To-day I am once more within the district which, for ten years, extended to mu the' highest confidence and three tittles honored me as its repre sentative in the Congress of the United States. I was accused of no crime against the Constitution or laws, and was guilty of none. But whenever and 'wherever thus charged, upon due pro cess of law, I am now here ready to an swer before any civil court of compe tent jurisdiction, to a jury of my coun trymen, and meantime to give bail in ;toy sum which any judge or court, Stats or federal, may atlix; and you, the hundred and eighty-six thousand Dem o;•rats of Ohio, I offer as my sureties. Never for one hour have I remained in exile, because I recoil sized any obliga tion of obcclicnceto the unconstitutional and arbitrary edict. Neither did per sonal fear restrain me; and to-day I re turn of my own act and pleasure, be cause it is my constitutional and legal right to return. Only by an exertion of military power itself, against Con stitution and law, and consummated by military force, I was abducted front my home and forced into banish ment. The assertion of the President that I was arrested "because laboring with some effect to prevent the raising of troops and to encourage desertion from the army," and was responsible for nu merous culler acts of resistance to the draft and to the arrest of'deserters, caus ing "assassination, maiming and mur ider," or that at any time, in any way, I had ,lisobeyrit-or-failed.Ao obe dience to lawful authority, or ev - eii the ' , mild:ince of law, is absolutely false. No, the sole of fence then laid to my'eharge was words of criticism of the public policy of the ad ministration, addressed to an open and public political meeting of my fellow citizens of Ohio, lawfnlly and peacebly assembl ed. And to day my only "crime" is that in the way which they call treason worship I the Constitution of my fathers. But for now , more than one year, no public man has been arrest ed, and no new si.aper:-.-uppressed within .the states adhering still to the Union, for the expression' of political opinion white hundreds, in public as:iembly and through the press, have WWI at license and violence in which I never indulged, criticised and condemn ed the acts and policies of the adminis tration, and denounced the war, main taining even the propriety and necessity of the recognition of southern indepen dence. It is dead. Front the first it was against the Constitution and laws and without val idity, and all proceedings under it were and are utterly null and void and of no effect. The indignant voice of condern nationlimg since went forth from the vast majority of the people and presses of America, and from all free countries in Europe, with entire unanimity; and more recently,. too, the platform of an earnest, unammoui and most formidable convention of the sincere Republicans: Still !Urdu r, the emphalic letter of ac ceptance by the candidate of the conven tion, General John C. It is 'wither just nor fit, there fore, that the wrongs inflicted under ';'Order Thirty-eight" and the after- edicts and acts of such power, should any longer be endured—certainly not by me alone. But every ordinary means of redress has first been exhausted; yet either by the direct agency of the admin istration and its subordinates, or through its influence or intimidations in the civ il courts to meet a case which no Amer ican ever in former times conceived to be possible here, all have failed. Coun cil applied in my behalf to an unjust judge for the writ of habeas corpus. It was denied, and now the privilege of that writ is suspended by act of Con gress and executive order in every state. I appealed to the Supreme Court-of the United States, and, because Congress had never conferred jurisdiction hi behalf of a citizen tried by a tribunal unknown for such purpose to the laws, and expressly forbidden bythe Constitution, it was powerless to redress these wrongs. The time has, therefore, arrived, when it becomes me, as a citizen of Ohioniad the United States, to demand and by my owu act to vindicate the rights, liberties and privileges which I never forfeited, but of which, for so many mouths, I have been deprived. Yet the very men who control it, charge persist ently upon the members of the Demo cratic party that they have organized— especially in the northwest—the "Order of the Knights of the Golden Circle," or s&in - r—of - Vei`secret arseiety tr ie . or "disloyal" in its character, aft] is with the South, and for the purpose of :Limed resistance to the authorities of the Federal and State Governments. Whether any such ever existed, I do not know; but the charge that organiza tion of that sort, or having any such purpose, do now exist among members of that party in Ohio. or the other non-slaveholding States; is totally and positively false. The lawful political or party associations have been established, having as their object the organizing and strengthening of the Democratic party and the. success in the coming Presidential eleption, and designed as a counter movement to the so-called Union Leagues, and therefore secret in their proceedings, is very probable; and however objectionable hitherto and is ordinary times, I recognize to the ful lest extent,uot the lawlessness only, but the propriety and necessity of such or ganizations—fur "when bad men com bine, good men must associate." But they are no conspiracy against the Gov ernment; and their members are not con- - -- • spirators, but patriots; men not leagued together for the overthrow of the Constitution, or the laws, or still less, of liberty, but firmly united for the preservation, of these great objects. There is indeed, a "conspiracy," very powerful, very ancient, and I trust that before lon I - may add strongly consoli dated-also, upon sound principles, and destined yet to be "triumphant," a con spiracy known as the Demacratic party, the present object of which is to over throw the administration in November next, not by force, but through the ballot box, by the election of a President who shall be true to his oath, to liberty, and the Constitution. This is the sole con- spiracy of which I know anything; and I am proud to be one of the conspirators. If any others exist, looking to unlawful armed resistance to the federal or state authorities anywhere in the exercise of their legal and constitutional rights, I admonish all persons concerned that the act is treason, and the penalty death. But I warn also the men in power, that there is a vast multitude, a host whom they cannot number, bound together by the strangest and holiest ties to . defend by whatever means the exigencies of the times shall demand, their natural and constitutional rights as freeman, at all hazards and to the last extremity.
