That no inronvenietice may arie from the
changes in the constitution ot the Coui
luotiwesllh, and in order to carry the
asuie into complete operation, it is here
by dsclared that :
Sectiok 1. This constitution shall take
eflect on the first day of January, in the
year one thousand eight hundred aud seventy-tour,
for all purposes not otherwise
provided for therein.
Sec. -. Alt laws in force in this Common
wealth at the time of the adoption ol this

Sec. . At the general election in the
years one thousand eight hundred and seventy-four

a Lieutenant Governor shall be

constitution.
Sec. 7. The Secretary of Internal Afl iirs

Sec. 12. The registers' courts now" in ex.
istence shall be abolished on the first day
of January next succeeding the adoption of
this constitution.
Sec. 13. The General Assembly shall, at
the next session after the adoption of this
constitution, designate the several judicial
districts as required by this constitution.
The judges in commission when such de
signation shall be made shall continue du
ring their unexpired terms judges of the
new districts in which they resi le. But
when there shall be two judges residing in
the same district, the president judge shall
elect to ahich district he shall be assigned;
and the additional law judge ahall be as.
signed to the other district.
Stc. 11 . The General Assetnblv shall, at
the next succeeding session after each de
cennial ceuiHis, acd not ottener, desiguate
the several judicial districts as required by
this constitution.
Sec. 15. Judges learned in the law of any
court of record holding commissions in
force at the adoption of this constitution
shall hold their respective onW until the
expiration of the terms for which they
were commissioned, and nntil tneir succes
sors shall be duly qualified. The Governor
shall commission the president jud eof the
Court of First Criiuiual Jurisdiction for the
counties of Schaylkill, Lebanon aud Dau
phiu as a judge of the Court of Common
Pleas of Schuylkill county for the unexpi
red term of his office.
Skc. 10. Alter the expiration of the term
of any H-esideut judge of any Court of
Common Pleas in commission at the adop
tion ot this constitution, the judge of such
court learned in the law and oldest in com
mission shall be the president judge thereof",
and when two or more judges are elected at
the same time ia any judicial district, they
sba'd decide by lot which shall be president
judge ; but when the president iudge of a
court snail be re-elected he shall coutiuue
to be presideut iudge of that court. Asso
ciate judges, not learned in the law, elected
alter the adoption of this constitution, shall
be commissioned to hold their offices lor
the tciin of five years from the first day of
January next alter their election.
Sec. 17. The ticueral Assembly at the
first session after the adoptiou of this con
stitution shall fix aud determine the com
pansation ot tho judges of the Supreme
Court and OI the judges of the several ju
dicial districts of the Commonwealth, aud
thj provisions of the tifieeuth section ot
the article on Legislation, shall not be
deemed inconsistent herewith. Nothing
contaiued iu this constitution shall be hekl
to reduce the comiicusalioa now paid to any
law judge of this Cuuiuiouwcalih now iu
commission.
Skc. 18. The Conrts of Common Pleas
in the counties of Philadelphia and A!le-pht-n;
shall b; computed of the president
judges of the Itistri.-t Court and Court of
Common I'leas of said counties until their
offices shall severally end, aud of such oth
er judges as may from time to time be se
lected. For th? purpose of first organization in
Philadelphia ihe judges of he Court mini,
bir one shall be Judges Allison, Pierce aud
l'axson ; of the Court number two, Judges
Hare, Mitchell and one other judge to be
clet ted ; !" the Court uumlier three, Judges
Ludlow, Fiidetter and Lynd, and t the
Court number four, Judges Thayer, Brings
and oue other judge to be elected.
The judge first named shall be president

and seventv-five, and existing courts iu said
counties shxll continue with their present j
powers and jurisdiction uutii that date; but
no new suits shall be instituted iu the Courts i
of Nisi Prius alter the adoption of thiscou- j

Sec. IM. The causes and proceeding pen- ;
ding in the Court of Xisi Prius, Court of
Common Pleas and District Court iu Phiia- j
dclphia shall be tried aud disposed of in the
Court of Common Pleas. The record and

Stc. 21. The Prothonotary of the Court
of Common Pleas of Put ade'phia shall be
lirst appointed by the judges of said court
ou Ihe first Monday of December, ia the
year oue thousand eight huudred and sev-euty-five;
aud the present Prolhouotary of
Uie District Court iu said couuty shall be
the Prothonotary of the said Court of Com
mon Pleas uutil .aid dat.;, when his commis
sion shall expire, aud the present Clerk of
the Court of Uyer aud Terminer aud Quar
ter Sessious of the i'eacj iu Philadelphia
shall be the clerk of such court until the
expiration of his present commission on the
lirst Monday of December iu the J eoi oue

Sec. 2i. In Philadelphia magistrates in
lieu oi' aldermen, shsil be chosen as requir
ed in this constitution at the election iu said
city for city and ward ollicers in the year
one thousand eight huudred and seventy
five; their term of ollice shall commence
on the first Monday of Apf U succeeding
their election.
The terms of office of a!derhien in said
city, holding or entitled to commissions at
the time ol tue adution of th s coustttu- j
lion shall not be sllected thereby.
Sec 116. All persons iu ollice iu this Coin -inon
wealth at the time of Ihe adoption M
this constitution, aud at the first election
under it, shall hold their respective vliice
uutil the term for which they have been
elected or appointed shall expire, and until
their successors shall be duly qualified, un
less olher ise provided in this constitution.
Set. -7. The seventh article of this con
stitution, prescribirg an oath of ottice, shall

Sec. -S. Tho terms of office of county
commissioners ana couuty auditors chosen
prior to the year oue thousand eight hun
dred aud seventy -five, which sha 1 not bare

six, shall expire on that day.
Sec 2'J. All State, county, city, ward,
boiough and township thcets in olhce at
tliH lime of the adoption ol this constitu
tion, whose compensation is not provided
lor by salaries alone, shall continue to re
ceive the compensation allowed them by
law until the expiration of then respective
terms ot ottice.
Sec 30. All State and judicial officers
heretofore elected, sworn, siEruied, or in
ollice when this constitution shall take ef
fect, shall severally, within oue month after

Sec. 31. The General AsscuiWy, at its
nrst session, or as soon as u ly be at ter the
adoption of tbis constitution, shall pass
such laws as may be necessary to carrr the
same into full force and effect.
Sec. ii. Tho ordinance passed br this
convention, entitled "Ai ordinance tor
submitting the amended constitution of
Pinnaylrania to a rote of the electors
thereof," shall be held to be valid for all
the purposes thereof.
Sac. 3d. The words '"County Commis
sioners," wherever used in this constitu.

same, shall be held to include the Commis

1. Thit the amended Constitution pre
pared by this Convention, be submitted tu
the quolilicd electors of the Commonwealth
tor tneir adoption or rejection, at an elec
tion to be held ou the third Tuesday oi De
cetulier next ; except as hereinafter ordered
and directed, the said election shall be held
and conducted by llic regular election olli
cers in Ihe several electiou districts through
out the Commonwealth, under all the regu
lations aud provisions of existing laws re
lating to geueral elections; aud the slier ill's
of the several counties shall give at least
twenty d iys notice of said electiou by proc
lamation. 2. The Secretary of the Commonwealth
sh ill. at least tweuty days bet ore the said
electiou, f urnish to the commissioners of
each county, a sufficient nu nber of proper
ly prepared circulars of instructions. The
commissioners of the several counties shall
cause to be printed at least tu-ee times as
many ballots ol affirmative votes as there
are voters iu each couuty and the same
number of negative voles; ami the said
commissioners shall, at least five days be
fore said election, cause to be fairly distrib
uted to the several electiou districts in their
respective counties, the said ballots, tally
lists, returns, circulars of instructions, and
snch other books and papers as may be ne
cessary. The ballots shall be printed or
written iu the following form : Ou the out
side the words "New Const. H.tiou ;" in Ihe
inside lor all persons giving atliriuative
voles the words 'For the Sew Constitu
lion," and lor all persons giving negative
votes the words '-Against liio .New Consti
tution." 3 If it shall appear that a majority of
the votes polled are fur the new Constitu
tion, thcu it shall be the Constitution of the
Commonwealth of Peunsylvauia on aud af
ter the first day of January, iu the year of
our Lord oue thousaud eight hundred and
seventy lour ; but ii it stia.l appear that a
majority ot the votes polled were against
the new Cwustitulion, tueu it shall be re
jjeted aud be null and void.
4. Five Commissioners of Election, viz :
Edwin 11. Fitter, Edwaid Browning, John
P. Verree, Henry S. liugcrt, aud Johu O.L,
James, are hereby appointed by this Cou
veutiou, who shall have direction of the
election upon ttiis amended Constitution iu
the city ol Philadelphia. The said Coiu
iuiMioners shall b.r duly swon or affirmed
to jell or ui iheir duties with impartiality and
fidelity. They shall also uace power lo fill
vacancies iu their owu number, it shall he
the duty of said Commissioners, or a nil-

turns thereof. No person shall serve as an

election in the said city shall be opened,
computed and certified before tho said
Commissioners, and wuli their approval
which approval shall bJ endorsed upon the
return. They shall make report, directed
to the President of thia Convention, of
their official action under this ordinance and
concerning the conduct of ihe said eicCtiuu
within the said city.
The Judges and lns;iectnr8 aforesaid shall
conduct the election in ad respects con
formably to the general electiou laws of
this Commonwealth, aud with like powers
and duties to those of ordinary electiou
ollicers. Each lii-.pe.-tor shall spjioiut one
clerk to asMtt the Board in the perform
ance of its duties, and ail the election offi
cers shall be duly sworn or affirmed accord
n.g to law, and shall possess all the quali
fications required by law of e'ectiuu ollicers
iu this Commonwealth. At said election
any duly qualified elector who shall be un
registered, shall be permitted to vote upon
making proof ot his right to the electiou olli
cers, according to the general election laws
of this Couiuiouwealth. Return Inspectors
and their clerks and an hourly count of the
votes shall be dijeused with, but orurseers
of election may be selected lor any pre
cinct by said Election Commissioners, whose
duties and (towers shall be the same as those
of overseers of election in said city under
existing eleciou laws ar-jJicable thereto.
Returns of the election shall be made in
said city as in tin case of an electi-m lor
Uovernvr, but a triplicate general return for
said city sh ill be m id out and forwarded
to the President of this Convention at Har
risburg, as i bereiuoltcr provided incise of
countv returns.
5. Iu each of the countiss of the Com
monwealth, (except Phllalelphia,) the re-
turna ot the electi n shall be in He as iu
the cose of au election for Governor, but
ihe return judges iu each county shall make
out a triplicate countv n-tuni and transmit

directed to the President of this Conveu.
