R Biddle Roberts, Esq., stated that Samuelßecher, an 1m•
portent wi! nese in the case of the United States against R. V.
C. opus of Washington county, charged with counterfeiting,
was sick and unable to attend this court. tie therefore
more .l that the case be postponed until the next sessien of
this court, in September. Under these circumstances the
tim.licar lan was granted.
The case of the United States vs. Bailey and Perrine was
resnmed.

ing and exchange business; the style of the firm for the
tart three years has boon Clark Metcalf; saw the alleged
stolen draft in the tatty pat t of Fe' ruary, is the pus
',llion of Mr. Gilmore, who wished to have it cashoi; Uil
more Was a stranger to us, and was introduced by a man
seirned blichentaub; my partner told Gilmore wo would re
ceive it Lir collection, and if paid, uccAint for it; the draft
wail passed to the credit of Eichenlaub, who was to pay
Gillmore the amount upon advices being received from New
York; nu one was with Gillmore but Eichenlautg sometime

Yolk house; the words "Pay to order of Clark S Metcalf,'
on the draft, are in the hand-writing of my partner, Mr.
Metcalf; one of the endorsements is in my own writing.
Enoch Terrine, sworn—l live in Mercer county, ten miles
east of Mercer, at Terrine Port Office; I was post master
there in February, 1857; my eon, William V. Per rine, as
sisted me in making my returns; he was a sworn assistant;
about that time a letter came to nay since, in January,lBs7,
directed to Louis l'eter Nicholas; it was open at one end
and part of one side, and had a large Beal on, which was
not broken; there were three pieces of paper iu the envel
ope, which I took out, pat into a new envelope, and sent
the owner, with my way bill, at Cairo Post Office, Virgiu:a,
by direction of Fleming :with; the hitter was sent by mad
to Mercer it was forwarded about the 12th of March; the
letter was in the Slime condition all the time it remained In
my Mike; did not know Nicholas at all; no one called lPr
the letter till Nicholas sent for it; it came ou Saturday eve
ning-. the same directions were put on the new envelope an
had been on the old one.

the letter, one the sine of a half sheet of letter paper, and

writing was in German or in French, and I conal not read
it; I receiv.ed the mail containing the letter myself, and
opera it; I put it in a desk; two days aftorwards I took it
out of the desk and put it inn private drawer; I did not at
that time know Andrew Daily; it is nine miles from Pine
Grove to Perrier; have no recollection of eve r havirg scan

Am attachment was granted for Francis Eichenlaub, who
did not answer his name when called nen witness.
Mr. Roberts proposed to offer the draft in evidence, to
which Mr. It. Flenniken, one of the counsel fur the defence,
ot jectod, on the ground that th - re was a variance between
a name on the draft and a name in the indictment. In the
draft it is "Geo Milner," in the indictment "G. W. Milner." 1 1
(The Court admitted the draft for the present, but reserved
a decision on the point
