their family will not be released
to a Philadelphia television sta
tion, a judge decided.
Videotaped and audiotaped con
fessions of Bryan and David Free
man, 16 and 17, and an audiotaped
statement from their cousin, Nel
son Birdwell 111, 18, also will not
be handed over, Lehigh County
Judge Lawrence J. Brenner ruled
Wednesday.
The videotapes show the vic
tims' bodies in blood-spattered
rooms in their Lehigh County
home. The Freemans are charged
with killing their parents, Dennis
and Brenda Freeman, and their
brother Erik, 11. Birdwell also
was charged with homicide and
conspiracy.
Prosecutors said a knife, an alu
minum baseball bat, a pickax han
dle and a weight bar from an
exercise machine were used in
the stabbing of Brenda Freeman
and the beating of Dennis and
Erik Freeman, whose skulls were
crushed.
The Freemans, who rebelled
against their family's Jehovah's
Witness religion, had tattooed
"Berzerker" and "Sieg Heil" on
their foreheads.

tapes became public record when
they were shown and played dur
ing a preliminary hearing in
April.
Brenner wrote in a 31-page
opinion that any broadcast of the
tapes could jeopardize the broth
ers' right to a fair trial by "creat
ing a circus-like atmosphere,"
would invade the victims' rights
to privacy and would serve no
purpose except as "commercial
exploitation" because reporters
were able to describe them to the
public after the hearing.
"Clearly, the principles of com
mon decency and the dignity of
the unfortunate victims outweigh
the public right of further access
to this tape," the judge wrote.
Also, he wrote that broadcast
"might act as a catalyst and titil
late a sick and demented mind,
thereby triggering a copycat mur
der."
He wrote that the tapes differ
from evidence shown at a trial
because they are not part of an
official court record. They were
kept by the district attorney after
the hearing and never filed.
Birdwell fled to Michigan with
the Freemans and initially was
charged with hindering their
arrest.
