o'clock P. M.
. After supper he. said he was going to
stony point to get some Money ehanged,and
returned about eight o'clock -with some
candy=-on morning he' wont to
Smith's, and Odd him $0,50 for meet, and,
butter, and - returned - with it. In the after
noon. Titus and his wife wont to Shippens
burg and bought and paid for •the•articles•
enumerated, a. - nounting to $2B. Qn Fri
day morning he said be was going - to Mar
tin. Idooneys'i hevcventaway and-Mrs. Fry
and .her son and daUghter noticed that the
shovel had disappeared from the bog-per,
where Titus had put it,the.day before. --
He, rotated before. dinner-with his pants and feet) bespattered with mud, and on that
morning ho returned the mattock which
he had borrowed the day boforo from Mrs.
'Worley.. This evidence shows oonclusive•
ly that the grave was dug and, - the body
buried on Friday-and other evidence'
proves as conelesively that the prisoner
expended at Smiths' and in Shippensburg;
on Thursday, between thirty and forty
dollars., This money must therefore have
been taken from Stahm on-the day ho was,
Murdered, for it was expended by defen.•
'dant the day before he hefted the bedy.
" TIM prisoner's counsel further allege that
the murder may babe been committed in
a quarrel, after blows bed been interchang
ed by the parties. This allegation is made
upon the declaration of the prisoner, to
one witness that Stalam struck at him with,
.a club and then he struck him-with the
axe and cut him with the bit, of the axe
before he fell on the ground—that he and
Stahm had quarrelled. To another he
said he strueis Stahel on the head with the
pole-of the axe and cut him in the peek
with the bit.
In these conversations the prisoner did not
allege that Stalin) had struck him.hut only
struck at him with a club; and there is no
_exidettemcorobo'retive-o-this-stateme , tt-or
that any Club had been used—No club was
found upon the groUnd, Gut the - root of u

of the grave; which was near to trees.
The facts in evidence in this ease point un
erringly to. the degree of crime of which
-the defendant, is-guilty beyond-alliroom-for
doubt—The prisoner tools the deceased to
his house-twice he obtained money from
him to supply the wants of his family and
being rensed the third time, then within
an hour or two, u: ler the pretext of cut. ,
ting wood, ho takes the deceased, to a low
secluded spot, obscured from view by the
surrounding hills ; and by the margin of a
pond,, a fit place CO conceal the dead body,
he cruelly murders him by repeated. blows
almost severing the head from the body,

-er,. wo lament the conclusion to which the
evidence has brought us. The life of u
human being, by the plea in Oils case, has
been placed in out:: hands, and we are re
quired to perform a respons" ale and solemn
duty which seldom devolves, upon the cour t
alone unaided by the verdict of a jury— we
believe this is the first case in Pennsylva
nia under the lief of 1704, where ups' the
plea of guilty to an indictment for murder.

the degree of murder of which ,the (Wend-,
ant is guilty—ln performing the momeM
teus and so einn duty. which we owe to the
prisoner and to the public, it is a sour, e of
satisfaction which in a measure alleviates
thegrave andsplemn duty the law has im
pressed upon us,' that the clear and uncon
tradietedevidence to which we have refer
red will net permit us to entertain any
doubt that the prisoner is guily of murder
of the first degree. '
And how 17 August 1809. The Court
after having examined the witnesses on
part of the Commonwealth and of the de
fendant, do determine and adjudge that
Adam Titus, the defendant, is guilty of the
crime of murder of the first degree. By
the 'Court.

A. B. Sharper Esq., counsel for the pris
oner moved that judgment be arrested as
reasons filed.
The Court overruled the motion in ar
rest of judgment, Whereupen U. E. Ma •
giaughlim.Esq., District Attorney, moved
the Court for jiidgment in favor of the
Commonwealth, and that the sentence of
the law be pronounced upon the prisoner.
The court then asked the prisoner if ho
had anythihg to say why sentence of death
should rot be pronounced on him, to which
Adam-Titus the prisoner replied that be
