It was charged that this Was not a lawful resignation, told this vote of Nevada was recommitted. like, the Michigan ease, for the separate action under the,Electoral act of the two houses. Both houses having voted to count Ne vada.; Oregon, the third grand battle field of the count, was reached. .The two sets of certificates were opened, read, objected to; and subtnitte.d to the commission for ari.iument and the hearing of testimony. Wheel er. Next followed:the reading of the cer teificates from the state. of Pennsylvania, gWirig twenty-eight votes for Hayes and Wheeler. ' Objection having been made oil the ground that one of the electors was a Centennial Commissioner the Sen. ate withdrew and the Jiouse took a re cess' until Monday at ko'clock. In this State one of the - electors, Dan iel J. Morrell was a Centennial Commiss ioner but clid not atteud the meeting of the-College, who filled the vacancy: - The case' was presented to the House ;by Stenger, of Chambersburg, who • re ,fered to the adjudicated case 'in Rhode Island; where Oorliss, a Centennial Corn initaionei, was one of the electers chosen bf the people. declined the position of 'lector under the clause in the Rhode island statue, which says : '`lf any elect , Ors lhosen as aforesaid shalt after their said election, decline the said = office or - shall be prevented,etc., the other electors shall fill such 'vacancies." The .SUpreme Court of Rhode Island held that tliis statue did not authorize the other elect- Ots to till Corliss' place ; on the ground that 4 before any persorl cau decline under this section he must first be elected,. and no person can be elected who is ineligible, or, in 'other words, incapable of being elected.". And another sentence - puts this - ruling still more express terms:. "We ' think," say the Court, e."commit3sioner 01 . 7% the United States Centennial _Commiss ,, ion holds an office of trust under the United Stat and that he is therefore disqualified for the offi(,e of "elector."-- ' Tnst ruled COrliss out/ right there, and the only way way to get offer it in Rhode Island was to take advantage of another statue, which is not i on Pennsyliania's bookOillOwing the Legislature, in grand 0 54414,tee, to fill a vacancy occasioned by alaitire to elect the proper number of electors by reason of a tie vote or 'N;)ther w*," this word`'otherwise" being the operating word. Now, in Pennsylvania .the statue simply' provides : first, that elector:3 shall be appointed by the people, and then if any such elector die or fail to attend, the other electors shall fill. The point is then that Morrell was not "Bud?, an elector." The. We find also.that the charges for, county advertising are exorbitant for the times, and would suggest to our. Commissioners that they use, every means in thew power to reduce the same. And while we find the present board of Commissioners have made a large reduction in the salary of their clerk we would recommend a still further reduction if practicable. M. L.
