➢lore Prosecution for Nuisance.
It will be remembered that some days
ago Mr. Ralph Lawyer entered suit against
lorrence & McGarr fora violation:of the
- city ordinance against nuisances in erecting
a bow window on Fourth et. According to
the construction put upon the ordinance
by Mayor Sawyer, the window was an ob.
struation, and therefore came under the
ordinance, an 4 he ordered it to be abated.
We believe an appeal has beer, taken in
this case. Yesterday Mr. Lawler again
complained to the Mayor of a post on the
corner of Fourth and Market streets,erect•
ed by Messrs. Torrence tt: McGarr for the
purpose of using it as an awning met, and
a post for a mortar sign, and they were
summoned to appear before His Honor on
Monday next to answer. This is a ques•
lion that is of considerable interest to
may - of our merchants and others. On
Market Area from Third to Fifth street,
there are no l- - ss than thirty one bow win
dows, and on Fifth street from Market to
Wood street there are eighteen. - These
form bat a small proportion cf the bow
windows in the city. Now, if Messrs.
Torrence & McGarr are to remove their
bow window and awning post, it follows
that all oth srs must do the same thing as
soon. as some one shall take interest
enough in the matter to enter a complaint,
and looking at it in that light, we do not I
see but that the city can be compelled to
remove lamp posts that occupy the con
nen of the streets. But does - not a strict
construction of the ordinance make it ne
cessary that the object complained of
shall be an obstruction to be a nuisance,
and what if a large number witnesses swear
that they err no obstruction, but
rst'aer an ornament, and that of dark
nights they are of absolute benefit on ac
count of the light they give ? We think
that a delicate question arises here. A
number of men say that bow windows are
both user' and ornamental. One man
for some reason best known to himself
says they area nuisance, and he takes
upon himself there spousibility of becoming
prosecutor. We shall not call into ques
tion Mr. Lawyer's motives for this prose"'
cation, but we hope that in order that the
matter may be thoroughly tested, and
forever Wet rest,that it will be taken into
a higher coo t, and there disposed of.
Since writing the above we are informed
that lamp posts at the street corners can
not be abated as nuisances, for the reason
thafthey were placed thereby special ordi.
nance, or in other words, nothing can be
a nuisance that receives the sanction of
the City Cohncils. If a lamp or awning
post erected by a private citizen be ft nui
sauce, then assuredly it would be the
same if it received the sanction of the high
est court in the land. Crack your whips
gentlemen and let us Bee which way the
wind blows.
Accident.
An accident occurred on Saturday Ey
which Mr. John W. Patterson, Court cri
er, came very near losing his life. As he
was standing at the foot of the inclined
plane at the coal works in South Pitts•
burgh, he was startled by hearing a loud
scream, and at the same moment he re
ceived a push from the " hitcher"just in
time to avoid being struck by the first of
the two cars ,which had got loose, and
were desceudink , the plane at almost light
ning speed. As it was they struck a pony
that was need at the pit, in the abate,
which being knocked some disteuee into
the air was instantly killed. The check
man, Mr. George Fisher, who was the
CUM of the accident, fearing that some
one was killed partially lost his senses for
a time. The scream which first alarmed
Mr. Patterson came from him.
Select Council.
The members of the Select Council met
last night pursuant to adjournment, and
after the usual preliminaries, the ordi
nance granting to the Pittsburgh and
Steubenville Railroad certain pnvileges
was taken up, and considered section by
section. A number of amendments were
made, after which it passed. The ordi
nance of itself is very lengthy, and a note
of the amendments would scarcely be un
derstood unless the reader had the entire
ordinance before him. It will be pub•
lished in a few days, together with the
amendments, provided the company see
fit to comply with its provisions, in which
case those interested will have an opportu
nity of reading it.
The Old Canal,
On Monday night a resolutiork was offer
ee, requiring the removal of the two canal
boats in the old ditch between the river
and Liberty street, and to fill up said
ditch. This nld portion of the canal is
at present in a deplorable state, it having
a lot of filthy green, stagnated water in it,
which later in the season will create mias
ma, that will make the neighborhood very
unhealthy. This is a matter that should
be immediately attended to, and we doubt
not bat that if the attention of the Board
of Health is called to it, it will be abated
in some manner or other. We think that
a drain cut to the river would keep' it
dear Of such accumulations as are offen
sive, and detrimental to health.
Robbery.
Our city is at present infested with pro•
fessional thieve, burglars, incendiaries
and•members of the light fingered frater
nity generally. Night before last the to
bacco establishment of Mr. Megraw, on
St. Clair street, was entered and about
$l,OOO worth of tobacco and segars taken.
The thieves entered by•the vault hole on
the side walk, and the robbery was not
suspected until yesterday morning.
Where is the School Master.
"The following order was left upon the
slate of Messrs. Lupton & Oldden, en•
gaged in putting gravel roof on houses in
this city. We give it verbatim as a litera•

the Circus, and then the side shows, con
taining everything in the world, and more

nightly crowds. Then - there are concerts
and fairs, and horse racing out of town,
and sparring exhibitions in town, and bil
liard rooms, and Hunt's, Miner's and Pit
took's, where you can get all the late
news, and more too, and the City Council
two nights this week, and in fact fun at
every corner. Who says Pittsburghisnt
fast place?

There not being a quorum present las
night, this body adjourned to await a cal
from the President for another meeting.
Query.
In case the Councils prohibit the land
ing of crude oil in barrels, or the storage
of M. T. oil barrels within the city limits,
what will the oil dealers do for operations
to ship their bit East and West, and how
will they manage to get the aforesaid M
T. oil barrels back to the well? And furth
er if the A. V. R. R , P., Ft. W. and C.,
or the C. and P. R. bring oil into the city
for the purpose of sending it East over the
P. C. R. R., will that not constitute a
landing of oil within the city limits? And
further, do not the members of the Coun
cils find oil a very slippery matter, and do
they think they have bettered matters by
their extensive legislation upon the sub
ject? What a pity it is that a few barrels
of oil could not have been found in the fire
of Sunday night, so that its origin might
have been traced to some dJfiuite s onrce.

Circus.
The circus is still on hand, and will this
afternoon give an exhibition joy ladies
and children. In the days of the old Ito•
man Emperors the circus was considered
one of the most prominent institutions,
and shall we be behind the degenerate
Romans I Jet the cry be no longer "on
ward to Richmond" but shout in thunder
tones "onward to the circus." Richard
shouted vociferously for a horse, and of
fered all his landed estates fora horse or a
mare, he was' nt particular which, but it is
very evident that he had not seen Dr.
Thaycr's two mules when he wade the of
fer.

WAsniNcroN, May 2G.—Acting Rear
Admiral Porter, ins dispatch to the Navy
Department, from Yazofl River under
date of the 15th, states : A few days since
the Mound City, Lieut. Commander Byron
Wilson, came up as far as Warrenton to
reconnoitre and to see what guns were
there, likely to annoy our troopa. The
rebels have been engaged for some months
in building a strong casemated water bat
tery, intended to mount 8 ten inch guns
on it. This work was built with cotton
bales covered with logs, the logs covered
with railroad iron and the whole covered
with earth. On approaching the Forts,
Lieut. Commander Wilson sent a party on
shore to reconnoitre. On coming up to
the casemate to look in, the party discov
ered that a company of artillerists had
taken refuge there. Supposing themselve s
perfectly secure our men fired their re
volvers into the crowd and warned the
vessel that the rebels were about.
Lietit. Commanding Wilson then com
menced shelling the fort, and in a short
time it was all in a blaze. After burning
thoroughly for some time the whole work
Was destroyed. Thus ended a fort is the
spade of an hour which had taken the reb
els 5 months to build, working day and night.
I proceeded to Warrenton this morning
to be certain that the work was thorough
ly destroyed. It required nothing more to
be done to it. The Mound City had fin
ished it.
The rebels set fire to all their houses
containing their stores as the gunboats ap
proached, and what they left I ordered to
be destroyed.
'Warrenton has been a troublesome place
and long merited its fate.
WestutvoToY, May 26.—The President,
Secretary of War, Assistant Secretary o
the Navy, the General-in-Chief of the
Army And General Hooker, were in coup•
cil several hours today at the Executive
Manion.
It i. understood that a dis-atch was re
-1 ceired to-day which states another line o
th.f. , nces has been discovered in the rear
or Vicksburg, which it would be necessary
to take by storm.
It iz reported and laei:eved that Stuart
had seat about one hundred men to rein
force Mosby, to the end of continuing the
lettere depredations around our lines.
The impression prevails around Rappa
hannock Station that Stuart is corcentra
ting 8 large billy of his cavalry between
Culpepper Court Bowie and Brandy Sta
tion.
The Richmond Whig of the 23.1 contains
a letter from Jackson dated the MIL,
which says it is reported in Mobile that
Snyder's &clff has been reoccupied and
that the report of the occupation of
Yazoo city is disbelieved.
A special di3patch to the Mobile Adver
tiser dated the 2.ti says the latest from
Vicksburg i 4 to Thursday night. Oar loss
is alight. The injuries to the batteries is
trifling. The g• - triiaon is well supplied
and confident of holding the place.
Firing was heard at interv.llc last night
and to-day. The enemy is supposed to be
shelling ,
The enen-y are reported to be at Pon- -
chatoule bringing, the trains up that far
from New Orleans.
WASHINGTON, May 26.—Up to ten 'o'-
clock to night no later intelligence from
Vicksburg than that communicated to the
Public to-day had been received by the
President.,
It is not believed that Grant himself
has recently sent any telegrams to the
government respecting his movements.
WASIIINGT3N, May 26.—A special dis
patch to the Poet from Washington aays :
Some 600 officers and privates arrived at
Annapolis yesterday from Richmond.—
They report that Capt. McKee, of the
I4th Kentucky cavalry, and Lieut. Conn,
of the 13t Virginia cavalry, will be hang
by the rebels in retaliation for the execu
tion of two spies by Gen. Burnside.
This information is known to be trust
worthy.
Mr. Holborn, the correspondent of th 3
New York World, was released on condi.

tations to our government regarding the
measures of retaliation about to be adopt
ed by the rebels.

The Tribine correspondents, Messrs.
_Richardson and Brown, are retained in
Libby prison.
PHILADELPHIA, May 26 —Jay Cook;
G eneral Subscription agent, reports the
sale of $2,929,000 Ewe -twenties to-day at
the various agencies throughout the coun
try; principally New York, Boston,Phila
delphia and Cincinnati. This is the larg
est amount that has yet been subscribed
in a single day.
CI N I NNATI, May 2G.—The Eagle Plain,
log mill corner of Freeman and Flint st.-

stroyed by fire at noon to•day. Loss
twenty-five thousand dollars. Insurance
three thousand dollars.
There is no truth in the report that
Burnside has been asked to be relieved of
the command of the department of Ohio.
Sergeant Sarguit in passing through Green
county tinder orders of the Provost Mar.
shal was fired upon by an unknown per
son. A squad of cavalry was sent in the
neighborhood. Six persons were arrest•
ad to be held as hostages till the perpetra.

NEW Youx May 26.—A. special dispatch
to the Post from Washington says:
It -is understood that the government
has received an official dispatch from Gen.
Grant, dated the 22d, cosfirming all the
previous accounts of the successes of our
troops, and speaking of the capture of
Vicksburg ascertain. 9.
It is reported than the rebel pickets on
the Rappahannock yesterday admitted
that Vicksburg had been captured.
NEW YORK May 26.—There is reason
to believe that `the enrollment act will be
carried out according to the letter of the
law.

Friday evening last at Altaic Hall. It

Utica. N. Y., May 26.—The Loyal
League Convention ,assembled this after
noon. • The Committees were appointed
and the Convention permanently organ
ized by the choice of General John Coch•
ran as President, and a large number of,
Vice Presidents and Se,retaries. A State
Central. Committee of sixteen was ap
pointed. The Commit.es on resolutions,
reported a series. The first four reeolu• '
tions were adopted denouncing party
organizations in time of War, and re•
commending the establishment of Loyal
Leagues to support the Government,
characterizing the rebellion as aimed at
the overthrow of republican institutions
and pledging the people to agree to a
peace as soon as the authority of the na•
Lionel Government is restored.
The fifth resolution recognized the ex
istence of powers in the Government in
cident to a state of war to be exercised
when necessary for the preservation of the
National existence, and whenever the exi•
geneies of the country compel the abridge
ment of the freedom of speech, or of the
press, or the suspension of the habeas
corpus. The greatest care should be ex
ercised against establishing dangerous
precedents. This gave Ilse to considera
ble debate, in the course of which the
arrest of Vallandigham seemed to be ap•
proved by the sentiment of the Conven
tion. The Convection recommitted the
resolution and a recess was taken til'
seven o'clock. .
EVENING SESSION
At the evening session a resolution was
proposed in place of the fifth resolution,
reported in the afternoon, approving, of
the utmost
those in the North aiding our enemies.
That leading traitors in the North should be
promptly arrested, •promptly tried and
proniptly punished, and no outcry, how•
ever insolent or virulent, should be allow•
ed to deter any officer, civil or mili
tary, from the meafiuree essential to the
safety of the country; also expressing as
the conviction of the majority of the loyal
people that whenecer necessity compelled
the suspension of the habeas corpus great
care should be exercised least an example
be set which may induce in the future the
violation of our rights
After two hours debate this resolution
together with others were adopted.
