Overt nets done in pursuance of a conspiracy arenot
the conspiracy,.but Its offspring—not the offence, but
the evidence of it—nut the subject matter of an ln
dietment, but when proved, are evidence to .support
the charge contained therein. The literal meaning
of the word conspire is to band together, and •not
to act together. The conspiracy is the agreement,
the acts are the result of it; the act* are nut a canoe,
hat a consequence.
In winding up the Judge remarks :
\The defendants are indicted for wickedly, corrupt
'y, and unlawfully combining :rod conspiring. You
ill calmly review the evidence and the whole con

net of the defendants, and if you can reasonably tic
otmt for it on any other theory,. supposition or by.
°thesis, if yen can fairly ascribe the acts of the de

If Louisa Stoip, moved by her own individual sug
gestions, from motives of lust, or lucre, or both, as
sailed the chastity of the prosecutor, to which assault
ho did not yield, and Walker's suspicions ware arous
ed, unjustly awakened against, the prosecutor, and
from what he considered a sense of duty, ho deter
mined to detect, and put his intent in execution, and
the prosecutor was aroused from alnmbisr by the un
expected presence of thie woman, and the tumult that
ensued: then the prosecutor stands free from all
fault, his character in this transaction spotless, and
your verdict wpuld be one of acquittal, for itrequires

Conldock's general excellence as an actor—of his
superiority in such characters as Luke Fielding,
Rieblleu, Lear, &c., and therefore it is almost super
fluous to say that last night we were delighted with
hisitopersonation of the proud and much abased aid
King. We were pleased, too, to see so good a house,
for it isan evidence of the taste of our citizens. It
is only once in a great while that they have a chance
to see Mr. Couldock, and none should miss a treat so
rare. To-night the pieces are " The Advocate," and
" Still Water Buns Deep. " Of the former we have
Pregnantly spoken. The truth is, Mr. Coutdo..l will
not play a clap-trap piece, nor perform a 'character
until he has thoroughly mastered it. Of the latter
we can only say that we have never seen his John
ildway, in "Still Waters," but It has received the
highest encomiums in other oitiea. If some of the
gentlemen who "support" Mr. C. were a little more
fa briar with the text, it would avoid a number of
very embarassing "scenes," not down on the bills,
which are of nightly occurrence. The -play of
" Hamlet" was terribly emasculated to suit the cepa
airy of the company, bat notwithstanding, several
dreadful pauses occurred.

The president announced that theapecial meeting
was called for the purpose of granting the Allegheny
Valley R. it. the right of way through the city, via
Pike street ; also for the ptirpose of memorializing
the legislature on the subject of additional taxation.
A resolution was received from the Select Conceit
requesting. the Legislature to authorize the city of
-Pittsburgh to levy an additional tax of four mills on
the dollar, to provide for the payment of the city
'bonds to the Steubenville Railroad. There was some
opposition at first, but after it was explained that if
the bill were not passed immediately, it would not
reach the Legislature in time, it was road and passed
three times by a vote of 24 yeas to 4 nays—the
latter being Items. Evans, Fitrizamous,-Irwin and
Scott. " .

is estimated tint 2,000 regular troops and volunteers
are preparing to take the field.
The Panama Star and Herold attribute the defeht
of Behlissinger to the culpable want of vigilance and
discipline. The Americans were surprised, and the
battle lasted only 14 minutes. Costa Ricalls Liss,
forty five killed and wounded.

Accounts of the battle from Costa Rican sources

ported that the fort was in possession of the Costa

The Empire City brings a portion of the crew of the
Sea Witch of New York, which was lost at Havana.

against Cohen.
The Democratic State Convention has appointed
Delegates to the National Convention at Cincinnati,
after• adopting resolutions approving of the main
Features of the Nebraska bill, and &cluing James;
Buchanan their first choice for President.
The California Senate rejected the resolution con
demnatory of the election of Speaker Banks, which
had previously been passed by the Howe.
The steamer Cortin. which left San Francisco on
the 2eth for San Juan, took lUti recruits for IV aiker's
army.
An express arrived at Punta Arenas, which states
that 90 of Walker's men were found dead, and it
was' supposed that others had perished in the woods.
Official details from (len. Mora are published in
the San Jose papers. Previous accounts state that
Costa Rira was in great excitement, and that the war
was popular with all classes. Many foreign residents
had rendered services to the government. A levy of
$9,000 has been ordered, and a loan of $lOO,OOO.
Puntas Arenas was full of troops under Parda Pulew.
The principal army of 3000 strong, under Gen.
Oera, was marching upon Nicaragua, and would
cross the frontier in eight days.

states That the attack lasted fourteen minutes, when

/larch by a party of 500 Costa Ricans under Gen.
Ward, and entirely defeated.
The 19 prisoners eourt-martialed and shot by the

Accounts say that Walker', party were surpris

leaped the walls and with knife and bayonet cut
down all they enconntered and dispersed or took
