The Erie Railroad.
Pittsburg, Nov. 27. The question of
tbe railroads, through the town of Erie,
has been before the Supreme Court sitting
at this place. The Liatjry of the present
proceedings is as follows :
On the Cth of October tha Governor
signed the bill passed at the last session
of the Legislature, and on the 3d of Nov
ember he appointed Joseph Casey to take
possession f the Erio and North East
Railroad. Oa the 19th of November, the
Railroad Companies, (Erie and North East
aud Cleveland, I'ainesville and Ashtabula) j
appeared before Judge Woodward, at his
chambers iu Philadelphia, and made a mo
tion for an injunction to restrain the agent,
Casey, from taking posession. Judge
Woodward granted the injunction, with
an admonitory order commanding Mr.
Casey not to proceed until the hearing of
the rule.
Oa the 21th, the case was argued be
fore all the Judges of the Supreme Court,
in this city, on a motion of defendant,
Casey, to quash the admonitory order.
Ycsterdav the opiuion of the Court was
rrivt'D IlV Chief J Ustice Lewis. tO the fill- ,
lowinj; effect : Judge Woodwerd s juris.
Uiction was unanimously susuiiueu, uui.
r i- J i
the order was amended Dy substituting
the words "be cautioned'' for "be com
manded." The question will ha argued in Phila
delphia, iu January.
Strange Developeraent
A correspondent of tbe Cincinnati Ga
zette writes from Pittsburg tliat, when
the case of Passmore Williamson was ar
gued, last summer, at liedforJ, oa the mo
tion ta bring Williamson out on a writ of!
hal-a$ corpus, three of the Judges (Messrs.
Lowrie, WooJward and Knox) were in fa
vor of granting the writ, aud two (Messrs.
Ulaek and Lewi?) opposed to it. When
the Court re assembled iu Philadelphia,
Judge Kane aid his friends bad an inter
view with oar Judges, and communicated
to them the fact that the President had
ordered Ihe United States Marshal, in case
the Court should direct the writ to issue,
to remove Williamson from Mojarueiisiug
to the United States receiving ship, and
defend him there, with United States ma
rines and soldiers, against any force the
date mignt scna to take uitn. lue oues-
tion presented to our Judges was, whether
it was prudent to risk the threatened colli
sion ? I am sorry to say they thought it
was not. They Lad not the nerve to
Ftand up for State Rights. Judges Low-
rie aud Woodward changed their opinions, j
and the writ of AatVn corrtus was not is- :
sued. The threat for it was a threat
should have been an incentive to its issue,
instead of the pusillanimous course adop
ted ; for the question of State Rights has
g it to be settled, aud this was the oppor
tunity needed.
