Jas. H. Hopkins. J. E. Brady and Wilson M'Candless for defendant, and Messrs. It. Biddle Roberts and Thos. Mellon for the Commonwealth. The following reasons for a new trial were pre sented by Mr. Hnpkin, • Ist- Thu court erred in admitting in en idence a paper purporting to be an article at agreement be tween Janice M'Corkle and Leeerton Thomas, dated July 11, 1815, and relating to certain property in Sligo. 2d. The court erred in admitting in evidence the blank paper signed by Thns. M'Corkle. and purport ing to be witnessed by flew Rohl, I'.l. The court erred in rejecting the offer of the defendants counsel to prove that the farm of James .51.'Coz kb-. in Washington f•ounty, oltorod at pub• lie sale before it was sold to Robert Officer, and the price which ons bidden for it. itlf. Although correct iu the main, the able views expressed by the court in their charge to the jury, upon:the farce of eirtannstential evidence, were cal- Ciliated to mislead the jury, but certainly not so tie signed, and In, induce them to disregard the positive evidence of the note and article of agreemebt, charged in the indictment as having been forged. tith. The verdict of the jury was against the weight of the evidence in the case. 7th. By a 'misunderstanding of the agreement of the defendant:4 counsel with the counsel for the Commonwealth, as to the reading in en idence of the pispers filed in cases NOR. sii9 and 570, of July term, 1852, in the District Court, the defendant's counsel did not put to evidence a certified espy of liens against James M'Corkle, of record in Washington county, and of the time of tho dale the firm to llebert .I)fricer, which would have shown that the ;whole $5,200, the consideration of the purchase by Okecr, were applied by him to the payment of said hone, and that a balance of a gout judgment of a $2,000 in favor of Levortun Thomas, the defendant, was left unpaid. Mr. Officer'edeposition. which de fondant's counsel understood it wee agreed should he read in evidence, proved the same fact, and that do_ fendant's counsel subsequently offered said list of liens in evidence_ Bth. Nowhere does it appear in the evidence that the alleged forgery woo committed within the county of Allegheny. qui. The uttering of the alleged forged papers was not by the defendant, if any uttering is preyed, but was brought into court (District Court) upon proper notice in the trial of a civil cause. 10th. Aside from tic ten papers deseribod in the indictment as forgeries, the ether papers containing the alleged signatures of Thomas .M . Corkle and ties. A. Robb, which were offered to contradict Robb, were nsed by the Commonwealth as waiters in chief. l 1 th. That Mrs. Sanshury, formerly the wife of Metehoir Beltshnover, saw James 111Torkle out about his usual business in the month of March, 18.16, and that he (M'Corklei Ind-rowed Belishoover's horse, and that she saw him start. Some time in the month of April, in the same year, as M'Corkle said, to go to Leverton Thorns' house. A number of depo,sitionm were also read on both ; sides. The arguments wore quite lengthy, and oc cupied the attention of Wu court the greater part of the day. At the conclusion, Judge Ai'lllure took the various doetunents into his possession. When he first made his appear ance he was enthusiastically applauded, and must have been gratified with his cordial reception, lit:- performed as he alwa)s does, wonderfully, and it is impossible to discriminate where all was so excellent: suffice to say, that lie played like Ole Bull, and we never beard him perform better; he was heartily en cored at the conclusion of each piece. Signorina who appeared for the first time before a Philadelphia audience, sang with great sweetness and expression; her rendering of Bellini's celebrated aria " Qui la Voce," was all that could have been wishetti anti her execution gave evidence of great skill and study; she was warmly encored. N.,: Gas 1.111,“ r.--Messrs.. Baker, ha Costa & he Silva have presented us with a pair of new gas born yrs, which they are about introducing to our city. We have had them on trial in our office, and find them to be what they are represented. The Phila delphia press speak highly of them, as an improve ment and a saving over the old burner. The time required by the old burner to consume a cubic foot of gas is nine and a half minutes; by the new, fifteen minutes. The invention consists of two jots which blend together and thereby consume nearly, if not quite, all the blue flame which issues from the burner, and is lost iu the ordinary burners. Messrs: Bolter & Da Costa have recommendations from nearly all the eastern gas companies, and we would advise all who wish to save gas and get a good, steady light, to give their burners a trial. Friuli Accident on the P,onsyteunia Railroad.—A man named Aden Dougherty, rt.siding in Altoona, was killed at Tyrone, on the Pennsylvania Railroad, on monday last, by a freight train passing over him. Ho was a brakeman on one of the freight trains, and at the time of the accident was standing on the track looking at the emigrant train, which was vainly at tempting to got in motion, when the local freight Gain, which was backing towards him, knocked him down, and three or four cars passed over both of his thighs and right arm and shoulder, crushing and mangling them most horribly: The sufferer was dragged by the brake of ono of the ears for a consid erable distance before the train could be stepped. After being extricated ho lingered for about two hours, when death put a perion to his sufferings. They furnish far the best mode of limiting dwellings, churches and other public buildings that is now in use, according to the opinion of many good Judges who have examined them.
