In' the House of Lords, on the 26th of June, the Marquis of Clanricarje said that in asking the question of which he had given notice on this subject, he waa.. not going to dia - miecthe propriety orthe I justice of the decision of the American I Prize Courte-Lbat he thought the pro ceedings oniiiise'C'MUts should beClosely I watched,- forlif:ldeitrines were admitted there ,iikose-maintained in this count , great conftision, would be there- suit hereafter. The, principle upon Which a sentence of condemnation and snot her sentence of conditiOnal condemnation had been pronounced, differed entirely, from these- laid down by the English 'Privy Council daring the last war, It was now maintained in America that suspicion was sufficient to justify the condemnation of it vessel—that the onus of provinginhocence was Kam not merely the captain and crew, 1.);:t upon the owner of the ship.— The owner was Palled upon to prove a neg ative, and moreover, it was held that where a ship was going avowedly and con fessedly to a neutral port, a strong pre sumption arose of the intention to ran the blockade, because before the war there was no demand in the port for the goods which she carried. Now, that was a mon, stroue doctrine. There might be a market of goods to be run, or those goods might be sent legitimately by laud to the Confed erate States; but that was not ,a ground on which we ought to permit our ships to be condemned, for we bad a perfect right to establish a depot at Nassau if we choose to lo' so. It was 'necessary that not only our merchants but the officers of the'Roy al Navy should clearly understand what would suffice for the condemnation of a vessel and to constitute an n''ringemetit of belligerent rights. He h,..::." wish to press for a discussion upon the subject, now that there was a hope of in), unhappy war coming to an end, In v. h . case the confusion and irregularities arising from it might be expected to cease lie hoped that this horrible and unnecessary war was about to terminate, because it had been stated, in what appeared to be an authoritative form, that the Emperor of the French had made or renewed a propo sal to the British Government to recog nize the existing Government of the Con• federate States. That was a most import ant step, and he could not but think that' the time had come when we could not permit a continued hindering of our com• merce. He did not desire that we should interfere in any way ; but it was quite compatible with our position a 3 neutrals that we should recognize a Government which had shown itself to be capable of conducting its affairs at home and abroad, and of performing all the functions of a Government. If England and France, and he might add Spain, were to recognize that Government, he had no doubt that a speedy termination would be put to this war. He would 'aelc'the noble Earl wheth er any proposition had been received from 'the Government of France, and also whether any copy of the judgment deliv ered by the American Prize Courts had been received, and whether the proceed ings of these Courts were being watched. Earl Russell—l will first answer the question of my noble friend whether any report of proceedings of the prize courts of the United States, especially with ref erence to the case f the Dolphin, has been received at the foreign office. In answer to that question I have to state that what appears to be an authentic re port of the judgement iu the case of the Dolphin was received at the foreign office last evening. I should think it right, cer tainly, that all these cases should be watch ed; ' I find the doctrines relied upon in that judgment are those laid down by Sir W. Grant: and Lord Stowell. Whether these doctrines are :rightfully applied to the circumstances of this particular case is another question, and one upon which I offer no opinion. I shall not re-enter a discussion which we had upon a but I still think that the goon international law by not in accordance - upon the sub -^- whether •-• the former e opinions hela my noble friend a with the high anthoritien ject. As to the second questiu-, any communication has been made government of this country by the Gov eminent of the Emperor of the French, proposing or suggesting a recognition of the Southern States, I have to say that no such communication has been received,- Upon the general subject of recognition, ' do not think the circumstances are much altered smce . my noble friend Lord Strath heden brought forward his motion in this House, and I entertain the same opinions which I then expressed.
