—Tho following decision was delivered by Judge
M'Clarep on asttrday, in the Court of Quarter Ses
eiOnS, in relation to the matter of jail allowances. rt
will ho found interesting to every tax-payer of the
county:
In the matter of the application of William Magill,
late Sheriff of Allegheny county, to the Court of
Quarter Seasionii, in account with the County Com
missioners.
The application is basis! upon an Act of Assembly
approved May Bth, 1855. Pamphlet Laws, 1855, page
520, which is as follows:
Sec. 1. "That, from and after the passag e of this
Act, it shall be the duty of the Court of Quarter Se!--
along of Allegheny county to fix and settle upon the
amount that shall be allowed and paid by the Couoty
Commissioners, to the Sheriff, for the per he sup.
port of each prigener who has or may be in the Slt id
jail, and said allowance shall be paid by the said
Commissioners, and Ruch order shell be made from
Lime to time by said Court as they luny Jerre prudent
and right."
The dally allowance for the support of prisoners
now, and for thirty-two years past, has been:
I. For vagrants, ten cents a d ay
for each vagrant.
2. For court prisoners, fifteen cents a day for each
court prisoner.
The petitioner sots forth the unpreredented hizh
price of flour and of the necessarae of ht . ° during a
portion of the time he was in office, and asks the
Court to fix, as may he just and proper, the daily
support of each prisoner who has been in jail from
the commencement of his term of oflire. The facts
set forth in his petition are true to the letter.
The rate insisted on by the Sheriff's counsel ix fif
teen rents ft day for each vagrant and twenty rents a
day for sash court prisoner.

The Sheriff is perpetual, though the incumbent in
transient. The County Comtnissioners are quasi car

I pereeived from the drift of the arguments of learned
counsel, some embryo applications to this Court to
"fix" and "settle" for sumo of the petitioners, prede•

Each member of this Court, after frequent and careful
