OFFICIAL PAPER OF THE CITI
OEO F. tali-MORE. J. B. MuNTOOMEILT
GILLMORE & MONTGOMERY,
PROPRIETORS AND EDITORS.
MONDAY MORNING
We said, more than a year ago, that Know
Nothingism could not be permanent, and that in
the end the whole K. N. party would be sold out
to the Abolitionists. The process of sale is now
going on rapidly, and the design is to consumate
the transfer this winter at Washington.
How do our former - friends—those Democrats
who left our party to join the new party secretly
—like the disposition that is about to be made
of them ? Will they follow their leaders and turn
Abolitionists ? That certainly was far from the
thought of most of them when they left our ranks.
They would not he warned ; will they still follow
the lead of politicians who care nothing for
them, or for Abolitionism either, only so far as
it serves their own selfish purposes.
William H. Seward wants to be President.
He can only succeed by the formation of a gren
northern party, strong enough to carry every
et northern State. To do this, or to gain any hope
of doing it, it is necessary not to fuse with the
Know Nothings, but to compel the K. N.'s to
come into their ranks, and be the mere hewers
of wood and drawers of water under Abolition
leaders. No fusion or division of the spoils is
offered. The K. N.'s one and all must serve in
the ranks. Like the English army in the Indies,
which is officered by Englishmen and the ranks
filled up by sepoys or native soldiers, so the Re
publican party is to be commanded and officered
by Abolitionists. and drill sergeants of the Gar
rison and Greeley school will he employed to
teach the K.. N. recruits the manual.
That discipline will be pretty severe upon some
of our late Democratic friends. Commencing
with the simplest exercises first, the new recruits
will be required to shout lustily such compound
words as •' Doughfaces," " Manstealers," Ne
braska Iniquity," Southern Bullies, - and vari
ous other well known terms of awful sound but
very little sense. The next exercise will be a
little harder, implying, as it does, sonic wear and
tear of conscience in the way of a few falsehoods
that at first seem wicked, but habit, it is said,
makes them easy. They must say that the
Democracy is pro-slavery: that the Democratic
party and the present President desire to make
Kansas a slave State ; that the President is help
ing Atchison to drive the free State men out of
that Territory; that Passmore Williamson is
martyr, and Reeder a victim: that the Union is
only worth forty cents per head to the people of
the north : that the constitution should 1.0 pub-

Dnrroks OF POST.--I Raw R call of a uouitliittee in
the Union on Saturday morning, and find xliy name
among the names of the Committee. It pr4esses to
be the Democratic Executive Committee of the city.

Was it done according to the usages of the plrirty, or

questions will oblige Yours. &e.,
The writer of the above note is a well known,
sound, and excellent Democrat, and ent4led to
all the information we can give him on t4ie sub-

Two years ago, a City Democratic CoMmittee
was held, of which Jacob McCollister wag Chair
man. It was proposed that the delegates from
each ward give to the Chairman the naud' of one
person from their several wards, as suitable per
sons to servo on the Executive Committ4 for a
year. The Chairman of the Conventio4 made
those persons the Committee, making Mr. Charles
Barnett Chairman of it. That was tw l ;,j years
ago. Last year, in December, the term k that
Committee expired. They could hohi t over,
though, until a new Committee was appointed
by a competent authority. But instead 4 that
last year Mr. Barnett appointed a new Ckurnit.

get the field, procure Democratic signatures to a

to organize in full force.
There are the names of good men on the Com
mittee, but it appears that they have not been
consulted at all, as is evident front the foregoing
note of Mr. Irwin.
If that Committee, when it meets next Thurs
day, undertakes to endorse Mr. Vole, we shall
give to its action just as much force and con

A most extraordinary instance of fox preser
vation lately occurred at Comlogan Castle. Rey

hut, finding his earth closed, took a line for the
lining-room window. A visitor who was watch
' ing the hunt from the turret, and was puzzled to
hear one cr two of the hounds bay up to the
window, while the whole of the field were dig
ging furiously at a drain outside of the garden,
descended into that room, and found Mrs. Phil
lips knitting before the fire. On telling her how
oddly the fox had been lost, she quietly rose,
and, opening the door of a cupboard, showed
him the animal lying curled up on one of the
shelves. It seems that he had dashed through
the glass, and sued for compassion. Mrs. Phil
lips rang for her maid, and while the latter kept
guard against the hounds at the window she
found a refuge for the fox. She kept him there
all night and fed him. The cunning animal soon
became familiar with the domestics, and allowed
them to pat his head before he was let out next
morning into hie native woodland wild."

THE NEWS
The Trial of Baker—Proteating Attorney.
The trial of Lewis Baker, in Sew York, for
,hooting Poole, terminated on Wednesday, and,
up to last evening, the Jury had not agreed up
on a verdict. Before the case was submitted to
the Jury, and alter the charge of the Judge, Mr.
Brady, Baker's counsel, excepted to the Judge's
charge for stating that facts were proved, which
are the facts in dispute before the jury. Mr.
Brady said: I therefore except in the first place
to the whole of your Honor's charge upon these
facts, on the ground that your Honor is not n
juror; that your opinion on the fact, is of no
consequence, and that you have n., right to ex-
press it.
The Judge—And the Court respectfully differs
with counsel as to that.
Mr. Brady—l want to know whether your
Honor is a juror or not, and I appeal front your
Honor's opinion as to the fact; to which we sepa
rately object.
The Judge—That you have a right to du.
Mr. Brady--That I know I have a right to do,
:Ind I will now state in detail those separate ex
pressions or opinion no to the fact- , to which we
.eparatcly except.
I. lour Honor state- that three men armed
w.th pistols entered Statiwix Half. I except to
your Honor'' , stating that there is any such testi
mony iu this case. It i, a , 111, , ti011 of tact l'or
thi, jury whether l'audeen was armed or not.
Deati saes he saw no pistol with him.
2. Your Honor says that Baker sow Turner
after the first affray nt Stanwix Hall. We under
-tand th e evidence to be exactly the reverse
that he sought Turner before either of the af
frays at Stanwix Hall hal occurred, and we sub
mit that to the jury. I have entire confidence in
this jury, and in their recollection of the testi
mony. I have entire confidence in their com-ci
entioustiess, their integrity, and their courage,
and that they will vindicate their right and duty
to express their own opinions on the facts unin
fluenced by Court or counsel. •
3. Your Honor asks this question of the jury,
''Why did they leave the City Hotel unless it
was to renew—as Baker expressed it— the ball
which had been opened in the evening '!" I ex
cept to that.
4. Your Honor says that I'audeen locked the
door. I except to that as being a controverted
point.
FRANKLIN PIERCE
5. I except to your Honor's ruling, if it be a
ruling, that the frequenting of tippling-houses
on a Sunday morning is against the law, and I
protest against its being introduced as having
any connection whatever with this case.
Mr. Clark—lt is an ordinance—not a law.
Mr. Brady—l don't care if it was the law de
livered by an angel specially sent from God on
earth ; it has nothing to do with the question of
the guilt of this prisoner.
6. I except to your Honor's remark that that
was an unlawful and suspicious visit. I say it
was lawful—perfectly lawful.
Mr. Brady went on in the same style, enume
rating twenty-four distinct reasons for excepting
to the charge, one of which was as follows:
" Your Honor, in reference to a certain hypo
thesis of this case, suggested that it would be
a case of murder, but a very proper one for the
jury to recommend to mercy. I have conferred
with my client, and he is a man of intelligence.
He has great respect for this jury, and a great
love of life, but he authorizes me to say that if
this jury find him guilty of premeditated mur
der, he would not respect them as citizens if
they recommended him to mercy." [Sensation.]

When I closed my last letter, Mr. Banks was
increasing his vote for Speaker of the House, and
many expressed their belief of his election ; but
he could not get above 107, six votes less than
necessary to a choice, and yesterday his vote
declined to 105. All consider that he has reached
his highest figure, and that some new man or
some new combination must be propOsed before
opposition elements will be able to fuse suffici
ently to secure a majority. A great pressure
has been brought to bear upon some half dozen
men from New York, Ohio and Indiana, but they
have resisted manfully, and receive as their re
compense the unbounded abuse of the Black
Republicans. 'laving withstood the blandish
ments of Abolitionism, it is . not probable they
will succumb to its denunciations. Indeed, an
impression begins to prevail, that there is a ma
jority of conservative men in the House, and
that Black Republicanism cannot triumph under
any circumstaneest.
The little speech of Mr. Campbell, withdrawing
his name as a candidate for the Speaker's Chair,
is pregnant with suggestions respecting the vote
cast for Banks, and the means by which it has
been secured. Mr. Campbell averred that he
could not he elected without modifying his well
known views on the subject of slavery, or making
such pledges as would render him the object of
scorn among all honorable men. He had reach
ed eighty-one votes. Mr. Banks stands orrthe
same Abolition platform, and has received one
hundred and seven votes—an addition of twenty
six. It is very easy to imagine that Mr. Banks,
or his friends for him, have given assurances to
these gentlemen that their wishes in thearrange
ment of the Committees will lie .ratified, or
that some other consideration has been found
available towards accomplishing the desired end.
The present is the President -making session of
Congress, and it is not clear that the country is
a loser by the delay in the organization of the
House, or that parties cannot marshal their forces
as successfully without a speaker as with one.
The National Conventions will meet by and by,
and members of Congress usually devote them
selves with much earnestness towards directing
the selection of candidates, and after they have
been chosen, with equal earnestness to the suc
cessful opening of the presidential campaign.
