The modern usage of nations, which has become law, would be violated if private property should be generally confiscated and private rights annulled. (U. S. vs. Percheinan. 7 Peters, 51 ; 3 Philleinorg, p. 743.) When States were reduced to rerritories the National Government could not abolish slavery therein, except under the right of eminentdomain, and by giving, just compensation. The rebel States are still members of the Union, foregoing for a time its privilege, but subject to its du ties, bound to it, by a cord which the sword of successful revolution can alone sever. What, then, it may be asked, is the legal character of this great insurrection? Ihe answer is, it is a rebellion of citizens of the United States against the Government of the United States ; an organized effort to subvert and overthrow its authority, and to establish another Government in its stead. He only is the enemy of the United States committing treason by levying war against the United States or giving aid and comfort to those who do.. The loyal, faith fid subject of the United States, wherever on the soil of his country be may have his home, is not the enemy of his country. No subtlety of logic, no ingenuity of legal construction, no misapplication of the laws of international war to this contest can change the nature of things, can convert loyalty into treason, or devotion into hos tility. If there he to-day in Tennessee, or Georgia, or South Carolina, even, a loyal subject of the United:States. "faithful among the faithless found," the Govern ment is not at war with him. While using the powers and appliances of war for the purpose of subduing the rebellion we are by no means acting within the pale of the Constitution. We are seeking domestic tranquility by the sword the Constitution has placed in our hands. In the path of war, as of peace, the Constitution is our guide and our light—the cloud by (lay the pillar of fire by night. The recognition of the "belligerent rights" of the rebels by foreign powers can, as between the sovereign and his subjects, have no other or further effect. Such recognition (if known to the law of nations) proceeds upon -the ground that the revolution is not accomplished, and that the connection is not dissolved. Had this been done, the recognition would have been of their sep arate national existence. In my humble judgment the "seceded States," so-called, and the people of those States are to-day integral parts of ttie Constitution of the United States, and the laws under it, will resume their peaceful sway. Traitors may perish, some institutions may perish, the nation will remain and the States will re main essential parts of the body politic. I "The body is one, and hath many mem bers, and all the members of that body, being many, are one body." With this brief and imperfect development of the principles involved in this great contro versy, I proceed to a more direct consid eration of the subjects of confiscation and emancipation. I No purpose, however humane, benifi rent, or attractive, can divert our steps from the plain straight path of sworn duty. What is writ is writ. In seeking to change it by force of arms, we become the rebels we are striving to subdue. The people do not desire a bitter and remorseful struggle over the dead body of the Constitation.— We may raise armies and navies, and pour out as water the treasure and life blood of the people, but we can neither think nor act wisely, live well or die well for the re public unless we keep clearly and always in view the end of all our labors and sacri fices, the Union of our fathers and the Con stitution, which is its only bond. No thoughtful man can believe there is a pos. sibility of reconstructing the Union on any basis, or that it is within the province of Congress in any other but the peaceful way of amendment, to make the effort. The propositions for confiscation include the entire property of the rebels, real arid per sonal, for life and in fee. The mind in stinctively shrinks - from a proposition like this. It relucts to include in one "fell swoop" a whole people. It asks anxious ly if no consideration is to be had for dif ferent degrees of guilt; if the same meas ure is to he meted to those who have been forced into it; if no consideration is to be given to the fact that allegiance and pro tection are reciprocal duties, and that for '•lte past ten months the national govern ' hag found itself incapable of giving mei " -- se to its leyal subjects in the "se eded ctib. neither defending theta ceded State :, or giving them a *us to defend themselves, n. r and and that, deprived of our ..heyprotection have yielded incapable of resistance, t only to superior force; if a the govern ment is to forget the nature of 1,.." an the influences of birth, of, soil, of hold" society, and of State, by which his opinions are insensibly moulded, and that this pes tilent heresy of secession, fatal as it is now seen to be, not only the existence of good government, but of social order itself, has been a cardinal article in the faith- of a large portion of the Southern States, and that they have been induced by the arts, and:sophistries, and falsehoods of unprin cipled leaders to believe that their future safety and well-being required the exer cise of the rights 4 Those leaders should atone for their crime by the just penalty of the law. "But you cannot," says Burke, "indict the whole of the people; you can not apply to them the ordinary rules of Criminal jurisprudence." To state • the proposition to confiscate the property of eleven States is to confute it; is to shock our common sense and sense of justice, is to forget not only the ties of history and of kindred,. but those of a common humanity is to excite the indignation of the civilized world, and to invoke the interposition of all Christian Governments. The act of general confiscation would defeat the great end the government has in view—the restoration of order, union and obedience to law. " The following wonderful story is told by the London correspondent of the Dublin Evening Mail : "This is the age of discoveries, and one of such a startling nature has just been made in an English county that it seems out of place in the region of sober fact, and to belong purely to the at mosphere of the three-volume novel. Here are the circumstances—the names for the moment I am not at liberty to in dicate : The Earl of married not long ago, and brought his bride home to one of the old family mansions which members of the English aristocracy re gard with affection amounting to venera tion. The lady, however, being more con ' tinental in her tastes, after a short resi dence in the apartments appropriated to her use, expressed a wish to have a buodoir in the vicinity of her bedroom. The noble Earl would gladly have com plied with the request, but, upon examina tion, it . was found that the rooms, as sometimes happens in antique buildings, were so akwardly distributed that upon no conceivable plan of re -arrangement could the desired buodoir be fitted in. Thereup on it became necessary to invoke profession al assistance, and an eminent artist was summoned from London. He examined the house narrowly, and said there seem ed to be nothing for it but to build, though at the same time he could not re sist the impression that there must be an other undiscovered room in that wing of the mansion. The noble Earl laughed at the idea ; the oldest servants and retainers of the family were questioned, and de clared that they never heard even a rumor of its existence. The ordinary methods of tapping, ite., were resorted to, without effect. Still, the architect retained his conviction and declared himself ready to stake his professional reputation .on the result. The Earl at hist consented to let the walls be bored, and when the opening had been made, not only was the room found, but a sight presented itself which almost defeats attempts at description. The apartment was fitted up in the rich est and most luxurious style of one hun dred and fifty years ago. A quantity of lady's apparel lay about the room, jewels were scattered on the dressing-table, and but for the faded aspect everything wore, the chamber might have been tenanted half an hour previously. On approaching the bed, the most curious sight of all was seen, and this it is which affords the only clue to the mystery. 'l'he couch held the skeleton of a female, and on the floor, un derneath the bed, half in and half out, lay another skeleton, that of a man, present ing evident traces of violeuco, and proving that before he expired in that position, he must have received some terrible injury. The secret connected with this tale of blood has been well kept, for not merely had all tradition of the scene faded away, but even the existence of the room itself was forgotten.
