Natural Gas Co , bill in equity asking

by the Gas Co. and th« Plate Glass
works is supplied with gas at a meter
rate per cubic foot. The bill states the
(Jas Go wants to abandon the wells and
will not sell them for more than they
are worth. A settlement is likely.

damages by viewers in the matter of
opening Wayne St, westward to Fair

Mrs. Mary C. Krut, sime.
Mary Colinet vs August Colinet of
Butler, divorce. Crnel and barbarous
treatment and abuse is alleged.
John Young vs Robert W. Hervey of
Allegheny, summons in assumpsit for
$22,128. On Aug. 21, the parties enter
ed into an agreement by which Young
sold his farm to Heryey for S2OO per
acre. The property consists of 110
acres, two miles west of town. ' Of the
purchase money SSO was paid in hand,
SIIOOO was to be paid in 30 dajs and the
rest at longer periods, secured. Ilervev
did not pny the SB.<K)O and the suit re
sulted. His defense is that Young can
not give him a good title because it can
not lie traced back of 1867 when the
laud was alloted in partition proceed
ings to David Borland as a part of the
estate of WE Borland, dee d. J. M.
Galbreath appeared for Young and
W. A. Booth of Pittsburg and Williams
& Mitchell for Hervey. Jury trial was
waived and a stated case made on law
points.
TRIAL LIST.
On motion of the defendant company
a compulsory nonsuit at the plf's cost
was granted in the case of Mrs. Mar
garet Goddard of Callery vs the Forest
Oil Co. for damages for the death of her
husband.

lips aud Hartzell vs Phillips were con
tinued.
Friday, Saturday and part of Monday
were occupied with, the assumpsit suit
of Bella Pearl Adams against R.'Lycur
gus Hindman for $3,000 for breach of
promise to marry.
The plaintiff in a daughter of John
(painty Adams,the Fairview hotel keep
er. The defendant is a son of Stewart
Hindiuau of Concord twp, and is a
driller and contractor.
Besides herself, the witnesses for the
plaintiff were her sister, Dora, her fath
er, Mrs. F. W. Linger man and Rev.
Althouee. They showed in brief that
the yarties became acquainted in 1807;
engaged iu I*l*B. and continued to keep
company two or three times a week un
til May 30. 1002; that Hindman called
the plaintiff Mrs. Hindman in the pres
ence of members of her family; that he
wrote a letter from Scio, 0., telling her
she should be bis wife: that he bought
for her or gave her money to buy rings,
cloaks, a brooch, hat, etc.: that he gave
her an engagement ring in the presence
of Mrs. Lingerman (then Maude lieat
ty): that while she was on a visit he told
her if she did not return soon he would
break the engagement; that la*t spring
he began going with a Miss Hinnian of
I'etrolia and then told the plaintiff he
would not marry her.
For the defense an attack was made
on Miss Adams' reputation and Mrs.
Isaac Davis, Harry Sheaklev, Hattie
Wiles. Mrs. Dodds, Newt Wilson, Wal
ter EUenberger, Frauk Snrth, Curt
Kaukin, Sadie Elleul>erger and Walter
Dufty told of her attending questiona
ble dani-es; receiying attentions from
other men, mentioning a Barnhart and
Mortimer; drinking beer, etc. Dr.
Thomas was placed on the stand to tes
tify about an illness of Miss Adams, but
knew nothing. Hindman, the defend
ant. went on the stand and made some
grave admissions implicating himself.
Miss Adams and a Chicora physician.
He also admitted that when Deputy
Sheriff Hoon went to the Hinman resi
dence in Petrolia to arrest him on the
capias issued when the suit was com
menced that he had resisted the officer.
Lev McQuistion addressed the jury
for the defense and S. F. Bowser for the
plaintiff. Monday the jury was charg
ed and rendered a verdict of $1,2:17 for
the plaintiff. A motion was made for
a new trial.
NOTES.
A process was issued Monday for Jas
Clinton, who is accused of a&b, entered
bail for his appearance and failed to
appear.
Thi- larceny charge made against P.
Wtisenstein by Ida Sturn was with
drawn.
Charles Concil plead guilty Monday
to agg a&b on Hymen C. Fisher and
was fiued S2O and sent to jail for 20
days.
Constables T. C. Campbell of Slippery
rock and James Klngh of Karus City
resigned.
The case of Com. vs John Craig was
settled.
L. Cohen, a Fair Ground ave. store
keeper has been held for trial on a
charge of extortion made by Mike
Mehichle, who alleges that Cohen ac
cused him of stealing a handful of salt
and made him pay $lO or be arrested.
All the Sheriff Hales were adjourned
to the coming Friflay and sale of sever
al other farms was adjourned.

morning. By reason of a switch being

roof, with his hip and back injured.
James Bradley of Butler, a fireman
on the ''Bessie," fell from his engine at
Erie, on Thanksgiuing day, and was so
badly injured that he was taken to a
hospital there.
H. D. West, a southern boy. was
caught between ff eight vars, while
helping to make up a train, early Tues
day morning, and crushed to death.
John Wnddell slipped and fell over a
wheelbarrow in the yard as his home at
Piano, Tnesday, breaking two ribs.
