Interesting Railroad Gale.
A case which excited some

the District Court, on Monday _and Tuesd in

which the Pittsburgh and Connellsvile Railroad
Company brought suit against Gen. WM. Robinion
for the recovery of a subscription of one hundred
shares o f t h e ca pital stuck of that road, amounting
with interest to $6,000. The Company claimed that
the subscription was made in good faith, and that it
was valid and binding. On the other hand, Gen.
Robinson asserted that the subscription was made at
the request of Oen. Wm. Lirimer, then President of
the Board of Directors, with an understanding that
he would not Us e.e l .l upon to pay it. He also
claimed that he transferred the stock to Gan.
nior, who transferred it l.cer to the Company.
The tarn was conducted by Messrs. George P.
Hamilton and J. H. Sewell on the part of the Com•
pany, and Thomas Williams and A. W.Miller,'Esqs.,
for defendant.
The following affilivit was offered in evidence by
Mr. Williams:

understanding that he was nut to either pay for It or bold

Court met at nine o'clock this morning, and pro
ceeded to the consideration of a number of surety of
the peace eases.
Several of the prosecutors and defendant: were
o e.t, and for their neglect were ordered to pay the
costs.
P. Stephens vs. Malcolm Husking ; surety of the
peace. Mr. Stephens, constable of Chartiers town
ship, swore that after Husking had given bail and
been released on a charge of burglary, upon which
he had arrested him, he had made threats of taking
Stephens' life. A colored man, Levi Brannon, who
has also a charge of surety of the poaee against Hus
king, testified that on the evening of Huskies' release
from jail, while at his house, he made terrible throats
against the constable, avowing that " he weuld have
blood before he slept." Haskins was ordered by the
Court to pay the costs, and also held him to bail in
the sum of one hundred dollars to keep the peace.
It will be remembered that this Huskies is the man
who, when arrested on this charge of burglary, made
his eeeape from the terry boat while being brought
over to prison, by jumping into the water and swim.

The grand jury came in and returned a number of
true bilk. en several of which processes were issued.
Michael Malone, an old man, accused of an inde
cent iitzeoll upon e little child, several urmths since,
who was admitted to bail at the last term of Court,
was surrendered by his agretv, and committed to
jail to await his trial.
The Court ordered Francis l'pperman to pay the
costs on txo chirgas of assault and battery, in which
he was the complaitiant, the grand jury having ig
nored the bills.
The first jury cake was taken up this afternoon.
It minaisted of tee cross suits for etesaUlt and battery,
ono the Commonwealth vs. Thomas Smith, the other
Commonwealth vs.. William Lea, Samuel Lea, Alex
ander M'Mnrray, James Robinson, Isaac Reed and
Nathaniel !Javelin.
The suits originated in a difficulty which occurred
at this end of the St. Clair street bridge, on the 19th
of August, about 12 o'clock at night, after the eels•
bra:ion in humor of the laying of the Atlantic Tele•
graph Ca r ,'le.
Mr. Smith, and :me or two other witnesses, testi
fied to a difficulty about Z'Je toll for a party crossing
with Mr. Lea, consisting of ten t , r twelve persona,
who attempted to cross without paying 01. Sever
al of the party struok and abused him. Ha took a
mace and went to the door to raise the alarm, when
he received a severe blow, which felled him to the
earth. For s time ho was insensible, when he recov
ered, the party again attacked him. He could not
say who struck him, but the party above mimed
were present.
The evidence on the other side was very different,
and went to prove very conclusively that Mr. Lea
and his party were cro,:eing peaceably - , that he offer
ed twenty cents for toll, when Smith alleged with an
oath that Loa had run forty over the bridge, and ho
wanted him to pay for them ; that Smith reached
through the window and struck Mr. Lea in the lore.
The crowd fell on Mr. Smith, lied Mr. Lea pulled
them off, saying this violence would not do. Ir also
appeared that smith provoked this attack by striking
one of the party with bis mace at the door. After
the affray, Smith came out, seized Mr. Lea by the
oullar and demanded his name, which Mr. Lea would
not give, having done nothing wrong. ' r ibose facts
wore shown by several witnesses. When all the evi
derma had been heard, the eases wore submitted to
' the jury without argument, after the charge of Judge
M'Clure, which was very brie:: at the hour of ad
jeurntnent no verdict had been rendered, and the
cry was instructed to bring in a sealed verdict.

thirty j. Ilars in money. Ile made off rat; len
Smithfield street, but was pursued and captured by
Mr. James Mont , ,uth. lie went into the store, in
company with another person, and asked for butter ;
while the boy attending was in the cellar, they took
the drawer and disappeared, uaoh taking a different
direction. When the boy found he was pursued he
threw the money away from him near the corner of
Strawberry alley. This is not his first offense, as he
was arrested a few days ainee fur picking pockets,
with others, but aP the person from whom the money
was taken was a stranger and could not remain to
prosecute, they were discharged.
Exciting Scene in a Church.—Sanday evening,
during divine service in St. Paul's Cathedral, ono of
the candles used in the ceremony fell on the altar,
and, communicating with some inflammable sub
stance, it was soon in a sheet of flame. The church
was crowded, and for a moment this most painful ex
citement prevailed. At length, hawever, one of the
clergymen otli iating Rev. Mr. Keirdey, at groat
personal risk, extingui•died the tire b-itoro much
damage was dune, and to the Infinite relief of the
vast oongregation in attendance. Mr. K. had his
hands badly burned, Lint nothing serious happened
from the untoward accident.—Chronicle.
Chai/eoyes.—The Pittsburgh Boat Club has chal4
lengod the Allegheny Boat Club for a race between
their eight oared boats, the " T. A. Scott " Lnd "
Win. Robinson ; " the challenge to remain open three
days from ye terday.
' The National Boat Club also propose to run their
lour oared boat, the "M. F. Cassidy," against the
" Isaac Gullett "or " Reindeer." Should the °hal..
longs not be accepted by either of these boats, it is
open to any four oared boat in Pittsburgh for any
amount from one to five hundred dollars a side.
Mr. Roberts.—This popular actor appeared as
Richelieu last night to a good audience at Porter's
Pittsburgh Theatre. He has, we think, improved
by his European tour, and personated the character
of Richelieu well. He is announced this evening
fur lago, a character in which he is said to excel.
Mr. M'Farland is cast for the Moor, and will doubt
less support Mr. Roberts well
ii'isas,/.—The three men arrested on suspicion of
having robbed Bryan's store, on the Middletown
read, some weeks since, have been discharged, no
evidence being adduced to wArrant Mayor Stuokrath
in holding them. _ _
Fur Damages.-112 the Distriot Court, yz.sterday,
the case of Joseph B. M'Langhlin vs. Robert Camp
bell, for damages for seduction of plaintiff's wife, was
on trial. The public are familiar with the case, and
we will not repeat the details. It will be concluded
to-day.

SiThis great American artiste will commence an en
gagement, this evening, at the now National Theatre.
She will appear as "Julia" in the Hunchback. We
believe this is her first star engagement here, and we
regret to say it will be her last, as 6he shortly pro
ceeds to Europe to fulfil au engagement there. No
artist has done more to ennoble the profession by her
talent and admirable private character, than Julia
Dean Bayne. Nor has any actress attracted larger
or more intelligent audiences. Beautiful in person,
she combines with it high intelleetual attainments,
and a perfect knowledge of the stage. Oar citizens
will not have another opportunity of witnessing her
admirable impersonations, as after visiting Europa
rhe retires from the profession which she has so ad-
mirably adorned.
During Mrs. Hayno's engagement, the now plays of
" Greselde," " The Duke's Wager " and " King
Phillip of France" will be produced under her elle
direction. We are happy to state that Mr. Brongh,
so well known to our citizens, is her business agent.
Carriages and Buggies.—As will be seen by the ad
vertisement of Joseph White, in another column, ho
has jest received a new and complete supply of car •
riages, buggies, sulkies, barouches and other articles
in his lino of business. He has had a long experi
ence in the business, and from his thorough knowl
edge of its details, cannot fail to give general satis
faction. He also manufactures first class work to
order. His establishment is near Lawrenceville, lo
cated in the route of the Excelsior Omnibus Line,
making it easy of access.

Prupo4ed Benefit.—We learn that the members of
the Pittsburgh Gymnastic Association intend giving
a complimentary benefit to the Hutchinson Brothers,
who have performed here during the past two weeks.
It is probable that one of the Theatres will be leased
for the occasion. The time has not yet been fixed.

A New Counterfeit five dollar note on the Burling
on Bank, New Jersey, has made its appearance.
A Juet Award.—The Climax Grain Fan, to which
we have made frequent allusion in our columns, was
awarded the highest premium at the late State Fair.
It also took the sweepstakes premium—and we think
that it richly deserves the credit received. In this
Fan the farmer will find the great desideratum long
sought for, and as its name indicates, it is the climax
of Fanning Mills. We trust the inducements hold
out by the agent to the mechanics of Pittsburgh will
bo accepted, as the manufacture of this invaluable
machine in our city would greatly reduee the price,
and place them at the immediate cotnmand-sof the
