ALMOST A Pinr..—On last Saturday
night,. while Prof. S. N. Lutz was en
gaged in instructing his class in vocal
music,. in the Odd Fellows
,Hall, in New
Kingston, the chimney of-the lamps in
the Hall below was knocked off, and the
light extinguished. The janitor --at
tempiedto relight the lamps, and while
doing so; `it exploded, setting tire to the
oil, which immediately blazed as high as
the ceiling. An alarm was immediately
raised, And%the fire extinguished by the
exertions of Agustus Karns and David
*anbaugh, before any damage was
done. •

next. Its career. has been one of the
most successful in the history of Ameri
can journalism. Every department is
conducted with ability. Its Foreign
Corresponlance is unrivalled, and its
independence in Commenting upon 'politi-
Cal cotruptionti, is in the highest degree
praise-worthy.
We notice that it appears in a "New
Dress," and also announces that the suc
cess of he Year Book for 1871 will result
in Volume No. 2 for 1872, which will be
still more complete in its statistical' and
other tables of information, and in its
general arrangement.
Such enterprise deserves success, and
we advise our readers to send for a
'specimen copy of the paper. New- Sub
scribers will receive the Vapor free until

' READING FOP:SUPERVISOR& —We have
-often-.directed-the- attention- of-Supervis
ors to the fact that their. neglect to'
have - bridges and roads kept in ,repair
subjects them and the election -districts
which they represent to damages if any
accident should -occur in consequence of
unsafe 'bridges and roads. We now
point supervisors to a case recently de
cided by the courts; which May induce
them to the full performance of their
duties. On a dark night in 1800, a
teamster employed by Michael It. Moore,
of Lancaster county, drove over the
bridge which spans the Chigoes, divid
ing Rapho and West Hempfield town
ships, and the team broke through the
structure into the water, killing a valua
ble horse, breaking the wagon and des
troying a quantity of grain. To receive
damages7' an action was instituted by
Moore against the above 'townships. It
was shown that the bridge was rotten,
and that if the ordinary tests had been
used by the Supervisors, the defects
could easily have been detected. Under
this evidence the court charged that the
townships were liable—the question of
negligence being referred to the jury.
The jury found $378 03 for the plaintiff.
On a writ of error the Supreme Court
affirmed the judgment of the Common
Pleas, and delivered an opinion defining.
the liabilities and duties of Supervisors.
Its substance_ is embraced in the fellow
.
ing points :
1. Bridges are treated as portions of
the highways which cross them,-aud are
to be maintained and kept in repair by
the Supervisors of the township.
2. The neglect of the Supervisors to
keep them in repair, subject's them to a
personal liability ; but doe not lessen
- the primarybdit o.townships to
those who suffer injury from their
neglect.
3. What is negligence must depend
upon the peculiar circumstances of each
case, and is a question for the jury.
4. Great danger demands higher
vigilance and more effectual means to
secure safety.
5. Applying those principles here it
may be asked, what structure more im
portant in view of Hie safety of life and
property, can -be well imagined Wan
such a bridge as this, having a span of
fifty-two feet, crossing from ten to
twelve feet above the stream, whose
water is middle deep. The accident
itself is evidence, of its important
character. The plaintiff's wagon was
overturned in the fall, the body crushed,
tfile load of wh - eat fell underneath it into
the stream and one of the horses was
killed. As remarked by our brother
Read—" A bridge looks fair till it breaks
doWn—it'is not like a pit which you can
see and avoid." In practice, it is used
up to tile last monument. Hence such a
structure demands-'constant vigilance to
guard and. preserve V. Therefore wheni
a bridge is old, having stood for the
length of time the timbers composing it
are accustomed to last, and whop kt may
•he remisonably expected that decay - -has
set in, it is negligence to omit all proper
precautions to ascertain its trno cons.
&Lion. Nor will mere appearance in
such a case excuse the neglect. It is a
matter of common - knoUledge-that in
viasible -defeets-rmay,. and, under .such
circumstances, probably - do exist—that
either wet or dry rot may,have set in and
uot be visible, and therefore should be
nought for. But no one .of ordinary in
telligence would think of seeking for an
unsound ankinvisiblO"defuct by merely
inspecting the surface of the wood.
This being the case, it is clearly the duty
of the-Supervisors, having thus- reason
to believe that defects may •exist, to call
to their astiistance those whose skill will
enable them to ascertain the true
,state
of the structure, and determine the
question of its, safety. Without doing
this much at least, their duty to the
public is not' performed ; not to do it, is
therefore 'negligence, and this iS the
point On which the ease went to the joy.
There is, therefore, no error yin the
