State Legisla
ture, and of the select or common councils of any
incorporated district, is by law incapable of hold
ing or exercising, at the same timo, the office or
appointment of Judge, Inspector or Clerk of any
election of this Commonwealth, and that no In
spector, or Judge, or other officer of any such -election
shall be eligible to any office then voted for.
Also, in the 4th Section of the Act of .Assembly,
entitled, "An Act relating to elections and for
other purposes" approved the 16th day of April
1850. it is enacted that the foregoing 13th Section
shall not be so construed as to prevent any militia
oflicer or borough officer from serving as Judge or
Inspector at tiny general or special election in this
Common weal tli.
'Pursuant to the provisions contained in the Act
first aforesaid, the judges of the aforesaid districts
shall respectfully take charges of the certificate
or return of their respective districts, and produce
thein at a meeting of one judge from each district
at the Court House, in the Borough of Ebensburg,
on the third day after the day of election, being
Friday, the 17th day of October, A. I). 1850,
then and there to do and perform those duties re
quired of them bv law.
A nd fui thcr, if any judge, by sickness 01 una
voidable neeident, is unable to attend said meet
ing of judgss, the certificate or return afroesaid
shall be taken charge of by one of the inspectors
r clerks of the election of the district who shall
do and perform the duties required of said Judge
unable to attend.

property of Daniel Kcefe, deceased, will le ex

in Gallitzin, Cfmbria county, on

or less, adjoining lauds., of the Pennsylvania Rail
