IMPORTANT DECISION.
The following important decision to merchants
and transporters, was delivered in the Supreme
Court of Philadelphia, on Thursday last.
Whore defendants were both warehousemen and
CWILIIIIIIOI3 carriers at the same time, and goods were
delivered to them with directions, '• to ship immedi
ately," and defendants placed the goods in their
warehouse, whore they were destroyed by fire before
shipment: Held, that the liability of defendants was
that of common carriers, and not simply that of ware-
housemen.

fendants below were warehousemen and common
carriers at the time the goods were delivered to

Sias :—I am a Westmoreland County farmer,
and have an interest in the way of getting my
crops to market. All the farmers have, and there
is no respect in which our circumstances have
changed so much as in this. In 18d0 we had to
haul our wheat, &o. to Blairsville or Pittsburgh
at a great cost, and when we got it there half the
time nobody would buy it, and when they did it
was at low prices. In 1851, we sold our flour,
the best of it, at three dollars a barrel. In 1852
we did somewhat better, and now since the Penn
sylvania Railroad is open, we get -prices high
enough, and perhaps lately, a little too high.
But this is in consequence of the war inEurope and
a short crop year-before last, and will not last
long. We must alt expect to get just the price
fur our produce of the Eastern markets, after
deducting the expenses, and we aro just as much
worse off than we have a right to be, in propor
tion as these expenses are greater, than they
ought to be. Qur lands in the West arc fairly
worth as much less than lands East of the moun
tains as the differ - Mice of the cost of transport of
the various products to the great markets of the
Eastern cities. I mean that we must expect to
lie as much poorer than if Ihing in the East as is
the cost of g etting to market greater titan in the
East. But if the State steps in and forces us
to pay a tax on our farm crops, which is not paid
by people generally, and thereby makes a differ
ence between us and our fellowseitizens else
where, it seems to me to be unfair, and to be
still more unfair if it he a tax laid upon our
erupe, ice are very far from the markets,
and are for that reason itseir necessarily and nat
urally compelled to pay a price for carriage of
our crops to these markets, from n great part of
which people in the East are exempt, because
they are handier to Philadelphia:

lar here. The State wants three cents from

age to get a road of our own. Then, some "wise
man from the East - undertakes to say that al
though we have waited su long, and labored un

and paid so much money—and all without any
good whatever to ue—that before we shall use
this road, that is at last built, we shall pay IL
particular, special, exclusive, discriminative, un
eg.cary and odious tax, that was never thought

Aml when we petition for its repeal and ask to
be put un a common equality, republican fashion,
with oar fellow-citizens in the east, we arc told
that to relieve us froth this tax will `• lessen the
revenue very seriously." Suppose it , toes—then
we are very seriously oppressed. The greater
the injustice, the stronger the argument. You
say you can't afford to do without this plunder
because It is so large. Make it twice as large
and your argument is twice as strong. It is only
when the victim of oppression is stripped to the
okm that such an argument stops.

Macaulay
A third instalment of the critique of the Lon
don Tunes upon Mr. Macauliiy's new volumns,
tilling five ecnipact columns, appears in that
journal of the llth. The writer throes in caus
tic and compliments in about equal measure. As
a specimen of keen criticism, Macaulay himself
could not have done better. We give the con
cluding sentences of the article:
,• What a triumph that, with all those blem
ishes, great and small, Mr. Macaulay has given
us a book which will not only live, but which
threatens by its fascination "to supersede his
tory." What a grasp it evinces; what a light it
sheds frequently on the obscurest data; what
a welcome shock it gives to our torpid recoliec
tions. No man living could have written two
such volumes; and if we have remembered that
we had to perform a critic's duty, we must not
forget that we have to record a nation's thanks.
The source of its enjoyment has been eagerly ac
knowledged; it is read and it will be re-read; it
will go down to posterity ; it will pass to distant
nations and foreign climes, and it will be a

When he receered and returned,:. los w a s
emplii?ed in the Coast Survey. While engaged
in this service, the government, by its correspon
dence with Lady Franklin, became committed for -
an attempt at the rescue of Sir John and his ill
st erred companions in Arctic discovery. Noth
ing could be better addressed to the Doctor's
g overning sentiments than this adventure. The
enterprise of Sir John ran exactly in the current
of one .of his own enthusiasm—the service of •
natural science combined with heroic personal
effort ; and, added to this sort of.patrietisinwhich
charges itself with its own full :share in the exe- .
' cution of national engagements of limier; and,
' besides this cordial assumption of his country's
debts and duties, there was no little force in the
appeal of a noble, brave spirited woman to the
chivalry of the American Navy.
Ile was " bathing in the tepid waters of the
Gull' of Mexico, on the 12th of May, 1850,"
when he received his telegraphic order to proceed
forthwith to New York, for duty upon the Arctic
expedition. In nine days from that date he was
beyond the limits of the United Statet on his
dismal voyage to the North Pole. Of his first
American expedition, as is well known to the
public, he was the surgeon, the naturalist, And
the historian. It returned disappointed of its
main object, after a winter in the regions of
eternal ice and a fifteen montics' absence.
Scarcely allowing himself a day to recover from
the hardships of this cruise, he set on foot die
1 second attempt, from which he has returned,- of
verifying by actual observation the long outs,

In his deportment there is that mixture of shy
ness and frankness, simplicity and fastidiousness,

the man of genius, and the monk of industry.
He seems confident in himself but not of himself.
His manner is remarkable for celerity of move
ment, alert attentiveness, quickness of compre
hension, rapidity of utterance and sententious
compactness of diction. which arise from a ha
bitual watchfulness against the betrayal of his
own enthusiasms. lie seems to fear that he is

question him about the handsome official ao
