Muchbas been made—besides'the loss
of liberty to David Heasley, of Weatmore,
land conaty,,and James Riddle, of Mci
Keesport, and loss to their parents, by
r.
the failure of their suits, of the custody of
their children and the costs of the writs—
out of the decision of the late Judge
Ritchie in the case of the former, which I
will state with exactness. The decision
was a virtual de/drilla the parents of a
hearing on their writs.

I give, in its very 'words, the return . :t o
the writ in Heasley's case :
"NO. 267, inc. 1, 1862.

"And now, Nov.ll 28th, 1862, Robert
Pollock makes return to this writ that the,
body' of David 'Heasley was not in hili
poasession at date of issuing this writ, nor
at any time since.
ROBERT POLLOCK, Captain.
"And now, to wit, N0v..,28th, Captain'
E. S. Wright, Provost Marshall at Pitta•:
burgh appears voluntarily and makes re•
turn to. this writthat he has the body of
David Heasley present in Court, who is
in custody of Captain E. 8. Wright, as a
deserter or straggler.. ' - •

:reading the return of Capt. Wright, Judge
Ritchie,i addreising the counsel for the re
llator, said, "Why, Mr. Smith, the Presi
ident's preelentation suspends the writ of
Oahe= corpus in thede cases." ca ptain
Wright was 'worn to his return, and, be
ig interretaelf, he said he "had no
, nowledge of any charges having , been

be in due time." On proceeding to

line of his duty to. Court and client, that
there was no "warrant Of commitment or
detainer" shown, counsel , was reminded

rided?' Thus, with a 'heavy' heart, he
had to stand and take the new doctrine,
that "it seemeth to me (un is the
old) reasonable to send a prisoner
and not withal to signify the cr i mes " laid
against him." The de cision and order,
hough signed byJudge Adams, was Judge
itchie , a. The words,nrit "as .a deserter
.Trr e fr itggler;" Were iiiierted at the instance
of Relator'a counsel after the order was
read from the bench, as the whole decision
had been made to turn on them and the
oath of Capt. Wright. I can scarcely for
bear to criticise that portion of the order

It was admitted in Riddle's case, heard by
Jddge Aden:m.4lone, 4 -that the' writ hid
been served on Captain Wright in shawl
antlyaufficient time tohaveenahled him to
htive recalled him from the Railroad car
depot?.:; and afford the relator his hearing.
Itiljustice to Captain -Wright, however, he
explained on oath that ininilitary phrase,

Major or Bailey, and so was in the
Major's custody when the; writ was . seri

untarily," yet it is susceptible of proof

serted the writs, (I think in both cases)
that, Captain Wright remerked,• not that
Riddle had Passed out of his custody--but
.that., according,to the ,decision of Judge
Rittlue, in Heasley's case he "had seat

also. But straggling is among the minor,

The Richmond Enquirer says:
