State mental patients to get hearings
HARRISBURG( AP) —Roughly 6,000 persons committed
involuntarily to mental hospitals must have hearings over the
next six months to determine if they were hospitalized fairly,
a state official said yesterday.
Robert Haigh, deputy commissioner for mental health, said
the hearings are required under the new Mental Commitmant
Procedures Act, which took effect yesterday.
Attorneys representing both patients and the state will
argue whether each patient meets the new standard for in
voluntary commitments.

a clear danger to himself or others.
The old standard; repeatedly struck down by the courts,
permitted a person "who appears to be mentally disabled and
in need of care" to be committed.
"Impermissibly vague," declared the U.S. District Court in
Scranton in July.
The new provision presents more logistical than functional
problems, High said. The six-month deadline for completing
the hearings is reasonable and can be met, he said.

Other changes under the new law
Officials must reach a decision on commitment within 72
hours after a person is brought in for treatment. The old
standard was 10 days.
Common Pleas judges can appoint mental health review
officers to decide involuntary commitment cases. The officer,
an attorney, could devote more time to the cases than the
judge. •
