USG filing suit
against Datematch
company over fee

The Undergraduate Student Govern
ment is filing a suit against the company
that runs Datematch because of a con
tract dispute, USG's chairman of the
board of directors said.
Gordy Beittenmiller said Interperso
nal Research Inc. is being sued for
$673.90 because of a dispute about an
ambiguous fee schedule.
"It's been difficult to work with Inter
personal Research," he said. "You can
look at the fee schedule and read it his
way or read it our way."
Craig Millar, assistant vice president
for student affairs, said he thought USG
should press the suit.
"If it was in their financial means to do
it, then it was worth their while to do it,"
he said.
Randy Foker, a representative for
Interpersonal Research Inc., refused to
comment on the pending suit.
Beittenmiller said a fee schedule
shows the processing fees for different
quantities and types of computer date
forms.
The suit has been filed with District
Magistrate Clifford Yorks pending re
sponse by Foster. Foster has until April
24 to say whether he will defend the sujt
or not.
USG will win the case by default if
Foster chooses not to press the suit,
Beittenmiller said.
If the courts decide the contract fee
schedule is ambigious, the case will be
decided in favor of USG, Beittenmiller
said.
Even if USG wins the suit it might not
get the money because Interpersonal
Research could appeal to a higher court
or not voluntarily pay USG, he said.
If Interpersonal Research does not
voluntarily pay USG, a "lengthy collec
tion process would have, to be carried
out," Beittenmiller said.
Beitenmiller said he "had no idea"
when the case would go to court but he
expected al hearing date to be set before
the end of the term.
Beittenmiller said when USG paid In
terpersonal Research it felt the contract
was incorrect.

However, USG agreed to pay Interper
sonal Research anyway because it
wanted students to get their computer
date forms on time and avoid bad publici
ty for USG, he said.
"We decided to pay the full amount
because we didn't think USG needed the
badpublicity of what would appear to be
mismanagement," Beittenmiller said.
"People were waiting for the service and
depending on it."
Datematch did not show a profit this
year; in fact, it was $19.91 in the red,
Beitmiller said.
"It (the suit) makes a big difference in
the profit of the project," he said.
"Ne spent money based on costs that
we thought were going to be less you
can see how a mistake would hurt us."
Attorney fees and court costs for USG
will be $lB5, which would leave. a $952.92
profit margin for USG if it won the case,
he said.
"If we win, the defendent pays all costs
except for the the attorney's fee," Beit
tenmiller said.
USG's suit represents a deviation from
that organization's past policies, he said.
For the past two years, USG has
agreed with Interpersonal Research's
interpretation of the fee schedule; how
ever, this year Beittenmiller said he
realized USG was being ripped off and
decided to do something about it.
"Student organizations traditionally,
and USG specifically, have too often not
stood up when they've thought they'd
been wrong," he said.
"We feel we been wronged and we'll
work to try and right it," he said.
"People were waiting for the service
and depending on it."
Datematch is a money-making project
for USG where students fill out computer
forms and are matched with a computer
date.
This year's Datematch had 1,827 stu
dent participants. In past years; between
3,000 and 4,000 students participated.
In a recent article in The Daily Colle
gian, Beittenmiller said the decline was
because Datematch was held Winter
Term instead of Fall Term as in previous
years.

wind, which can burn the grass.'
