The Wit case is one of importance, as several others depend uponi the issue, and ,the be awaited with interest. The city brought suit for the recovery of $33.30, alleged to be due, by Mr. Woods, , being the laniount assessed upon his prop erty for the construction of a sewer on I Cherry alley. The defendant held that his propeKty was not benefitted by the lsewer andvdrefused to pay, when suit was brought against him as stated. The jury found for the defendant, whereupon an ap peal was taken to the Supreme Court, on the grounit'that the Court below erred in admitting Ale defendant's testimony that his property was not benefitted by the sewer. ,11 The Fire Department -- Six Steamers to be the Limit. The Chr'pnicle states that the special committee o f Councils appointed to report on the lcicittion of steamers, have, after several meetings, agreed on a report, to be submitted to Councils on Monday evening next, whichwill limit the number of steam ers to six, rikommend, by implication the removal of the "Allegheny" to a point on Centre Aveilue, Sixth Ward, and also the removal oflthe "Vigilant" to some point on Pennsyllania avenue, as soon as the City has the requisite means to make the. transfe4 The committee base their action on actual experiments, by which they ascertained that the Niagara can run to the city likitit in the Ninth' Ward in four and a half teS, the Neptune in seven and a half I thinntes and the Vigilant in eleven minutes forty seconds, from which they argue that no engine is required for the SevenMEighth and Ninth Wards.— We await with some anxiety the action of the Councils on this subject, as it will give rise to stormy' discussion, Aelive Pleasures. Surgeons in ;the army complain that neuralgia in the: head, with which so many of our soldiers are afflicted in the cold weather, is cansad by the want of proper protection from the snow, sleet, and winds. More gaiety and more gravity have been exercised _ photograph albums than `over aniotlier pieces of compilation. They are either portraits or parodies of allothe "beauties; harmonies, and sublimi • ties, of (human) nature." A great many very bad jokes have been cracked over them, and a few rather good ones. A be witching little wife and an old satyr of a husband have been characterized as a new version of Beauty and the Beast—a weak • husband and a Jezebel wife, as St. George and the dragon. Sedate clergymen, with very black gloves and very white neck ties sedate'matrons, pluming themselves on their pluinpness, and engaging in their embonpoint; green, skinny school girls, with sickly-looking eyes and short dresses; middle-egad men about town, excessively polite and exceedingly profane; heads of families, looking as though they were be ing asked for money arid were trying to get out of it, actors in attitude, and dancers twirling on their toe-tips--all these, and a hundred others which cannot be illustrated• in a local, congregate to gether in a photograph album. Some look as if they were visited with strokes of genius; others with strokes of apoplexy; others as if they should be pick ing rags; and others, again, as if their proper vocation was picking pockets. A few faces may be called beautiful. Women have often been called angels, and we pre sume it is for this reason lovers always prefer their sweethearts as represented among the clouds. Babies are bad enough in real life, (mothers please pass over this portion) but in albums they bloom with a meek, sleepy kind of infantile horror, which is not preferable= to their natural gifts of mind and person. However, as we are always in for fashion, so with re spect to this fashion we cry with the crowd, vine the photographic albumi, Two Prisoners 'Escape from the Sum etime between three and five o'clock yesterday morning, two of the parties con fined in the tombs for the robbery of Mt fenbacher's shoe store, succeed in effecting their escape, viz : Michael Tanner and James Tart. They were confined in the same cell, and from appearances and the storymf, their accomplice, Rufus Connor, (who, although he was in the next cell, they basely left behind to his fate) forced the lock of their cell with 'a poker, and climbed out of a window into the yard, from which egress was comparatively easy. It is asserted that the parties were assisted in their escape by outsiders, who got into the tombs by the windows opening into the yard. A painful air of mystery sir rounds the whole affair. Theatrical. A good bill isoffered at the Theatre for this.evening, embracing three pieces, with singing and dancing. Mr. Ilerideraon.ap : pears as Rolla, in the tragedy.of "Pizarro.' As he has not played recently this should draw, out a good audience. The Varieties. The reputation of this popular place of amusement is kept up by a continued Suc cession of novelties. A rare bill of at- traction is offered for this evening and all raw attend will get double the worth of their money. Get a programme and see for yourselves. Railroad Companies to add the Tat. The Secretary of War has decided that, tinder the tax law, Railroad ; Companies have a right to add three per cent, to their charges for transportation of passengers, under their agreement with the War De partment, thus increasing the rate 'from two cents to 2 6 100 cents per mile. Quar termaster Gen. lefeigs has issued a circu lar embodying this decision, and direct ing that all accounts for the transportation of troops,:since September Ist, shall be set-= tied accordingly. Robbery in Upper St. Clair Tp. On Wednesday night the room of Thos. McMillan, a respected and aged resident of Upper St. Clair township, was entered and $171,50 in gold, silver and bills and a promissory note for $9OO taken from a chest which he used for their safe keeping. Robert Rankin, a returned soldier, and Cyrus Pryor, a lad, in the employ of Mr. McM., both slept in thesame bed 'in the house. In the morning Rankin was gone and the boy was arrested on suspicion and committed to jail by Justice Aiken. There is, however, nothing to implicate him in the robbery. Regulars Arrived. Lieut. Reese E. Fleeson, of the Regular Army, arrived in the city yesterday morn ing from Fort Wise; in command of a de tachment of regulars, who have been or dered to Washington. Not All. 'Mr. Diffenbacher informs us that all the goods stolen from his establishment were not recovered—only seven or eight pairs, found in the possession of the women re ferred to. Resignations. It is stated that Col. R. Biddle Roberts, of the Ist Pennsylvania Reserves, has re signed his position on account of ill health. Lieut. Eb. Williams, Quartermaster of the 101st Regiment, has resigned on account of ill health, being unable to stand the fa tigue and exposure of campaigning. Awaiting Shipment. At least one thousand car loads of live stock have accummulatad in Allegheny city, awaiting shipment East over the Pennsylvania Railroad. The detention grows out of the fact that government freight takes precedence of all other busi ness. Corn Bread • Mix at night a quart of corn meal with water enough to make a thin batter, add ing. a table-spoonful of yeast, and salt to snit the taste. In the morning, stir in two eggs and a small tea-spoonful of soda, and with a spoon beat it long and hard.. But ter a tin pan, pour the mixture into it, and bake it immeniately about half an heur in a moderately heated oven. • Gen. Negley Complimented. Gen. Rosecrans, in a dispatch forwarded to Gen. Negley, after the late repulse of the enemy before Nashville, pays him the following handsome compliment: " Your ,dispatch of the Gth inst., regarding . your handsome affair of the same date, is re ceived with great satisfaction. Pocket Picked. Mr. Tames McMaster, of the Sixth Ward, was robbed of his pocket book, containing $125, at the Pennsylvania Railroad depot on Thursday evening. He has no clue to the thief. Stragglers and Deserters. Loris, Nov. 21.—Advices have been received that the enemy in the Sout hwest had advanced, fifteen thousand strong, from Boston Mountain to Cave Hill, apparently intending to give battle to our forces under general Blunt. On learning that the enemy was at Cave Hill, Blunt made preparations to move upon him, but he soon found, as if apprised of his movements; that the rebels bad hnr riedly withdrawn and again retired to the mountains. This is all the intelligence al present received relative to this move men` prrrentrßou. INDIA RU always clean and General Schofield has received tempo rary leave of absence from his command an account of sickness, and is now on his w,ai to St. Louis. Brig. Gen. Gorman hafAbeen instructed to report for orders to General Curtis and will shortly arrive here. WasiliNurok, Nov. 21.—The steamer Blackstone has been chartered by the llovernment and will convey vessels to the squadrons of Rear Admirals Lardner, Dupont and Wilkes, leaving New York on the sth inst. Acting Master Smith has been ordered to that vessel to take charge of the naval stores and attend to their de livery at the points at which her Captain will be instructed to stop. Commissioner of Indian Affairs Dole, to-day received a letter from Assistant Secretary of Interior Usher, dated St. Paul, in which he says there is no prospect whatever of difficulties with the Chippewa Indians as was some time ago apprehend ed. The head chief of that tribe says they have no complaint and have enough to eat and are contented and happy. Advices from the Army of the Potomac say the rebels still occupy Fredericksburg, with a small force tn dispute the crossing of the river. Some guns were brought to bear upon one or two ravines on the op posite side of the river, through which the railroad passes. The result is that no trains have attempted to run since. The weather is very disagreeable, it having rained heavily all yesterday afternoon, swelling the streams to an unusual height. There is no news from the enemy. Nashville, Nov a 20.—Special to N. Y. Tribune.—The expedition of two regiments of infantry, under Col. Cardin, which has been scouring the country between here and Clarksville, has returned, having cap tured forty-three rebels, eighteen horses, twenty mules and one hundred muskets. Another flagof truce, with rebel ladies for the South, will leave here to morrow. A scout has justarrived from Knoxville, which place he left on- the 13th. There were no troops there except the sick and Convalescents. lie understood that the rebel troops had gone West. At McMinnville there was a considerable force of conscripts from the adjoining counties. At. Sparta theit was a small force of the rebels. Fie saw no other rebel troops ex cept at Kingston, where there are a few. Gen. Rosecratts has ordered the release of three thousand bales of cotton, which were seized for the purpose of using them for breastworks in this vicinity recently.— They will be shipped North as soon as the railway is open. The enemy still evince a dispositon to fight at Tallahoma. Gen. In the meantime his communication was conveyed to Gen. Longstreet, whose troops were encamped a short distance outside of the cqy. As the demand was made upon the civil authorities the Mayor sent an answer which was evidently written at the dictation of Gen. Longstreet to effect that the complaints enumerated should be remedied so far as firing on our pickets' and furnishing supplies and material to the Confederate army was concerned. Also, that the rebels would dispute the occu pancy of the city by the Government for ces. He complained of the short space of time allowed for the removing of the women, children and sick soldiers. The giving of any more time as requested, is now under consideration. Permission has been given the citizens to run one train from the city, but only for the conveying of women and children. The news received to-day from .Jackson shows that he had rented a house in Win chester for his family. His troops are in front of the city with a regiment of cavalry at Martinsburg. a,, Bridal. The flag-of truce steamboat Metamora arrived at Fortress Monroe this morning from City Point, but she had no passen gers. Four hundred Union prisoners will ar nye at City Point to-morrow.: While the Metamora was at City Point her officers and crew were not allowed to step ashore; neither was any communica tion, except official, offered them. The rebel officer-4 were not communicative or even social as has generally been the case heretofore. NEW Yoiu Nov. 21.—A letter from Headquarters at Newbern, N. C., states that I , oster's recent expedition flanked the rebels at Hamilton. They only escap ed by a hasty flight. Three miles of forti fications erected at that place were de stroyed. Two more companies of volunteers have been raised on Hatteras Banks. JetT. Davis is said to be at variance with Vance and seriously debating the aban donment of North Carolina as a dead weight to the tale's. In consequence of complaints relative to insuf f icient quarters being provided for the troops arriving in this city as alleged through the inattention on the part of the officials. A visit was paid at B) o'clock to-night by Major General Banks Coy. Morgan and Col. Howe, to the Park Bar racks, when almost through and search ing investigation was personally made, re sulting in a complete refutation of Snell charges. The quarters were found amply well ventilated and clean and the food ex cellent. The men themselves declarine their wants supplied to a sufficiency. CAIRO, Nov. 21.—Passengers from La Grange report that the main body of our army is still there. -No portion of the troops except detachments of cavalry have advanced as far as Holly Springs, and they had returned. l he railroad bridge, three miles south or Lagrange, which was burned by the rebels, was beingi rapidly rebuilt. The Memphis Bulletin. of the 18th, says that Gen. Bragg arrived at Holly Springs last Saturday, with 15;000 troops.
