This act was frothed' br.the Commissioners,
who were appointed to revise the civil code. The
Report Was accompanied by remarks and explana.
thins on each particular section: ‘Vitli regard to
the 1 2 and
.3 sections, the only material sections
to this case„they say "The first and second sec.
tions contain all the provisions of the several laws.
now existing; which give jurisdiction to the
Court, to grunt relief in the case of insolvent deb.
tors. "See 111 isTrom I sec..of the Act-or 1814,
theist sec of the Act of 1815 and the .Ist sec.
of the Act of )820." Turning,to these sections,
'-- we fired the'first one referred to, prievdes that.any
person in' actual confinement for the recovery of
• moneY, &c. n - ho shall have resided with in the
State six months immediately preceding such con
,finetnent, may apply and take the benefit &c. Thu
next Act refereed to(1810 provides that the same

have not resided six months in the State. imrnedi.
ately preceding their confinement, eovided, that
.stn person who has not resided therein six months,
vhall he entitled to the benefit thereof,' until con-
tined for three months, &c. The next Act, 1820
referred to, is in these words: "That if any deb.
Aor shall-hernafter - bo'airested, or execu
tion on a bail piccolo a civil snit, and who.shall
_have resided six . months in the 'Clorniiionwealth
;previously thereto, he may apply when arrested in
execution to the president or associate judge, &c.
end giVe bend ,&c.
Tho second section of the' Act of 1836, con.
ilenscs the above provisions into three divisions:
."1 In the case of persons arrested or detained by
'virtue. of any process issued &c." "2 In the
ease of a person held on a bail piece &c. and 3,
In the case of a debtor not arrested, detailed or
itchd as aforesaid &c." . .
Tire Acttherethro recognizes two distinct clas
ses or cases to wit : lunnlnntary, or when 'ar-rcxt
ed of detained; and voluntary, or when not ar
rested or detained. _ , .
With these distinctions, the fitncied incongruity
of that little 3d section excluding the applicant,
‘anishes into nothing, and each and every pert-of
Lbc, law is reconcilable will the other.; is rational,
and afriirds the relief intended, to every applicant, ,
vs he shall range himself in the one or•the other
liinss. If of the first class, that is, arrested or de
linnetl by process, his residence must date, six
months retrospectively from that time. If atilt:
second class, that is a voluntary applicant, not ar
rested, he must have resided within the state six
months immediately preceding his application.
InAltis_canc, there is_amothex_putied from 'which
to date the six mopthz retrospectively.
His Honor therefore fell into two errors, floal
to the' interests and personal liberty of the appli.
cant; first, in confetunfmg the two distinct classn
of cares, and deciding in effect that the applicant
must abide within the Ceminonwealth for fix
months immediately preceding the time of his
discharge ; and sccondly,in confininding the rights
of one who is a:citizen at the time he is arrested,
with the disabilities of one, who is not a six
months resident.;
• The -,confolinding 'and mingling these distine.
thins and rights, by which the applicant was re•
timed the benefit .Cc. were riot thought of much
consequence, as by surrendering himself to jail
in discharge of his bail, he would so instenti, he
felicved by the Act abolishing iinprlsuninent for
debt, passed the 12th day of July, 1842. Broad
and expansive as its provisions nre, his Honor did
not think it covered this ease L—that the statute on
insolvency and this one, were to be construed in,
Mari material This was another fatal- error of
his goner. The provisions of the Insolvent law,
,with its distinctions and requirements are render.
• ed to all intents and purposes, in all eases
of doted arising, ex.eiintracta, (except in cases'of
• fraud - or tialtintarsi insolvency) by the provisions'
•of the Ace abolishing imprisonment for debt, an.
tiihilating even the distinction betiveen resident
and non-resident, and extending its protection to
indiseritninately/ REPORTER.
