The Committee to whom was referred the' pa
pers and decision of the "Cominittee' of Arbi
tration " and "Committee of Appeal's" for the
"Cincinnati Chamber of Commerce," in regard
to a claim fur deficiency in the weight of flour in
a lot purchased by a dealer of Pittsburgh.,of one
in Cincinnati, respectfully report :
That the case presented for their considera
tion is one of great commercial importance,, in
volving as it dues, a vital principle as regards
moral obligation, as well as heretofore acknoWl
edged rights at common law.
The case and decision before your Committee
is simply this : A dealer in Pittsburgh sends to
his agent in Cincinnati to purchase and ship him
a lot or parcel of Hour, of a quality not inferior
to superfine. It was purchased, inspected by
the Inspector of flour, received and shipped to
Pittsburgh.
Upon its examination after arrival at Pitts
burgh, it was found to be deficient in weight by
the
,inspector of flour in the city of Pittsburgh,

The purchaser seeks redress from the seller
through his agent at Cincinnati ; the seller de

absence of prof of the deficiency in the weight
as the ground of their 'decision, nor the sup
position of loss by transit, but solely that inas
much as the quality was such as the purchasers
required, no evidence could be received as to
imm/ity, their Inspectej: having no legal deci
sion in that respect.
The Committee respectfully dissent from the
opinion of Arbitrators for the reasons before
named, to wit: That in the absence of any law
in Ohio requiring an Inspector to weigttor,deter

teitpt to perfect his crude invention, and it was
no until 1799 that he confided his discovery to

containing the result of his researches. Le Bon
conunenced by distilling wood, in order to obtain
from it gas, oil, pitch, and pyroligneons acid,

ing gas by distillation from fatty or oily substan
ces. From 1799 to 1802, Le Bon made numer
ous experiments. He established at Havre his
firie,t thermo-lamps, but the gas which he obtain
ed, being a mixture of carburetted hydrogen and
oxide of carbon, and but imperfectly freed from
it 4 impurities, gave only a feeble light and evolv
ed an insupportable odor, and the result was that
but little favor was shown to the new discovery ;
the inventor eventually died, ruined by his ex
periments. The English soon put in practice the
crude ideas of Le Bon. In 1804, Windsor pat
ented and claimed the credit of inventing the
process of lighting by gas ; in 1805 several shops
in. Birmingham were illuminated by gas manu
faCtured by the process of Windsor and Murdock;
among those who used this' ,new light was Watt,
the inventor of the steata- - engine. In 1816 the

1818 that this invention, really of France origin

woolens, $5,281,663 in cottons, $5,330,626 in
silks, $927,208 in flax, and $177,056 in miscel
laneous dry goods. The quantity entered for
warehousing during the past year was $8,627,-
974, against $13,607,196 in 185-4_ The quanti
ty withdrawn from warehouse was $8,586,868,
against $10,926,578 in 1854.
