In Select Council, Mr. M'Auley in the Choir A communication was read from the City Solicitor endorsing a communication from Messrs. Robb .3k, M'Connoll, asking for the payment of interest on Railroad bonds. The communication was referred to the Finance Committee, with instructions to ren quest the City Solicitor to inform the applicants that the appropriations being already made, the demand cannot bo considered during the present year. C. C. concurred. The City Solicitor sent in a communication, with a resolution instructing our representatives in the Legislature to vote against an net authorizing suits to be brought against the city of Pittsburgh in rail road bonds in the city of Philadelphia. On motion, the resolution was ads Fed. C. C.. concurred. The City Regela or n•ported that he had examined tie stone arch over the road way at the northern end of the aqueduct, and that it was insecure. A reso. lutrun was in consequence adapted requiring a briek arch to be immediately built under toe stone one, at a cost not exceeding Di;:ht hundred dollars. In C. C. laid over on second reading. The committee reported several resolu tions. One of these authorized the Finance Com mittee to exchange the bonds of the Ohio and Penn. Sylvania Railroad Company belonging to the city for bonds of the Pittsburgh, Fort Wayne and Chicago It. ilroad Company, previous to the 15th inst. A second resolution instructed the Committee on Rail road Stock, to be composed of two members from Setcct and thr.a3 from Common Council, to vote against any man for Director of said road who is an timer or Director of any other road terminating in this city. The report also embraced an ordinance relative to city bonds issued under an ordinance pa.-sed February sth, which provides for drawing the bonds for from ten to thirty years. Also, an act of A:semlity providing for additional taxation for city ou:p .ses. The report of the committee was accepted, :he resolutions read three times and passed, ns was also the ordinance, and the act of Assembly was or dered to be printed for th 6 use of members. A cdwuaunication was read from the Mayor, trans mitting the • ollowing correspondence between him self and Mr. Cass. It. H. Co. —I herewith enclose a copy of an ordinance ordained and enacted into a law by the Councils of this city on the 2d ult. I am now ready at any moment to enter into con trat.t with said company as contemplated by this or dinance. Yours respectfully, 11. A. WEAVER, Mayor. HON. H. A..WEAVER, Mayor: Dear Sir:—l have received your favor of 26th ult., enclosing a printed copy of an ordinance, or dained and enacted into a lew by the Councils of Pittsburgh on the 22d ult., and entitled "An Or• dinanco relating to the Pittsburgh, Fort Wayne and Chicago Railroad Company." In your note, you notify me that you are ready at any moment to enter into a contract, under this ordinance, with the corn pany represented by me. . . . WM. SIcCULLOUOH It would bo a matter of infinite satisfaction to me if I could feel myself at liberty to at once accept the ordinance, enter into the proposed contract, lay down the rails across Penn to Liberty street, and thus ena ble the Company to enjoy the full use of its line to its legitimate terminus without further hindrance or delay. The undersigned first appeared before the Coun cils of this city, by memorial, on the 25th of Febru ary of last year, asking an extension of time of the ordinance of the 9th of January, 1854, granting the right of way to the Ohio and Pennsylvania Railroad Company. From that day forward—for near twelve months—have I been diligent, in season and perhaps uut of season, in urging action on the part of Coun cils, without any definite result. -43 last, at their session on The 12th of February, the action seemed to be conclusive against the Company, and I accord ingly directed the Solicitor to resort to the legal remedies left to the Company, which be did on the 16th of the same month, by filing a bill in equity praying for a preliminary injunction to restrain the Mayor and other officers of the city from interfering with the sgents of this Company in the work of coin pleting the road to the legal terminus in the depot of the Pennsylvania Railroad. By an agreement with the City Solicitor, the motion was sot for argument before the District Court on the 20th alt., but owing to the illness of His Honor Judge Williams, the hear ing was postponed until the 27th ult. In the mean. time (224 ult.) the City Councils enacted the ordi nance now before me. If this ordinance had Leen free from objections, or if the objectionable feature had not been of sc, grave a character, I would have ordered the proteedings in the case dismissed ; and entered into• a contract on your invitation, believing that such a course would have re ceivod the sanction of the Board of Directors of this Company. But the ordinance contains pro visions which I have stated, in written commu nication to Councils—at conference with com mittees of Councils—and in conversation with indi vidual members—that I could not agree to; and to which I have assured members of the Board of Di rectors I would not accede. No other alternative is left to me but to submit the ordinance to the Board of Directors for acceptance, rejection, or to propose some modifications. This I propose to do at their session to be held on the 16th inst. That no other than a necessary delay might be ex poriencod, and to the end that the legal rights and duties of the parties might be made known, I deemed it my duty to have pressed to a decision the motion before the Court fur a preliminary injunction ' not, withstanding the ordinance of 22d ult. When or how the Court may necide upon tile motion, I of co se do not know; but I cannot believe it will long del y decision upon so important a case, and es pe ; - y where the delay occasions a large daily loss; nor with the facts and authorities so fully and con vincingly presented by the counsel of the Company to the Court, and so feebly met (and no one could have made more out of so weak a case) by the learned counsel of the city, can I doubt that the Court will hesitate in granting the injunction prayed for. If my expectations are met in this last particular, the Company will be none the less ready to enter into such contract with the city as may be necessary to protect the lives of the citizens, and guard the busi ness of the community from all unnecessary annoy ance. The City Solicitor, in his argument before the Court, went out of his way, it seems to me, to make a threat that unless the Company forthwith accepted the provisions of the ordinance passed on the 22d ult., the Councils would at their very next meeting repeal the same. For the credit of the city and the good name of the Councils, I trust the City Solicitor was impelled t.) make such a threat for the lack of VA reasons for his cause, rather than by any authoritative giving out as to what would be the course of Councils. I have submitted to Councils on several occasions, through different channels, within the past twelve months, the views and wishes of the Company, and now for the first time have Councils indicated upon what basis it is willing to enter into a compact with the Company ; and with their terms, so long delayed, (if the City Solicitor speaks by authority,) comes a violent intimation that unless the Company at once accept the terms, they will instantly be withdrawn. But I prefer to take rho assurance which has come to me through a dif ferent quarter, that the City Councils are now really desirous of enacting such an ordinance as will not embarrass the Company, and, at the same time, protect the interests of the ci•y and its citi zens, and, therefore, renew the suggestion I made you on a former occasion—that a special corn inittee be appointed with full power to make a contract upon such terms as in their judgment may be proper. The objectionable features, to me, of the ord Lance of 22d ult., are contained in the sth, Bth, Ilse, 12th, 13th and 15th sections, and I presume the Faille will bo more or less obnoxious to the mem bers of the Board of Directors of this Company. With a committee of Councils at all disposed to com promise differences, and the decision of the District Court before us, I have faith to believe that there is good sense enough with all the parties, to do what ought, in equity and good conscience, to be done. Benefit of Mr. Hanley.—Our new leading gentle man, Mr. Hanley, takes a benefit at the Theatre this evening, when an excellent bill is presented. " The Stranger,"._ with Hanley as the Stranger and Miss Kimberly as Mrs. Haller, is offered; also Balwer's beau Ifni play of the "Lady of Lyons," Claude Mel notte, Mr. Hanley; Pauline, Miss Kimberly. We hope to see this gentleman favored with a good house, as his talents deserve ft. Miss Turnbull was greeted by egood audience last evening, and played, sang and danced in her usual style. We understand she intends leaving as, but we hope the management may succeed in prevailing upon her to " wait a little longer." Singular Death.—On last Tuesday morning, Mr. Cornelius M'Collister, a citizen of Muon township, started home in a carriage. When some fifteen milts from the city, the horses walked over an embank ment, breaking off the tongue of the carriage. It is supposed Mr. M'Collister was seized with a paralytic numbness to which ho was subject, and holding on to the linos was dragged out of the carriage, striking his head on the ground. Ire was found near the car riage, quite dead, with only a slight mark on his forehead. A Coroner's jury was summoned, who, after reviewing the circumstances, rendered a verdict of death from the visitation of God. Attempted Rope.—A German woman, about thirty }cars of age, named Ro-a Speeler, who practices midwifery and resides on Pennsylvania avenue, pre ferred an information before Alderman Lewis yester day morning, charging Francis Fredericka with at tempting to commit a rape upon her sometime lust month. Both of the parties are married. Freder icks has been annoying Mrs. Speckr fur some time, and she considers this the easiest way of getting rid of him. •He was arrested and gave bail in six hun dred dollars to answer the charge. Small Pox in Jail.—Munroe Stewart was removed to Passavant's Hospital on Wednesday, by order of Sheriff Patterson. He is quite ill, and his recover; is extremely doubtful. A second case broke out in jail yesterday morning—a young girl, a v grant, named Caroline Foreman, being the person attacked. Most of the prisoners have been vaccinated, yet we are tearful the disease will spread in the prison." As soon as the Commissioners were informed of this case, they ordered her to be released and sent to the Hospital, which was done immediately. Carrying Coneealed Weayons.—By our advices from Harrisburg we notice that a bill has been offered in the Leiglature making the carrying of concealed weapons punishable by imprisonment in the penitentiary. We hope the bill may become a law; our streets are infosted with lawless rowdies, who go around wilh bowie knives, revolvers and knucklers, who should be punithed whenever these instruments are found in their possession. George Raglan, the master of Farris, the slave ab ducted by Shaw, is in town. His business here is said to be to assist in effecting tho release of George Shaw on a habeas corpus, for which applica tion will be made on Saturday next. Mayor'e Office.—Eleven cases were Wore the Mayor yesterday morning. One was discharged, three were committed, and seven paid their fines. Larceny.—Alderman Donaldson yesterday com mitted Thomas M'Cullough to jail, charged with stealing some articles of trifling value from Margaret Lane.
