IMPORTANT RULING OF THE BOARD-00LO WATER
THROWN ON THE MOVEMENTS OF THE TEMPE
RANCE MEN-...-OBJECTIONS TO SEELY, SCLINECK,
AND RBA-GENERAL FIZZLE OF THE TEETOTAL,
ERS' EVIDENCE.
At an early hour, yesterday, a large crowd of anx
ious looking liquor sellers filled the room where the
sittings of the Board of Licensers are held, as it
was announced that in the morning the Temperance
League would substantiate their charges made on
Tuesday, against a number of those persons who
bare applied fur licea.se to sell liquor.
Col. Hawkins, Chairman of the Board, addressing
7. Heron Foster, Secretary of the Temperance League,
remarked that it would be well to state that the
Board of Licensers were of unanimous opinion that
the fact of applicants having infracted the farmer
law would not be taken as evidence against appli
cants under the present law. Col. 11. further re
marked that as this law was railer an experiment,
the Board had /tatted out more stringently than in
any other part of the State. If evidence can be pro.
duped against the moral character of any applicaut;
if it can be 'Mown that he is of intemperate habits,
has sold liquor to minors, or on the Sabbath day, It
would be considered a good and sufficient reason for
refusing him license.
J. Heron Foster—This will rather alter our pro
gramme. I don't know whether we ran offer anything
material against applicants under the ruling of the
Board. (It was the intention of the League to offer
the Quarter Sessions' docket, to show that nearly fifty
of the applicants under the now law were indicted
for an infraction of the law of known as the
Jug Law.) This decision, therefore, rather threw
cold touter on the toothtalers, oho strangely enough
did not appear to relish it.
When the name of C. C. Seely was called. Mr.
Olaurpton rose and remarked that if any were here to
make e)hjectioni, they should do so now.
Boron Foster said he would offer Mr. Daniel
O'Neill as evidence against that applicant.

On being cross-examined, Mr. Foster stated that
be did not know the names of any persons whom he
thought were id!e and dissolute, who went into Seely's

tossing up of a penny, or something of the kind,

some years since, had been there, on which occasion

horses, which balked while the wagon was on the
middle of the track. The driver, instead of trying

turned, Mr. Stuart resigned the post of President pro

discharge of their official duty near Hickory Grove,
on the i.td. were killed. The Marshal was in the act
of arresting some men who attacked the party under
Capt. Pate. The Free State soldiers had considera
bly increased in numbers, and yesterday were de
stroying houses, and driving men, women' and
children from their habitation near Bull Creek. A
company of ono Imadred and forty mem, under Capt.
Reed, hat left Now Santa Fe in pursuit of the mur
derers.
A man Just arrived from Kalllll9 City, reports that
a general rendezvous of the pro•slavery men is called
at Dull Creek, under the command of Whilfiehi. A
new attack upon Lawrence is contemplated. They
aspect to concentrate 600 men, generally armed with
T. S. muskets. The Free State riser, are determined
to settle the matter with the bayonet. They are de
ficient in arms and provisions. At the latest ac
counts they had formed a plan fur a night attack
upon the invaders.
ft is rumored that both Donaldson and James were
killed in a fight at Franklin, where a collision oc
curred over a quantity of goods stolen from Law
rence.

The houses were destroyed at Lawrence, as was
reported.
Report says that Franklin was not taken, though
attacked by a large party of Free State soldiers.
Captain Pate and companions had been liberated by
Cul. Sumner, who arrived at Black Jack Point just
in time to prevent a conflict between those holding
Pate and a party under Reed.
Uov. Shannowhas issued a proclamation hearing
date the 4th, which commands all persona belonging '
to the military organizations within the Territory,
not authorized by law, to disperse; that •auch orga
!illations are illegal, and should they re-assemble
will be dispersed by United States troops; all civil
officers of the government are required to be vigilant
in enforcing the law against offenders, and protecting
citizens against all violence and wrong.
The proclamation further declares that all law
abiding citizens of the Territory, without regard to
party measures and designations, must be protected
in their personal property, and all military organiza
tions either for the execution of the laws of the ter
ritory, or to disturb the peace thereof, must be dis
persed, and old aggressive parties from without the
Territory must be repelled; that the military force
placed under the control of the executive of this Ter
ritury is amply sufficient to enforce its laws and pre.
tart its citizens' rights ; and in carrying out this pro
eltimution. no dietinction is to le made as to party,
but that all parties are to lie served alike, under like
circumstances, and that obedience ti the laws and
the iiotlSeqUellt security of the persons in Kansas,
are its primary objects, and that all lawless violence
within the Territory, in whatever form testae-dad,
wont be suppressed. The inetructions of the Pre,.
dent of the (*Jilted Stites of the 11 th of February will
lie strictly enforced, and n requisition has teen made
rid. Sumner for a military force sufficient to insure
obedience to the proclamation.
