'Which a person who makes, it his business
to sell the products of his.own farm from
a stall or sland is required to pay a
special tax as produce broker. It in
enacted in paragraph thirteen, of see
-rim]
that every persim other than one lraviug
paid the special tax as a oommercial
broker or cattle broker, or wholesale or
retail dealer, or pedlar, whose occupa
tion itj.s to buy or sell agricultural or
faint products; and Iyhose annual sales
do - not eficeed $1 0,000, shall be regarded
as a produce loaer. Lt determing the
liability of a Milner to the special tax of
a produce broker it is necessary to in
quire whether it. is his occupation to
buy or sell agricultural or farm products,
and also whether he is exempted from
that tax by any other proCisions of the
statute. IL is provided in section seventy
four of the act of June :10, 1 WI, as
amended by the act of July 18, 1811;1,
that no special tax shall be required of
producers for selling their own products
at the place of production, &c„ and ill
paragraph thilly-two of section seTnty.
nine, that no man shall lie required to
pay a special tax for peddling the pro
ducts or his 01511 Cann or garden.
These are the only exemptions I find:
If, as it has been claimed, it was not the
intention of Congress to tax a farmer for
selling the products of his own farm in
any way whatever, it would seem strange
why these special limited exemptions
anfl'i•xceptiohs should have Leer made
in his favor. Why should he have been
exempted from a non existing. tax?
However desirous I may lie to - relieve
farmers t si xin tax for selling the , produets
of their) wn Bums, I am tumble to find
. alllO legal authority to do it, if it is their
occupation to Sell them, miles; they
fall within one of the exemptions or ex
ceptions above mentioned. The ruling
.under_which a person who makes it his
occupation to sell the . prodncts of 'his
farm from a stall or stand is required to
pay a special tax as produce broker
should he - construed with the utmost
liberality, giving him the benefit of all
doubts respecting , liis liability. It can
not, ordinarily, be said to lie the occti
pation or a farmer to sell his products.
It is his occupation to Min- them. The
selling is all incident to the production.
It is only when he makes such selling Inc
regular and constant bliSiness that he
should be reduired to 'pay the tax,
You will give your assistants the'
necessary instructions and will take
special pains to cause a liberal construc
tion 'of the laW in this behalf towards
producers. Very respeetfaiy,
C. DELANO: COmmissioner
