    Impertent Law Decision.
Saintlhlits and Blockaded /loads.—
An assault and battery muse possessing
a novel and important feature, wee tried
atthe last term of the Quarter Sessions
in Chester county.—The history of the
ease is briefly this: Joseph P. Walton,
the prosecutor, residing at Cochranville,
ttarted from Lis resiaenee on the 30th
of January last, for the village of Oxford,
- sod finding the road impassible on ac
count of the heavy snow drifts, laid
down the fence of Mr. Jacob Fox, the
defendant, in order to pass through the
fields. To this the latter objected, and
becoming excited, struck at Walton
with a spade, but missing him, hit the
horse, causing him to back, breaking
the shafts and upsetting the sleigh—
throwing Mrs. Walton and child into
the snow. Out of this transaction the
present suit originated. We allude,
however, to the suit because it settles
as important principle in regard to the
right of persons - passing over private
ground, when the public) roads are ob
structed by snow or other obstacles.
The report in the Record says:
The testimony having closed, Messrs.
Monaghan and Hickman addrgssed the
jury for defendant; and Mr. Nutter in
behalf of the Commonwealth. Upon
the ono side the counsel argued that the
owner of the land had an absolute right
under all circumstances, to forbid an
other person entering upon it, and to
resist and repel the trespasser—even
when the roads are blockaded by snow,
and that Mr. Fox was justifiable in in
tlicting the blow upon the horse or the
person of Mr. Walton. Upon the part
of tha Common Wealth, it was argued
that•the road being in'an impassible or
unsafe, condition, the traveler had a
right to enter upon the premises of Mr.
Fox—from the necessity of the case;
but itthis was not so, an assault with a
dangerous weapon was not justifiable,
if he had illegally ent)red upon his
premises; whereas the evidence was, he
had 'not entered lion the property o
Mr. Fox.
Sedge Haines. chhrged the jury op the
law and the evidence yesterday morn
ing.—His honor declared emphatically
that where the roads aro impassible by
reason of snow or from other cause, the
traveler has, a right to enter upon ad
joining lands and pursue his journey;
that the Supervisors are required by law
toopen the roads in all cases, and that
for neglect of duty in the case, the Su
porvisors of Upper Oxford were liable
to indictment. These are points of
great_ interest to the public. The jury
acquitted Mr. Fox.
Destitution and Starvation in Northern
Michigan.—Drrnorr, May 15.—There
is great destittlktion existing in GaHot
county and other secluded localities in
the northern part of this State. Sever
al persons have already died from star
vation and wily cattle are also perish
ing for want of food.
At a meeting held last evening in the
city hall liere; to devise means for the
relief of - the destitute people, a citizen
of Galiot county was present, and stated
that his wife and three children had
diedla starvation. Ile gave a gltomy
account of their staering in that region,
and said people were dying for want of
the most common food. The meeting
decided to ,raise 85,000 in this city to
purchase
_provisions with—one thou
sand of which was subscribed in the
halL
IlifirA 'man, in mining for lead in 'Wis
consin, a few days ago, after going
through rock for seventy feet, opened
into a remarkable cave, filled with bo
dies df animals, different from any re
cognized by the naturalist of that vicin
ity.—Teeth were discovered two and a
half inches square.
/?On Monday, the 4th inst., the
Commissioners' election took place at
Wilmington, N. C., and resulted in fa
vor of the Democrats.

Washington, May 21.—1 t is estimated
that the troops now moving in the di
rection of Utah col:alai:e s bout 2000 men.
There are two vacant federal judp•liips
in the territory which are soon to be
filled, and probably another marshal
will be appointed as pre:iminary to en
forcing the civil process. In the event
of opposition on the part of the Mor
mons to this, the military will be em
ployed to enforce the laws and topro
teet citizens of the I;nit‘d States froth
Mormon oppression. It is supposed,
however, that no necessity for extreme
measure* will arise. • The governorship
is still unsettled, although several geu
tleman are solicitous of the position.
But the government is anxious to select
one who will combine personal bravery
with administrative talent and mines
tioned discretion. The program of op
erations for Utah will be consummated
with the least possible delay.
m.On the let of July next the sugar
duty falls from 30 to 24 per cent. ad
valorem—a reduction of one-sixth.
IF-Hawkins, to be hang in Estill
county, Ky., on the 2 . 9, th instant, for
the murder of two men, is only 21 years
old, and has married five wives.
10.. Thu bachelor who undertook to
mend his breeches with the "thread of
life," gave it up as a bad job and sent
them to a tailor.
