Congressional vs. State Legislation
The Excitement at Trenton, N.J.—Gov
ernor Parker's Message.
The Trenton True American says
that there is great excitement at Tren
ton, growing out of what the editor calls
"..`the effort now making in Congress to
usnrp the right of this State to regu
late her own internal improvement."
Governor Parker, in his message to
,the
Legislature, invoking attention to the
subject, says:
Two inquiries naturally arise. First,
would the proposed action of Congress,
' if consummated, effect the pecuniary
interests of this State? Second and
chiefly, would such action infringe
upon the sovereignty of the State?
At an ea ny day, the State of New
Jersy, for a consideration, made a con
tract with certain companies, during a .
specified time, not to construct or au
thorize others to construct, any railroad
across the State, to be used - for the trans- .
portation of passengers or merchandise
between New York and Philadelphia,
without consent of said companies.
This privilege was granted partly as an
inducement to the investment of private
funds in what was then considered a
hazardous enterprise, and partly in con
sideration of the transfer to the State,
of a portion of their capital stock, and
the agreement annually to pay the
amount of certain duties in the State
Treasury. Whether such a con
tract was wise and calculated to advance
the public welfare, is a question net
involved in the consideration of the sub
' feet now presented. The contract, as
it stands, has been sustained by the
Courts, and whatever difference of opin
! ion may exist, as to the policy that dic
tated it, our solemn agreement cannot
r now be repudiated without the violation
of law, nor dishonor. It is for you to
inquire whether the proposed action of
Congress would affect the interest of
the State in the stock, dividends or tran
sit duties, derived from said companies.
The pecuniary interest of the State is
of little importance in comparison with
the principle involved; and I therefore
direct your attention, particularly, to the
-(iond inquiry before mentioned. New
Jersey is a sovereign State, and it is our
duty, by every lawful means, to protect
and defend her sovereignty ; and to trans
, mit, unimpaired, to posterity, all her
rights as they were received by us front
tur father.. In the exercise of her right
ful power she may build, maintain and
manage lines of public travel within her
! territory ; or she may grant to others the
right to construct such works, under such
regulations and upon such conditions as
she may see fit to impose. When the
*aces entered into the national compact
they ,y1400;1. to the Geriestattappiirs -
the right to establish roads for the eon
veyance of mails, and the power to eon
at ( - net military roads in time of war, for
the transportation of troops; but even
these roads must be operated by the Gov
ernment, and not through the agency or
for the benefit of private corporations.
A law of Congress, proposing to ex
ceed the powers granted by the States,
WI juges upon their reserved rights, and
.1, tract,: front the State Legislatures a
portion of their rightful authority. The
roads which Congress proposes to invest
with such extraordinary powers are al
ready posts routes; and the President has
been authorized, by law, to use any rail
road in the country for military purpose.
Therefore, no additional legislation is
needed to make these roads post or mili
tary routes, nor has any been asked for
by the President, the Secretary of War
or the Postmaster General

The third section of the bill declares
the object of its originators, which Is to
empower the companies therein named,
not merely to carry the mail, or convey
troops and munitions of war, but to
transport goods, wares and merchandise
of all 4,escriptions, and passengers, be
tween New York and Philadelphia, not
withstanding ana w of this State to
the contrary. Add not only is this an
thorlty to be given on the main line of
roads, but the proposition before Con
gress is, to grant the power to carry
freight and passengers on all branches
thereof, built and to be built. If such
a law be valid, the Legislature of
the State is a powerless body, and
our citizens must hereafter beg'
Congress for the privilege of eon
strncting works of public imprave
merit in our own soil. The passage of
such an act (although of no binding
source, because unconstitutibrial) would
be an insult to the people of New Jer
sey.. It would take the creatures of our
law, now under the ban of judicial in
juncion for violation of our statutes,
and, direct opposition to the decision of
our courts, attempts to make them inde
pendent of, and superior to the power
that created them. Such action de-
. - -
serves and should receive the strongest
legislative remonstrance. Let it be dis
tinctly understood, by those who would
inflict this wrong and indignity upon
our State, that while New Jersey will
comply with every legal obligation and
will respect and protect the rights of all,
h e will not permit any infringement of
her rights without resorting to every
lawful means to prevent it.
Interior View of the Confederacy.
A gentleman who left Atlanta, Ga.,
about a fortnight ago, called upon the
editor of the New York Express on Tues
day, and gave him the following insight
into the affairs of the Confederacy. He
is a Northern man by birth, and left
the Confederacy to escape the conscrip
tion. He had Leen a resident of Atlanta
for several years, and has resided there
continually during the war. He came
into our lines via Cleveland, Tennessee.
He says when he left Atlanta, there
were not many Confederate troops
there, but the hospitals were filled with
the sick and wounded. The railroads
leading from Atlanta were all in good
order, but the rolling stock, owing to
constant usage, was in need of frequent
repair. The Government foundries both
at Atlanta and Rome were running day
and night, turning out ordnance and
small arms. The mechanics and work
ingmen employed in these foundries
were mostly foreigners, and nearly all of
them are said to be skillful and expe
rienced men. There was-no lack of
provisions or other necessaries of life,
though prices were exhorbitantly high,
in consequence of the depreciated ear-.
rency, and the schemes of speculators.
An immense quantity of dry goods had'
found their way into the Ali cmfedemey
through Wilmington last fall eztdwitttqn,:
and these have been fonnd.amply suffi
cient to supply the more urgentatecessir
ties of the people. . In centraland north
en! Georgia there were several looms in
operation, turning out coarse cloth for
