Julia Conry's Administrators vs. Pennsylvania
Railroad Company. This was a ease in which the
husband of Julia Conry sued the Pennsylvania Rail
road Company for damages in consequence of her
death, alleged to arise out of the Company's care
lessness. The deceased was in the emigrant train,
when Mrs. Cowry and another woman got out of the
train against the orders of the Company's servants,
as it is alleged. Another train was coming along at
the time. They were warned or the danger, and the
other woman stepped off the track, but Mrs. C. did
not before the locomotive struck her, killing her in
stantly. The case has been on trial since Tuesday,
the Jury in the meantime going to Altoona to see
the scene of the disaster, and witness the operations
of trains under similar circumstances. Judge Hamp
ton charged the Jury as follows on Saturday more-
ing •
CHARON: Corry's administrators vs. Penna. It.
It. Company. The plaintiff, with his wife and two
children. took passage in the emigrant train on de
fendants' road from Philadelphia to Pittsburgh, in
April, 1854. They arrived at Altoona on Sunday
morning. where the train was placed o n the s ide
track, as shown by the diagram exhibited to the jury,
where it remained until about noon the next day,
when it was dropped down to its place of starting
west. The Hollidaysburg train came up on the
branch road from that plane on time, as it is alleged,
and after entering upon the main track, backed- up
the same post the e migrant train, at some distance
from it, and at the moment the plaintiff's wife, who
had left the latter train but a few minutes before.
was crossing. or walking along the main track, she
was knocked down by the backing train and instant
ly killed. John Corry. her administrator, now brings
this action to recover damages for the alleged negli
genet, of the defendants under the act of 15th April,
I S5l. (Dunlop, 1145.1
The plaintiff's counsel contend that the defend
ants, by their efficers, were guilty of such negligence
in the maartgement of the backing train, as will ren
der them liable in this action.
The defendants' counsel take defence on three
.grounds :-
Ist. That the plaintiff cannot recover as adminis
trator of the deceased because, as they allege, the act
of April. 1551. was virtually repealed by the act of
26th April, 1555: and
2,1. That the death of the plaintiff's wife was not
caused by any negligence on their part, but by the
want of proper care and caution en her part : and
3,1. That if there were any negligence, or want of
care on their part, yet. that she was guilty of negli
gence a l s o, which would prevent a recovery in this
case.
First. then, as to the repeal of the Art of 1851, which
embrares the first craned of the defence. This injury
occurred in April. 1854. and the present action R 31 3,
brought In July Term of that year. Under the pro
visions of that Act, at the tine this suit was instituted
the plaintiff had a right to sue as administrator of bin
wife—and the only question is whether that right was
taken away by the Act of April. 1855. The Act of
1551 is not repealed in express terms. nor do I think
it is so by implication, so far as to Affeet proceedings
commeneed under it before the passage of the latter
act.— The intention of the Legislature in passing the
act of 18:A seems to have been merely a limit to the
right of action to the husband or widow, children or
parents of the deceased, and consequently to prevent
the damages that might he recovered from distribu
tion among creditors. But if this were not so the
plaintiff would be allowed to amend his :Carr, in ac
cordance with the provisions of the 23 section of the
act of April. 1555, and as the plaintiff would have
the right under the first section of this net to sue as
the husband of the deceased, the fact of describing
bite as her administrator would not vitiate the writ,
but would be treated as surplus:cage. This has been
repeatedly ruled in Pennsylvania and elsewhere.
This groun•l of defence therefore is not available.
The second and third grounds of defence go to the
merits of the case, and if sustained by the evidence,
must defeat a recovery in this action.
This branch of the case raises two questions.—let.
Was the deceased guilty of any degree of negligence
which contrilnited to the injury complained of? II
so the plaintiff cannot recover, no matter whether the
defendants were guilty of negligence or not. But if
there was no such negligence on her part, then 2d,
was her death canned by any culpable negligence on
the part of the defendants? If so the plaintiff will
be entitled to recover. But if there was no suo•h neg
ligence. then the defendants are not responsible, and
the plaintiff will not he entitled to recover.
What constitutes eulpable negligence in any par
tiralar ease must always depend upon the fleets and
cirounistntices attending the act or injury complained
of . 5./ that no invariable ride ran he laid down whirl

gros , .. very gross, and .light. Gross negligenra
consists in the omission of that care which even in
rate-wive men, thoughtless men. never fail to take
their own property. Ordinary neglect is the want o
that diligence which the generality of mankind u•
in their own catieerns, that is. of ordinary care.
Slight neglect is the emission of that care which
very attentive and diligent persons take in their own
goods. or, in colter words, of very exact diligence.
It is well settled that those entrusted with the man
agement of a 141111ra:el are held to the strictest vigi
lance: They are bound to exercise the utmost care,
skill and dili gen ee in relation to their passengers and
the property committed to their charge. They are
responsibly for every injury mused by any species o f
negligence, however slight, which they or their agents

of the Pennsylvania 1 11'1 nod Company, on Satur
day, presented a pet,tion in the Court of Common
Pleas, for the appointment of a Commissioner to take
testimony in the matter of the assessment of taxes by
Caleb Russell, assessor of the First Ward, upon the
Duquesne Depot. The petition sets forth that the
Depot is of public utility and benefit, and that the
Company does not derive any revenue therefrom.
The structure was erected at a cost of $lBO,OOO, and
was intended, and is used for the safe storage of
goods, the owners of which merchandise pay no sum
whatever for such storage. This statement was also
made to the County Commissioners, who refused to
free the Company from the payment of the taxes,
which amount to $llBO. The proceedings com
menced on Saturday are under the nett of April 1844
and 1848. The County Treasury is already far from
being in an overflowing condition : indeed, there are
not a few wise old heads who say we are bound to ar
rive at repudiation, sooner or later, in consequence
of lavish subscriptions to bankrupt and unfinished
railroad corporations. The Pennsylvania Railroad
is in a flourishing condition, and it was constructed
in part by Allegheny county and Pittsburgh. We
have also impoverished ourselves in aiding roads
that are intended to be feeders to the Gaeta Central
Route; how the latter, therefore, under the circum
stances, can come into Court and ask for an abate
ment of taxes, is not altogether clear to our idea of

not exactly the state of affairs in the present instance.

their entire satisfaction in the manner in which it is
conducted under the control of Mr. Phillips, why ,
appears to study the comfort of the inmates in clean
Loess and the good order apparent throughout ; at
the same time, this Jury would recommend that some
prorision should be made for the moral and religious
instruction of the inmates, at least on the Sabbath
day. They likewise concur in former presentments
of Grand Juries, wherein they recommend the em
ployment at labor of committed vagrants. After
visiting the penitentiary, under the control of Major
Beckham, they state they found that establishment in
very good order, neat and clean, and the provisions

Attempted Jail Break at Canton, Ohio.
CANTON, 0., April 4.—On Thursday last, while the
Jailor at Canton, Ohio, was taking a prisoner from
the Court House, where be had been under trial for
passing counterfeit money, he saw a number of sus
picious looking persons around, and called to his aid
three or four citizens. Nothing transpired until he
unlocked the door of the cell, when the .prisoners,
some five or six in number, rushed on the Jailor,
knocking him down. His wife, hearing a noise in
the hall, locked the inside door, thereby keeping the
prisoners still safe. On looking out of the front door,
these suspicious personages wore seen lurking around ;
she immediately locked that door also. The priso
ners were put in irons. Considerable excitement is
manifested in the town and some fears are entertained
of an attempt to rescue the prisoners by their friends
to-day, us they are still there; but they are prepared

Bowen, will see that all arc made comfortable and at home
who travel on the Mansfield."
Tus line steamer `• Paul Antietam," Capt. S. Dell, will
positively leave this Evening, at 4 o'clock, for Keokuk and
Davenport. Passengers wishing a good and comfortable
boat to travel on should calkon board early and secure their
