He concluded the charier, by replying to the plea for mercy in favor of Smith, reflected upon the enormity of the crime, nod of the dreadful cunsequenceii which might have ensued had it not been for the intorven , tion of Providence. Durieg the long time the tor pedo remained in the shop before it exploded, he was not touched with remorse, and it would be only au abuse of the power of the Court to extend any mercy to such a man. Therefore the Court would nut do it ; indeed such a request should not have been made, The motion was overruled, and the prisoner setiMuced to the Penitentiary for three years, the full extent of the law. Smith looked very feeble from ildhealth since his coutinoment in jail, and it is scarcely prob able that he will survive a term of three years' soli tary confinement in the Penitentiary. The crime might have been a terrible one, and the punishment is not any too severe. The First. Ward School Case We have before referred to the petition which was recently presented to the Court of Common Fle.s by Mr. Collins, asking for an order to be installed as School Director in the Fir,t Ward, an office to which he was elected last tall. It appears that Mr. Mu, phy, a member of the Board of Directors, wished to have his house repaired, and moved away temporarily, giving notice of the facts. During his absence, Mr. Collins (though whether he was aware of the circuit'. stcnees or not we are unable to say) presumed there was a vacancy in the Board, and, ambitious of the honor, had tickets printed, ran for the office, and was elected. Mr. Murphy soon after-the election return ed, and the remainder of the Board would not recog nize Mr. Collins as a member—alleging that Murphy was still entitled to his seat. Mr. Collins concluded to test the matter, and presented the petition as above stated. The matter was before the Court yesterday, the action of the Board of Direotors was sustained, and the petition dismissed at the cost of the prose cuter. As the office is one purely of honor, no sal ary being attached to it, the payment of these u,sts will be rather disagreeable to Mr. Collins. !'suet.—We learn that, ns a general thing in this locality, the fruit is but little affected by the cold weather we experienced last February.
