Commonwealth vs. William iire.itrake : indictment,
seduction, on oath of Miss Mary Murray.
This was the first case called up, and re; it is rather
important, being the only one over tried in Allegheny
county ender the act of Assembly of 1843, known
as the " Seduction Law," we give below the evidence
in full.
The prosecutrix Is about nineteen years of ago, of
prepossciiing appearance, and was formerly a com
positor in the Dispatch office. She is well educated,
intelligent and accomplished. The seduction is al
leged to have been achieved under promise of mar
riage, a positive proof of which will be necessary
to warrant a conviction.
The defendant Is a young man of respectable pa
rents, and resides in Allegheny.
District Attorney Roberts and M. Swartswebier,
Esq., represented the Commonwealth ; Col. S. W.
Black and T. B. Hamilton, Elm., appeared for the
defendant.
Mr. Swart:weldor opened for the prosecution by
reading the act upon which the charge is brought.
It provides that any person found guilty of seducing
it female not twenty-one years of ago under promise
of marriage shall be subject to a fino not exceeding
$5,000, be imprisoned in the penitentiary not less
than ono, nor more than three years, or sent to jail,
as the Court, in its discretion, may choose. Ile also
gave a brief history of the case; after which the
prosecutrix was called and sworn.
Miss Mary S. Murray, steer"—ln Juno, 18.54, resi
ded in the city of Allegheny ; was then -engaged as
a compositor in the Daily Dispatch office ; had been
engaged there from September, 1853 ; lived with my
father; became acquainted with the defendant, Wm.
Oreatrake. about the first of June, 1854, at the house
of her mother, where I was introduced to him by his
sister; was only in the house a few minutes, and
when I returned home, be went with me; a few days
after, he called at my father's house, in the evening,
after tea, and staid two or three hours ' • shortly soh
sequent he called again, and staid an hour ; on the
9th of June I went with him to the theatre; idler
that ho generally called two or three times a week ;
during these calls I was sometimes alone, and at
other times persons wore with me; these visits were
continues until the latter part of July ; on the 4th of
that month be proposed marriage to mu ; did not ac
cept htm at that time ; he also made other proposals
I did not like ; he said if I would submit to his de
sires he Would marry me as soon as convenient; told
him to go home; he went ; saw him next day in my
father's house, when ho made excuses fertile conduct
the evening before, saying he had been under the in
fluence of wine ; he asked me whether I had consid
ered the proposal he had made me ; told him no ; he
said he wished I would; I replied that I did not ex
pect to see him again, after I had ordered him from
the house ; before be went away, told him I would
consider his proposal ; saw him again in a few days ;
he asked rue what conclusion I had come to, and I
replied, I would marry him ; this wee about, the 12th
or 13th of July; shortly attar, he Called upon me,
and again made improper proposals; he also acted
and spoke very rudely, which caused me to tell him
to go out of the house; do not know whether he was
under the influence of liquor; be made improper
proposals to me nearly every night he called ; 6n
the last Sunday in July, he came into our house,
just before Chueoh time, in the evening; we
took a walk, and came hack about nine o'cloek
the family was up stairs ; he again made improper
proposals,:and said if I would submit, he would mar
ry um; he succeeded ; I was then engaged to be mar
ried to him, and it was those promises that induced
me to submit; he said he would marry me in a month
or two, as his eireunistances would not permit him

Common chervil.--President Miirehall in the
The special committee, to whom had been referred
the subject of purchasing Lowry's steam engine, re
ported that they had raised $1,600 for the purchase
of said engine, and arranged for the payment of that
amount to Mr. Lowry. The report further stated that
as soon as the arrangements wore made, the engine
would be delivered up to the Committee on Engines
and Hose.
A resolution, offered by Mr. Errott, requestng the
Legislature to pass an act authorising the opening of
Pennsylvania Avenue, was road and referred to a
Special committee of five, with directions to report
at next meeting.
A resolution, requiring the city tax collectors to
levy upon property belonging to the Pennsylvania
Railroad, an which they refused to pay taxes, was
read three times and passed, after being so amended
as to make the city responsible for costs.
In Select Conseil, the City Solicitor, in pursuance
of a resolution passed at the last meeting, reported
that the Pennsylvania Railroad had refused to pay
taxes on their depot in the city, on the ground
that they were oxlionorated by their charter; he
also stated that the County Commissioners were
about testing the matter before the District Court.
The report was accepted, and a resolution instructing
the City Solicitor to assist the Commissioners in their

The ordinance granting the right of way to the
Allegheny Railroad by Duquesne Way to the Aque
duct, was taken up, but after considerable discussion
was lost by a vote of four ten.
A vote was then taken on the ordinance, granting
the right of way down Liberty atroet, which wad also
lost by a vote of four to to ten.
Mr. Varnum read in place an ordinate granting
the right of way down Butler and Pike streets, to the
canal, which elicited a very animated discussion, and
passed to a third reading.
