Millspaugh, City Treasurer Of Scran ' ton, informed his attorneys (Henry M. Hoyt and Henry W., Palmer, esqs., of Wilkesbarre,) ~that he, as City Treasurer, had returned to the State $5,000 less than the licenses paid into his offices aggregated. He also stated that .he had some time before been approached by John A. Waggoner a clerk in the Auditor! General's of when Hartranft was the inthimbent, who informed him bow he could enterinto a profit able speculation. Subsequently VfaggOner in troduced him to Marshall S. Smith , a clerk in the State Treasurer's Depariment, and arrange ments were ma4e to fix up the City Treasurer's return so that the State would be defrauded out, of $5,000, which was to be divided among these, three persons. Of this amount p,500 went to Millspaugh, while Smith and Waggoner receiv- ed the balance. The City Treasurer was ad vised to make public this transaction and re- fund the money he had illegally taken from the State, and on Thursday last a week, Mr. Pal per, one of his counsel, informed the Attorney . General of the fraud. On Tuesday of last week Messrs. Palmer,'Millspaugl; and Smith had an interview in Harrisburg, at which the matter was fully discussed. The City Treasur er agreed' to pay over to the State the money unlawfully in his hands and the treasury clerk also promised to transfer - to the State the other KM, the latter payment to be made the stme evening. He failed to meet Lis obligations, itd on Wednesday, Governor Hartranft made ihe inlotraation before the mayor of the fact!, and on Saturday last, Mirshall S. Smith was taken into custody while in the performance, ofqii duties as clerk and John Waggoner was a rested at his home.
