Court Proceeding.
Court convened on the 2nd iust,
and the first business before it was
the question of a free bridge across
the river at this place, on a motion to
have the report of the viewers for a
free bridge submitted to the grand
jury. Exceptions had been filed to
the report of the free bridge view
and were read in Court, and are as
follows :
1. The bridge which the viewers
were appointed to inspect was en
tirely destroyed by the flood of June
1st, 1889, so that when thev met on
July 22nd, 1889, there was no bridge
to view or appraise.
2. The viewrs have reported that
the payment of tolls ovar said bridge
ia burdensome, wheias in fact no
burthen was imposed on the travel
ing pubic, at the date of view, or any
time since.
3 The compensation awarded by
the viewers is so entirely inadequate
that the report should not be con
firmed. - Thf re is no authority vested in
! the public to take demanded bridges
j in tne way in wnicn me present pro-
' ceedings Lave been conducted.
seawgs nave oeen couauciea.
5. The law points out another and
j different proceeding, where a bridge
has been destroyed.
1 he consideration of the exceptions
were postponed, and the grand jury
was ordered to take testimony on the
free bridge question in open court.
X hirty some citizens tee tin ed on the
subject of free bridge. After thsjwit
n esses had all been heard tbe Brand
jury deliberated on the question and
returned a report 12 to 11 in favor
of the viewers' free bridge report.
whereupon the whole matter reverts
to the exceptions, which in all prob-
aouitv will tie argued before an Ar
gument Court to be held on the 17th
day of this month. If tbe Court
sustains the exceptions the free
bridge will be had. If the Court
sustains the action of the grand jnrv
then the matter will pass into the
jurisdiction of the Conntv Commis
sioners.
