and by the 13th section of the aforesaid act I
am directed, "that every person, excepting jus.
lice of the peace, who shall hold any office or
appointment of profit or trust under the Gov
ernment of the United -State or of this State,
or any city or incorporate district, whether a
commissioned officer or otherwise, a subordi
nate officer or agent who is or shall be, employ
ed under the legislative, judiciary, or executive
.department of tnis State or United Slates, or
ofanycityor incorporate district; and also,
that every member of Congress , and the State
Lagislituie and of the select or common coun
cil of any city commissioners of any incorpo
rate districts, is by law incapable of holding or
exercising at the same time, the office ,or ap
pointment of judge, inspector or clerk o f any
election of this commonwealth, and that no in
spector or judge or other officer of any such
election, shall be illegible to aiy office then to
be voted for."
Also .that in the fourth section of the act of
Assembly, entitled, "An Act relating to execu
tion and for other purposes," approved April
16, 1 840 it is enacted that the aforesaid 13ih
section "shall not be constructed as to prevent
any militia officer or borough officer from ser
ving as judge, inspector or clerk, at any gen
eral or special election in this Commonweallb.

ahall be closed.
The general, special, city in incorporate dis
trict and township elections, and all elections
for electors of president and vice president of
the United States, shall be herd and conducted
by the inspectors and judges elected as afore
said , and by clerks appointed as in hereinafter
provided.
No person shall be permitted to vote at any
election, as aforesaid but a white freeman of
the age of twenty-one years or more, who shall
have resided in this state at least one year, and
jn the election district where he offers to vote
at least ten days immediately preceding such
election, and within two years paid a stale or
county tax, which shall have been assessed at
least ten days before the election. Put a citi
xen of the united stales who has previously
Jeen a qualified voter of this stale, and removed
therefrom and returned, and who shall have
resided in the election district, end paid taxes
as efnreiaid, shall be entitled to vote after re
siding in this atate six months. Provided, That
the white freeman, citizens of the united states
between the ages of 21 and 22 years, and have
resided in tb elector) district ten days as
aforesaid, shall be rntitJed to rote, although
they shall not have paid taxes.
"No person shall be permitted to Yule whose
name is not contained in
habitants furnished by the commissioners unless

in two years, of a state or county tax ascssed
agreeably to the constitution, and give satisfac
tory evidence either on his own outh or affir
mation of another, that has paid s'icit a lax, or
011 failure to produce a receipt, shall make oath
of the payment thereof, or 2nd if ho claim a
rigiil 1j vote by being1 an elector between the
age f 21 and 22 years, he slull depose on oath
or affirmation, that he has resided in the slate
at least one year before his application and
make such proof of his residence in the district
as is required by this act, and that he does ver
ily believe, frem the accounts given him thai
he is of age aforesaid, and give such olher evi
dence as is required by this act, whereupon the
name of the person eo admitted to vote, shall be
inserted in the alphabetical lisl by the inspec
tors and a note made opposite thereto bv wri
ting the word "tax," if he shall be admitted to
vote by reason of having paid tax, or the word
age, il be shall be admitted to vote bv reason
of such age shall be called out to the clerks,
who shall make the like notes in the list of vo
ters kept by them .
"In all cases where the name of the person
claiming to vote is found on the list furnished
by the commissioner? and assessor, or his light
to vole whether found thereon or not is objected
to by any qualiheu citizen, it snail be the duty
ot Ihe inspectors to examine such person on
oath as to his qualifications, and if he claims to
have resided within the state for one year or
more, his oath shall not be sufficient proof
thereof, but shall make proof there by at least
one competent witness, who shall be aqunhfied
elector, that he has resided within the district
for more than ten diys next preceding said elec
tion and shall also himself swear that his bona
fid a. residence in pursuance of his lawful calling
is within the uistnct, and that he did not re.
move into said district for the purpose of voting
therein.
'Every person qualified as aforesaid and who
shall make due proof, if required, of his resi
dence and payment 01 taxes, as aforesaid, shall
be admitted to vole in the township, ward or
district, in which he shall reside.
"If any person shall prevent or attempt to
prevent any officer of any election under this
act, from holding such election, or use or
threaten any violence to any such officer, or
shall interrupt or improperly interfere with him
111 the execution of his duty, or shall block up
the window, or avenue to any wiudow where
the same may bo holding, or shall riotously dis
turb the peace at such election, or shall use or
practice any intimidating threats, force or vi
olence, with design to influence unduly or over
awe any elector or to prevent him from voting
or restrain the freedom of choice, such person
on conviction shall be fined in any sum not
exceeding $500 for any time not less than 1
mouth nor more than 12 months, and if it shall
be shown to the court, where the trial of such
offence shall be had, that the person so offend
ing was not a resident of the city, ward, or dis
trict, or township where the said offence was
committed, and not entitled to vote therein,
then on conviction, he shall be sentenced to
pay a fine of not less than S100 nor more
lhan 1,000, and be imprisoned not less than
6 months nor more than 2 years.
1 also make known, that by an Act, passed
the 9ih day of April, 1650. for the purpose of
a sccrtaining, by a vote of the people, a pro.
posed amendment to the Constitution, a copy
of which amendment added hereto, and by the
following Proclamation of the Governor, it is
provided.

inspectors and clerks of each of said townships.

duly qualified to vote for members of the Gen
eral assembly, and deposit them in a box or

proper officers, which tickets shall be labelled
on the outside "amendment;" and those who
are favorable to the amendment may express
their desire by voting each a written or print
ed, or partly written and partly printed ballot!
containing on the inside thereof the words,
"for the amendmeut," and those who are op
posed to such amendment, may express their
opposition by voting each a similar ballot,
containing on the inside thereof the words,
"against the amendment."
I make known that by an Act, passed the
9th day of April, 1850, "Relative to the Elec
tion of Auditor General, Surveyor General and
County Surveyor by the people," it is provided -
Sec. 1. Be it enacted by the Senate
and House of Representatives of the
Commonwealth of Pennsylvania in
General Assembly met, and it is hereby
enacted by the authority of the same.
That the qualified voters of this common
wealth shall choose by ballot, one person to
nil the office of Auditor General, and one per.
son to nil the omce ot surveyor uenerai, on
the 2d Tuesday of October, Anno Domini, one
thousand eight hundred and fifty, and at thei r
general election every third year thereafter.
Sec. d. 1 hat the general election laws now
in force for the choice of a governor of this
commonwealth, shall regulate the elections of
Auditor General and Surveyor General; and in
case any vacancy should occur in either of
said offices, by death resignation or otherwise,
the same shall be filled by appointment of the
Governor; aud the person so appointed shall
continue in office until the end of the term for
which his predecessor was elected.
Sec. 5. That the qualified voters " of each
county of this commonwealth shall on the
second Tuesday of October next, and on the
same day every third year thereafter, elect one
competent persons, being a practica surveyor,
to act as county surveyor for the proper coun
ty for the term of three years, who shall do
and perform all the duties, and have and re
ceive all the emoluments now pertaining to the
respective deputies of the surveyor general.
I also .make known that by an Act passed
the third day of May, 1650, "Providing for the
election of District Attorneys," it is provided.
Sec. 1. Be it enacted by the Senate
and House of Representatives of the
Commonwealth of Pennsylvania in
General Assembly met, and it is hereby
enacted by the authority of the same,
That the qualified voters of the city and
county of Philadelphia, and of each and every
county in the state, shall at the general elec
tion on the second Tuesday of October next,
and every three years thereafter, elect cue per.
son, learned in the law, who has been two
years admitted to the bar, and who shall have
resided in the county for which he is elected
fur one tear next proceeding his election, who
shall be called the district attorney of said
county.

cUIature, at two successive cessions of the

And WneaEAS, the Constitntion of the said
Commonwealth requires that any amendment
so agreed spon shall be submitted to the peo
ple, in such manner, and at such time, at least
three months after being so agreed lo by the
honses, as the Legislature shall prescribe.
And Whereas, by an Act of the General
Assembly of the Stale, passed the ninth day
of April, Anno Domini, one thousand eight
hundred and fifty; it is provided "that for the
purpose of ascertaining the sense of the citi
zens of this Commonwealth, in regard to the
adoption or rejection of the -said amendment,
the Governor of this Commonwealth shall is
sue a writ of election directed to the sheriff of
each and every county of this Commonwealth,
commanding them to give nolice in the usual
manner, that an election will be held in each
of the townships, wards and districts therein,
on the second Tuesday in October, in the year
of our Lord one thousand night hundred and
fifty for the purpose of deciding upon the adop
tion or rejection of the said amendment; which
eaid election shall be held at the places, and
be opened and closed at the time at and. within
which the general elections of this Common
weaUh are held, opened and closed."
Now Therefore, in obedience to the re
quirements of the tenth article of the Consti
tution, and in accordance with the true intent
and meaning of the said Act of the General
Assembly of this Commonwealth, I William
F. Johnston, Governor of the said Common
wealth of Pennsylvania, do issue this writ
commanding and requiring you the said John
Brawlev, Sheriff of Cambria, couuty, to give
notice in the usual manner that an election
will be held according to the terms of the Con
stitution, and provisions of the act of the Gen
eral assembly aforesaid, in each of the town
ships, wards and districts therein, on the sec
ond Tuesday in October, in the year of our
Lord one thousand eight hundred and fifty,
for the purpose of deciding upon the adoption
or rejection of said amendment.

August, in the year of our Lord one thousand

Relative to an intendment of the Con

tentative of the Commonwealth of Pennsylva
nia, in General Assembly met, That the Con
stitution of this Commonwealth be amended
in the second section of the fifth article, so
that it shall read as fallows: Tho Judges of the
Supreme Court, of the sevferal Courts of Com-
man Picas, and of such other Courts of Record
as are or shall be established by lew shall be
elected by the qualified electors of the Com
monwealth, in the manner following, to wit:
The Judges of the. Supreme Court, by tho
qualified electors of the commonwealth at largt:
the President J udges of the several Courts of
Common 1 leas, and of such other Courts of
Record as are or shall be established by law,
and all olher Judges required to be learned in
the law, by the qualified electors of the res
pective districts, over which they are lo pre
side or act as Judges; and the Associate Judges
of the Courts of Common Pleas by the quali
fied electors of the counties respectively. The
Judges of the Supreme Court shall hold their
offices for the term of fifteen years, if they
shall so long behave themselves well, (subject
to the allotment hereinafter provided for, tub
sequent to the first election.) the President
Judges of the several Courts of Common Pleas,
and of such olher Courts of Record, as are or
shall be established by law, and all other
Judges required to be learned in the law, shall
hold their offices for the term of ten years, if
they shi.ll so long behave themselves well; the
Associate Judges of the Courts of Common
Pleas shall hold their offices for the term of
five years, if they shall so long behave them
selves well; all of whom shall be commissioned
by the Governor, but for any reasonable cause,
which shall not be sufficient grounds of im
pe'achment, the Governor shall remove any of
them ori the address of two thirds of each
branch of ihe Legislature. The first election
shall take place a; the general election of this
Commonwealth next afte rthe adoption of this
amendment, and the commissions of all the
Judges who may be then in offico shall expire
on the first Monday of December following,
when the terms of the new Judges shall com
mence. The person who shall then be elected
Judges of the Supreme Court shall hold their
offices as follows: One of tbem for three years,
one for sit years, one for nine years, one for
twelve years, and one for fifteen years, the
term of each to be decided by lot by the said
Judges, as soon after the election as conve
nient, and the result certified by them to the
Governor, that tho commissions may be issued
in accordance thereto. The Judge whose com.
mission w ill first expire, shall be Chief Justice
during his term, and theieafter each Judge
whose commission shall expire shall in turn
be tli e Chief Justice, and if two or more co ji
mi ssionshall expire on the Bame, tho Judges
holding them shall decide by lot which shall
bo the Chief Justice. Any vacancies, hap
pening by death, resignation or otherwise, in
any of the said courts, shall be filled by ap
pointment by the Governor, to continue till
the first Monday of December suceeedia l he
next general election. Tin Judges of the
Supreme Court and the Presidents of the sev
eral Courts of Common Pleas, shall, ot stated
times, receive for their services an adequate
c oinpensalion, to be fixed by law, which shall
not be diminished during their continuance in
office; but they shall receive no fees cr perqui
sites of office, nor hold any olher office of profit
under this Commonwealth, or under the gov
ernment of the United States, or any other
Stale of this Union. The Judges of the Su
preme Court, during their continuance in office
ball reside within this Commonwealth; and
the other Judges during their continuance in
office, shall reside within the district or coun
ty for which they were respectively elected.

Stray Cow.
CAME to the residence of the subscriber in
Jackson township, nn the Iudiana Turnpike,
on the 16th of August inst., a dark red COW,
with a star in her forehead. She has a bell on
her neck and is supposed to be eight or nine
years old. The owner is requested to come
forward, prove property, pay charges and take
her away, otherwise she will be disposed of
according to law.
