the American masses waving as it were like a
spirit upon the waters. The latter can feel it in
the atmosphere ; they can read it in the signs of
the times; they know its approach as well as the
mariner does the approaching storm,—by the
single speck that appears in the otherwise cloud
less sky. Never has a public man ventured to
set himself up against a just public opinion that:
he has not been crushed. Never has an infatu- •
ated intellect dared to aspire against the honest',
declaration of the masses in favor of a good
principle or a good man, that he has not fallen
like Lucifer, to rise no more. Along the path-,'
way of political history, we find the memories
and the wrecks of such men strown like admoni
tions to the present political era. It has been to'
the Democratic party, this obedience to the Dem
ocratic will, the soul of its exstence, the pillar
of its power, the watchword under which it has
triumphed, and which has enabled it, even when
falling before a deluded popular demonstration,
to retain that inextinguishable vitality which
soon restores it to confidence and to power. Up
on this rock we take our stand ; here we plant
our banter, and Calmly await the issue of the
Democratic National Convention.

In yesterday's telegraph columns the account
of an attack on a United States Senator was
read. According to that account the assailant
spoke to him before he 'truck him, and then on
striking him the first blow Mr. Sumner called for
help. He appears to have made no resistance
whatever.
Now, Sir. Charles Sumner is, we should judge,
five feet ten inches io height, and will weigh
about one hundred and sixty pounds. Hs is
about forty-two years of age. He is in the
prima' and vigor of manhood—hale and atbleti. ,
in appearance, and apparently capable of coping
successfully with a majority of his fellow-men
Nature has given him a good proportion of the
means of self-defence. nal a man thus endow
ed shall adopt the principle of non-resistance.
and submit tamely to a beating from another i
a shame to mankind and a crime against nature.
Nature has endowed every titan with the instinct,
el resentment and self-preservation, and given
him strength to back them ; and to ignore those
instincts, and refuse to employ that strength
unnatural, shameful, and cannot command the
sympathies of mankind. What. man or woman
will applaud Mr. Sumner for sitting still in hi
arm-chair and letting another man beat him over
the head with a cane? The man was probably
not one whit his superior in physical capacity—
in health and vigor. Any man who can call 1 . ,,r
help can help himself a little.
Well, this thing of non-resistance may be right.
but, if so, it should be acompanied by a blame
less life, a gentleness of manner, a softiies, of
words that sill give no offense. To shield one'.
self under the plea of non-resistance and then
assail others with bitter and reviling language,
is a cowardly crime. The weak may not insult
the strong with impunity; and the non-resistant
may not insult those who will resent it with
blows. Mr. Brooks has acted the ruffian, ha
committed a crime in law, and, we think, a
breach of privilege. He may be punished by
the Senate; he may be punished by the Court.
But after all is said and done, Mr. Sumner ha
furnished his assailant with some excuse.
Saunter Butler, of South Carolina, is one of
the oldest men in the Senate. His log hair i+
white as snow with age. Mr. Butler VVIY al,
sent from Washington when Mr. Sumner made
his recent speech. Vet nothwithstanding his age•
and his absence, Mr. Sumner reviled him with
abusive epithets. After arguing that slavery
was all that was vile and wicked, he denounced
Senator Butler as its Don Quixote and its cham
pion. Mr. Brooks is a relative of Senator But
ler, and he undertook to chastise Mr. Sumner for
this assault on the absent Senator.
Now, if Mr. Sumner was a fighting man he
would have the right to use such language, being
restrained only by the courtesies of life ; but being
professedly a non-resistant, he has no such right.
We neither justify nor excuse the assault. 1 t
should be severely punished, and 'we hope it will
be. But these none resi.teut men, who can
shower down bitter and reviling words, but will
not defend themselves, are a disgrace to the
Northern States, as ranch as the bullies and
ruffians are to the Southern. Had Senator Sum
ner made an effort at defence by any means Within
his reach he would have had the general sym
pathy.
The Washington Star, in speaking of that
portion of Mr. Sumner's speech where he assails
Mr. Butler, says : .
" His personal villification and abuse of Senator
Butler, than whom a more considerate and higher
toned gentleman never graced a seat in the national
councils, caused a blush of shame to mantle the cheek F
of all present who respect the body before whom it
was uttered ; became it was wholly unjust and untrue,
and, in style, far better suited to some low doggery
in a region of country wherein billingsgate is uttered
with impunity, because it is not customary there to
resent and punish such language personally."
IN /4 4 RANE.—We exposed a fraud at d

hood in the Gazette the other day, and it hat
been in a "pretty considerable decidedly partic
ular rage "at us ever since. Can't help it; it
was our duty ; an unpleasant one, but we could
not shrink from it. "Let the galled jade wince,
our withers are unwrung."
Our only objection to the Gdzette being filled
every day with Kansas matters, is the compas
sion we feel for its readers. If they take no
other papers, they must be sitting in darkness,
indeed. All the rest of the world is a sealed
book to them. They are only told aboi _Kansas,
Kansas, Kansas ; and one-half they are told about
that is false upon its face. It itl well understood
to be a mere electioneering device of a broken
down party—a forlorn hope of a sinking pack of
political jagglers. But the joke of the thing is
that they imagine they arefrigiarning the demo
crats: Just think of that!

than any other. He is the choice of the people,
then ; and to say he should not be nominated if
Bound is to say that the people should not have
their choice. Is that democracy ? That may do
down in the " old Bay State," where the democ
racy are always in the minority : hut it will not
do in Pennsylvania, where it almost always tri
umphs. It would 'seem . that the democrats in
Massachusetts have been beaten so often that
they rather like it; and hence care nothing
about selecting an available man, and so insur
ing success. If the people are not to have their
choice by the selection of the available (because
popular) man, :who is to have the choice? The
politicians? Friend Greene, that will never do.
It is not " popular sovereignty." It is not the
people ruling themselves. It 1.1 not democracy.
Provided the candidates are all equally sound
on the great principles of the party, the most
available one should he selected ; because in that
way we give the people their choice, and insure
the success and triumph of our principles. No
one man can monopolize a principle of the party,
and say he must be the candidate to vindicate
the principle. The party can be made the pro
perty of an individual for no such a purpose.
The Boston Pool, article is aimed against Mr.
Buchanan, and is of course an admission that
Mr. 11. is now the must available man that the
democrats can nominate. The admission is right,
but the argument wrong, and it will prove un
availing.

But it would be most unwise to disregard
availability at the present time. It is folly to
say we can elect any man who may be taken up.
That boasting confidence might meet a sad re-

BOSTON, May 21.—The Personal Liberty bill
came up in the House to-day, and Mr. Hale, of
Boston, moved to substitute for the majority re
port (in favor of retaining the law) the minority
report, (for its repeal). The motion was carried
by 130 yeas to 113 nays, many members dodging
the vote.
The majority was composed of straight Whigs
and democrats and a portion of the Americans.
At the adjournment to dinner a motion was pend
ing, made by a free soil member, to indefinitely
postpone the whole matter.

Ledger states that private letters from London
speak of Jenny Goldschmidt's success there as
fully equal to her former triumphs.' Her chari
ties have been, as usual, most noble ; matrimony

OVERLAND EMIGRATION TO CALIFORNIA.—The
difficulties on the Isthmian travelling routes have
caused the Californian emigration to revert to
its overland route through Missouri, Kansas,
Utah, etc. A letter from Palermo, Kansas, says
that this spring there is quite a large overland
travel of this kind through that territory and
bound for Kansas.
THE Sub-Marine Telegraph Company is about
to resume and complete its line from the island
of Sardinia to Cape Ben, so that Paris will soon
be placed in telegrtrile communication with the
colony of Algiers. 'I'LL, marine cord has been
reduced from seven to three threads.

The people of Lawrence had sent a note to
Colonel Sumner asking him to station a body of
troops in the vicinity to prevent the mob It.=
proceeding to sanguinary extremities. He declined
saying, he had no power to move without orders.
Mr. Cox., of Lawrence, waited on Marshal Don
aldson, to ascertain if anything could be done
peaceably to prevent his monster posse entering
the town. Mr. Donaldson said their demands
must be complied with, that every man against
whom a process was issued should be surrender
ed ; that all munitions of war in Lawrence
should be delivered up, and that the citizens of
Lawrence should pledge themselves under oath
to implicitly obey the enactments under which
Cie Territory is governed.
Upon receipt of this, the citizens held a meet
ing, and drew up a letter to the Marshal, stating
that any person acting under him would be al
lowed to execute legal process against any in
habitant of Lawrence, and that if called upon
they would serve as a posse in aiding the arrest ;
that there would not now, or at any future time,
be any resistance to the law, and that they only
awaited an opportunited to testify their fidelity
to the Union and the Constition. They claimed
to be law-abiding, order-loving citizens, and
atked the protection of the constituted authori
ties.
The purport of the Marshal's answer was that he
did nut believe the promises of the people of Law
rence that he regarded them as rebels and
traitors, and that they should booty what his de •
mands were when be came.
Mr. Brown, editor of the Herald of Freedom,
writes that a mob entered the hotel at - Kansas
City, where he was staying, and dragged off a
man which they supposed to he himself. tin di , -
covering their mistake they returned and de
manded him of the proprietor, who refused to
deliver him up to them. A company of Michi
gan emigrants then entered the hotel tu protect
the occupants. The mob were still surrounding
the hotel, and gathernig reinforcements at the
close of his letter. No authentic intelligence
has been received concerning his i Brown's) fate
since his capture.
These is a paragraph going the round of the
papers to the effect that Col. Colt's invention of
the Revolver is no novelty, and that pistols of
a similar construction have long existed in
the tower of London. This in a fact. At
the Great Exhibition in 1861 we ourselves saw
a pistol in thecollection of ancient arms, which
in construction nearly resembled that of Col.
Colt. It had six chambers, but if we recollect
rightly, it was the barrel which revolved. It is
perfectly possible, however, that Col. Colt had
never seen or heard of these pistols, as it is more
than likely that the officials in charge of the ar
mor at this tower did not themselves know of
their existence. In the excitement consequent
on the Great Exhibtion of ISAI, they were, how
ever, disentombed, and were a matter of mu h
speculation to those curious in such matters.
