stitution says " &oh ho o shall choose a
Speaker and other office ." This j is imams

by, thisattempt of: the Republieiu - ofßeers to
hold over. The Words "each house" are re
peated In the Constituticei several times, and
it
mesa emit branch ! of th Legislature. This
"house" is composed of oli;
and new members,
and it was not intended b the framers of the
Censtitution, nor 'claimed by any previous
Senate, that the ofliOsta should preside over a
new Senate and new members. The Consti
tution does not say that "each house" shall
choose its: speaker alimony, but that: is its
mianin i g and such has been the practice under

it for seventy odd . years.
To divest this einvel plia of "perpetual or
ganisation" of every pretense of right or
custom on the pare . of its authors, the Senate .
Journals have been carefully' eximined buy
to the year 1794, and the result of the exam
ination is stated briety al follows
. ,From 1794 to 1864 no fate speaker kat ever
atternpted to qualify 'new Senators, and no new
Speaker Ads administered an ost4 to Amy Senator
Slice until qualified as specular Afaudf. At every
annual meeting orthe Senate, all the °Moire

form by the new Speaker.
'From 1731 to 1851, the chair was always va

Journals show that the successful candidate
"took the chair," or was •conducted to it" by

From 1794 to 1801, all (he Senators voted for

designation, eicept in 1825, when Thomas
Burnside voted as "late Speaker ;" but h•was
not a candidate for re-election.
From 1794 to 1825, in the Journals made
uP during the annual organisations of the
Senate. he is designated as "late Speaker ;"

igested as "Speaker," until the motion to
proceed to elect a Speaker prevails, when he
is referred to as •-having oaealed the chair."
In several instances there were a number of
ballots for Speaker; some of which were a tie,

In 1842 there were thirty-five ballots for
