Sec. 6. That those tavern, inn and hotel keep
ers, who apply for license to vend and retail only
cider, beer, ale, malt and brewed beverage, shall
be classed in the same manner tis above men
tioned in the preceding 4th section, and shall be
severally assessed and taxed according to the

Sec. 7. The 10th section of the act entitled
" An act to provide revenue to meet the demands
on the treasury and for other purposes," ap
proved the 4th of May, 1841, is hereby so far
altered and amended as to require every seller or
vender of wines or distilled liquors, either with
ur without other goods, wares, merchandise,
commodities or effects, shall pay for his license
so to sell or vend a like amount in addition to the
rates therein specified for the respective classes.
See. 8. Agreeably to the provisions of the act
approved 10th April, 1849, the Apprrilsers of
Mercantile Taxes shall make return to the Coup
ty Treasurer of the proper county, of the num
ber of rectifiers, of whisky and other ardent
spirits within their respective counties, specify
ing the names of such rectifiers, and the names
of the owner or proprietor of each, and the num
ber of gallons rectified, refined or distilled by
each per annum, of whisky or any other spirit
uous or ardent liquors. And all such rectifiers
shall be classed and required to pay annually,
for the use of the Commonwealth, for their re
spective licenses, agreeably to the said act of
Assembly, 100 per cent. in addition to the rates
above specified for the respective classes ; and
every license hereafter granted shall specify that
the party obtaining the i . tame is entitled to sell
rectiliisl whisky or other rectified ardent spirits,
hut by no means less than one quart. And the
raid rectifiers shall ahide by and be subject to
the several enactments and provisions and pen
alties contained in the said act of Assembly.
JANCAIIY 22
SEC. IL Distilleries and Breweries shall he re
turned, assessed and licensed, agreeably to the
provisions of the act of the 10th of April, 1849,
and the owner or proprietor of any and each of
said distilleries or breweries shall be assessed
.m.l required to pay anti tinily, as prescribed by
the said act of Assembly, Iv) percent. additional
on the rates or tax assessed, agreeably to the
above act. And the said rates shall be assessed
on the brewers and distillers of the city pf Phil
adelphia, provided the same shall not in ony case
be leas than $5O.
Suc. It). That no licenses whatsoever granted,
iu pursuance of the provisions of this act, shall
he assignable or transferre.l to another by trio
person to whom the same was granted. Nor
shall any such license give a right to keep a pub
lie house, inn, tavern or hotel of any kind in
any other house or building than the one men
tioned and describo in the license. Nor shall
the bar or any apartment so called, or the right
to sell amd retail any of the wines, spirituous or
milt liquors by virtue of a license, be underlet
or traosferable. or in any way liable to assign
ment., and any violation of tiny provision of this
section shall constitute and be a forfeiture of
any such license.
Six. I I. It shall be the duty of the County
Treasurer and the Clerk of the Court of General
QuArter Sessions of the peace of each county in

prosecution. And if the offender or offenders
shall have obtained a license agreeably to the
provisions of this eel, the same shall be forfeited
and all privileges under it shall forthwith cease.
And any fine so imposed as above, shall be re
eoi'erable in an action upon the bond, given by
the defendant or defendants and his sureties, as
well a, other stuns and responsibilities, covered
by the penalty of said bond.

stable and police officer within this Common
wealth who shall have a knowledge of any vio
lation of the provisions of this law, to make a
return thereof, with the name and residence of
the alleged offender to tine next Court of General
Quarter Sessions of the peace of the proper
county, and for every neglect or refusal so to do
lie shall be deemed guilty of a misdemeanor and

20. Fur the purpose of granting licenses
to persons to keep u tavern, inn, hotel, or public
house of entertainment, whether for the vending
and retail of wines, spirits, ardent and malt
liquors, or of welt liquor alone, within the county
of Allegheny, a board of licensors shell be con
stituted and authorized to act as follows, to wit:
The Judges of the Court of General Quarter
Sessions of the Peace, the two Judges of the Dis
trict Court, and the three ConntyCommissionem
of the said county of Allegheny, shall meet and
hold a public session in the court room of the
said Court of General. Quarter Sessions, within
fifteen days after the passage of this• act, and
shall order five days' notice to be given by the
Clerk of the Court of Quarter Sessions; et th e
expiration of that notice, the same official per
sons shall meet and hold a puplic.session in the
same court room, and shall there select and ap
point three reputable, disinterested and impar
tial persons, citizens of the United States, and of
Allegheny county, and not engaged in the busi
ness of tavern, inn, or hotel keeping, or in the

Board of Licensors fur the said county, and who
shall, for the purpose of discharging the duties
• enjoined upon them by this act, hold their first
public meeting in one of the court rooms of the
county Court house, immediately after their ap
pointment, and shall publicly receive and hear
the petitions and applications for, and the oppo
sition to, the grants of licenses; they shall in
quire into the moral characten correct deport
ment, and sobriety of the applicant, and ascer
tain the locality, commodiousness and extent of
the houses and property proposed be occupied
for the purpose mentioned in the petition. They
may adjourn from day to day, and-a majority
shall have power to decide upon any application ;
and in each case when the said Board shall de.
side to grant a license, they shall proceed agree
ably to the provision contained in sec. 5, and esti
mate and ascertain, as near as may be practicable,
the yearly rental, or valuation of. the house and
property intended to bo occupied as a public
house, and shall decide upon and order the rated
price to be paid for the said license, for one year,
according to the classification and scale contained
in the said section of this act, and which rated
price or sum shall be paid as herein prescribed
before the license shall be issued. After • the
said first public meeting of the said board of
licenses, they shall hold semi-annually public
sessions us aforesaid 4 the mouths of April and
October in each year, of which at least ten days
public notice shall be given. Immediately after
their first meeting, and also immediately after all
subsequent meetings, they shall deliver and have
tiled of record iu the office of the Clerk of the
Quarter Sessions of Allegheny county a written
table or list signed by them of the licenses by
them or a majority of them granted, the names
of the portions licensed, their places of residence
and the locality of the house and property
tended to lie used and occupied under the license,
:lad the rated sum or price assessed to be paid
upon each license—and the said Clerk of the
Court shall file the same of record, and upon
request shall make out and deliver to the proper
persons the licenses agreeably to the said written
list or table, for which service the clerk shall re
ceive from the person or persons licensed the fee
of one dollar for each license, at well as the sum
of fifty cents to be paid ever to the Board of
Licensers to pay any inciderital expenses incurred
by them. And each member of ,the said Ili all
of Licensers shall receive $1,50 for each thy
actually *necessarily occupied in discharge of
their duties, to be, paid by the Commonwealth
out of the fund derived from tavern licenses,
upon their certified written account transmitted
semi-annually to the Auditor General, and upon
warrants to be drawn by him.
SEC. 21. That a Board of Licensers shall be
established in the city of Philadelphia, to consi s t
of the senior City Commissioners or head of that
department, who shall be President thereof, anil
two citizens of the United States and of the said
city, who shall be annually appointed by the
Court of Quarter Sessions of the said county, and
lie of temperate habits, and in no wise connected
with or interested in the liquor business. The
said Board shall meet on the quarterly return
days of the said Court, and exercise all the au
thority of the Court of Quarter Sessions in the
other counties of this State in relation to - fixing
the rate and granting or refusing licenses to all
hotel, inn and tavern keepers within the said city,
subject to an appeal by any applicant or remon
- trant to the Court of Quarter Sessions, whose
decision shall be final.
Sc,-. '22. That said Board shall transact all
their business with open doors, audibly and pub
licly, keep a record of all their proceedings, of
the licenses granted, and of the rate thereof,
whieh record shall be kept by a clerk of said
department'whe shall note therein the yeas and

department at all times open to the inspection of
any citizen of this Cununonwealth,
S sr. 23. The said Court of Quarter Sessions of
the county of Philadelphia shall determine the
number of licenses which may be granted for ho
tels, inns and taverns, in the respective wards of
id city, having a regard to the necessary ac
cetionialation of travelers, distinguishing what
proportion now sell spirituous, vinous and tnalt
oportion shall sell malt
liquors, and what pr
quorstlthi cider only.
Sec. 21. The licenses ~ ,, T aitteil to any hotels,
inns and taverns in the said city, shall not au
thorize the keepers thereof, or any one for them,
ti sell any spirituous or vinous liquors to tiny
persons but strangers and travelers, or persons
for the time sojourning- therein, or upon the table
for those taking meals therein, and not to tran
sient callers from the- street or highway, or dwel
lers in- the neighborhood ; tun( any violation of
this provision shall subject the party offending to
the penalty of keeping a tippling house.
Site. 25. The members of said Board of Licen
sers shall receive from the State Treasury, on
war-rents drawn by'the Auditor General,
dollars cacti per annuM, in equal quarterly sums.
Set'. 26. The 'Pre/kg:arm- of said city shall have
all the authority olany County Treasurer, to re
ceive, collect and receipt for all tavern license
fees in said city, with the like compensation
therefor; but said fees shall be deposited with
and accounted for by said city, as provided by
law in respect to the State tax.
SEC. 27. It shall not be lawful for the clerk of
the Court to issue any license without the °reit r
or said Board of Licensers, nor until he appli
cant shall have filed the proof of the advertise
ment required by law having been made, the
certificate of the District Attorney that a bond
been approved and tiled, and of the City
Treasurer that the license fee has !seen paid to
hint.
SEC. 2S. The act approved the 14th day of
April, 185.7 i, entitled An Act to restrain the
sale of Intoxicating Liquors," is hereby re
pealed, and also the act relating to the city and
county of Philadelphia, passed the Mb day of
April, 1t4.114, (P. L. 657,) entitled an 4 . Act --
," is hereby also repealed, and no license
for any tavern, inn, ur hotel, shall be hereafter
granted, unless subject to the provisions of this
net.
