The petition of Catherine :tidily, Aduilnistratrlx of
Jacob Stehly. deed.. respectfully represents; That Jacob
Reidy, late of Westmoreland County, having gizen up
his residence In said County for the purpose of seating'
elsewhere, died on the 27th day of July last intestate,
that Letters of Administration were duly granted
to your petitioner (his widow).by the Register of Cum
berland County (in which county the only property
left by the decedent is situated) on his estate. That the
said Jacob Stehly, during his lifetitue,and shortly before
his death, was siezed In fee for a certain liouse and Lot
of ground in the borrough ofShippensbrug, In said Coun
ty 64 feet in front on Main Street. and 2i7 feet bath,
Mounded by Lot of Perry Stanton on the east, and by
public alleys on the south and west. Thai shortly be
fore the death of your intestate. to wit, on the 12th day
of June A. D. 1851 he entered into a written agreement
with a certain George Forney, to convey to the said
George Forney the said !louse and Lot of ground. for the
511111 of three hundred and seventy five dollars in the
following payments, to wit; $: , O, payable on the articles,
and the residue on the Ist 4.'4' April A. It. ISO 2, at' which
time the Deed was to be made and possession given:—
That in pursuance of said contrail, the said George
Forney pald the said Jacob Stably the sum of
fifty dollars. and was PUT INTO POSPSION of the property
which he and his representatives and heirs have had in
pesse...sion from that time up to the present date. That
said contract has been so far executed, that it would be
against o.mitc to rescind the lalne,:ind that no provision
for the preforms nee of said contract was made by the
decedent. :old having died without having made and
..delivemd a Deed to the said George Forney for said pro
perty, and without having received any further p.ty

of. said contract the said George Forney has also died,
leaving a widow named Magdalene, .and children and
grand children. to wit: Christian Ferney. Mary. Inter
married with George Hannan, Eliza4th, intermarried

Adam. Fredit Forney. Farah. intermarried with Jacob
hither, Catherine, intermarticil with Joshua McClure,
Rebecca. Intermarried with William Fray, Mary, inter
married w Ith JO] Barklow, William Forney, who died
leaving one child, Charles, Resarina, Intermarried with
Iliotry (los/mit, and Hannah intermart led with Famuel
Green. 'That Jacob Heck is his administrator.
Your petitioner therefore. prays tie Court to award a
citation directed to the said .Administrzttor and to the
widow and heirs nt law of the said George Forney, de
ceased, commanding them to appear in Court, and an
swer lids petition nt a day and time to be fixed by the
Court, and if cause be not shown to the contrary. Your
petitioner further prays the decree of the Court for a
specific performance of said .confract: according to The
true intent and tneaming, and that a conveyance may
be made under said decree. by 'yotirptititioner, of the
rlg,lit and title of the said Jacob Stchly to the widow

in trust for them. and that your petitioner fluty receive
from the party or parties to whom said conveyance shalt
