Wilson, trading as Wilson 4„1997 Summons in debt on book account running from December - 18, 1858 to January 1859. for $Bl3 84 with interest for G years. The prin cipal cause of action was for the price of a Boynton Furnace which Mr. Rand put into the Academy at Mechanicsburg. There had been great difficulty in getting tt proper heat er for the building. Messrs. Wilson con tracted with the owner, Mr. Solomon P. q4orgas to furnish it with a heater, but they ',ending to do so, got Mr. Rand of 124 North fi street, Philadelphia, to supply the building 'with proper heaters. Ile put up, what was isroved by Defendants themselves, a heater of the very best quality and which was high ly recommended. Defendants allege, however, that they had contracted with him to furnish such heaters as would heat the building properly and thoroughly; that they had represented it impossible to heat it owing to the faulty con struction of the building; and that he was confident that the heater of which he was the agent, could and should heat it, and that it had not. The heater remained in the build ing in which it had been vitt up at the ex pense of Plaintiff.—Verdict for Defendants. Penrose, Henderson and Hays for Plaintiff. G, od of Hagerstown, Maryltu d, but'Lewis Robinson was substituted as prosecutor upon motion, tttb Jan. 1805. True Bill. On the 11th Aug. 18131, Good had two borses stolen from him by W. 0. Ferris and and James B. Thomas, who came to Carlisle and sold them to Brightbill for 15 1. B. sold .one to Robinson, and lfingwalt got the other. Noticct by telegraph reached Newt illy where Mr. B. went a few nlayi after, that these horses had been stolen. B. believes that he had one that was described And telegraphed to G. to that effect—lie came on, gave hint $l5O fur the information that led to the re .tivery of one horse. Noble '.got $143 for the recovery of the other, and it was con tended by Robinson that N. had no right to the reward, he had concealed his knowledge of the whereabouts of the horse, and lie was not entitled to the reward and the money paid for the horse.
