the ditching perfectly, but seems to forget
all about the bacon.
"You say your daddy did this ditchinp;
do you know what he got in pay for it?"
inquired Col. C. for defendant.
"He never got nothiu', as ever I heard
on, that's what he got' answered the wit
ness. "Didn't your daddy get corn and bacon
from defendant in pay for that ditching?"
"Never heard of his gettiu' no corn or
bacon."
"What did your daddy and his family
live on last summer ?'
"Vittles, mostly."
"What sort of victuals ?"
"Well, meat, and bread, and some whis
key." "Where did be get that meat and bread?"
"Well, fust from one and theu from the
other."
"Didn't he get some from defendant ?"
"He mought."
"I know he mought, but did he ? that's
the question."
"Well, he mought, and then agin you
know be mooghoTt."
(With considerable excitement, and in
tODcsof thunder,) "Answer the question,
sir, aud no nmre of this trifling with your
oath. Did your daildy, or did he not, get
corn and bacon from the defendant for
duelling?"
"Well, now, he mought ; it don't occur
adzactly, you know."
Here his Honor interferes, and a stern
judicial frown addresses the witneoi tUu-:
"Witness, you must answer the ques
tion, or tbe Court will be compelled to
deal with you. Can't you say yes or no?"
"I reckins."
"Well, then, answer, yes or no. Did or
did not your daddy get corn or bacon from
the defendant at the time referred to V
iuquired the Court.
(Now fully aroused and conscious of
his danger,) "Well, Judge, I can't adzact
ly remember, you know, sccin' as how it's
all dun, bin gone, aud eat up; but,"
(planting himself firmly as one determined
to out with it,) "to the best of my rekcr
lection, if my memory serves me right, he
mought, and then agin he mougbtu't."

A Precocious Youth. Some time
during the last year, a young sprig of the
law was admitted to the Suffolk bar. II .s
father gave bim a hundred dollars to pur
chase a library of books, and told him that
was all he could do for him at that time,
but, by industry, prudence, and immedi
ate enforcement of payment of all sums
that might be bis, he had do doubt but
that be would get along. A few days af
ter, the old man dropped into Johus of
fice and borrowed fifteen dollars of the
money he had given him, promising to
pay h by twelve o'clock the next day.
"All right, dad," said John, "give me
your memorandum."
The next day, at twelve, pa did not ap
pear, and John immediately served a writ
upon bim, and put a keeper in his house,
just as the old man was sitting down to
dinner. That is what wc call an instance
of "sharp practice."
Balloon Ascension by a Donkey.
Monsieur Godard went np from Philadel
phia, on Wednesday, with a jackass appen
ded to his baloon. On being lifted from the
ground by the balloon, the jackass tried
the old trick of planting his legs at an an
gle of about fifty degrees, with hoofs ahead
of bis body, in the orthodox style of re
bUtiug jackasses ; but that movement pro
vinyt lamentable failure, be drew up bis
leg-, as if to get them out of the way as
useless appendages. He then looked
pagcly around, firrt at tbe up turned faces
of the crowd, then at the house-tops, and
finally all things else melting from view,
be turned bis exclusive attention to tbe
inflated mass over his head. Jack was as
tonikbed, if ever a donkey waa in this
world.
Hon. Elisha Allen, formerly whig M.C.,
was appointed Chief Justice of the Su
preme Court of the Sandwich Islands, by
the King, succeeding Mr. Lee, lately de
ceased. Mr. Allen is a native of Massa
husett, tut has lived for some years in
the Saudwicb Islands, and held important
posts in its irnverninent, the last being
Minister of Finance.
