the course of which he said.

of the principles of the Constitution and
the just'and logical application of them to
this new condition of thinp. It is by i no
narrow and rigid construction of thevords
of the Constitution that the powers and
duties of Congress On these subjects are to
be ascertained. Every provision must be
carefully construed, in view of the great ob
"ects the Constitution was ordained to ef-

feet, and with the full recognition of the
powers resulting from clear implication,
as well as express grant. In my humble
judglnent there has been and is now hut
one issue before the country, and that is,
whether the Constitution of the United
States shall be the supreme law of the land.
That Constitution was formed by the peo-
ple of the United States. It acts not upon
the States, nor through the States upon us
ati citizens of the several States, but di
rectly upon us as citizens of the United
States, claiming on the one hand our alle
giance, and giving to us on the other its
protection. The doctrines as to the • su
premacy of the National Government with
in its sphere, and of the reserved rights of
the States, are elementary. Between them
there is no necessary conflict. Each is
the complement of the other; lit th vital
parts of the political system under whose
admirable distribution and adjustment of
powers the people of the United States
have had for seventy years incomparably
the best and most benificent government
the world has ever known; a government
now imperilled, not by reason of any in
herent defect or any want of wisdom or
foresight in "its founders: not because we
bare outgrown its provisions; not because
it is'behiud the age, but because it has fal
len upon an age not worthy of it, which
has faded to appreciate the spirit of wis
dom, prudence and moderation in which
it was founded. Such being the relation
of the government of the United States to
its citizens and to the States, the first ques
tion that arises is how far this relation is
affected by the fact that several of the
States have assumed, by ordinance of se
cession (so-called) to separate themselves
from the Union? There is not n clause or
word in the Constitution which looks to
separation. It has careful provisions for
its amendment, none for its destruction:
capacity for expansion, none for contrac
tion: a door for new States to come in,
none'for old or new ones to go out. An
ordinance of secession has no legal mean
ing or force, is wholly inoperative and
Void. The onstitution, and the laws and
treaties 'made under it, the people have de
' Oared " shall be the supreme law of the
bind, and the judges in every State shall
be bound thereby, anything in the Consti
tution or laws of any State to the contrary
notwithstanding."
The act of secession, therefore, cannot
ehange in the least degree the legal rela
tion of the State to the Union. No pro-

States can be abrogated or impaired there
by. No citizen of the United States re
sidsug in the seceded States is, by such
I ordinance - 0f secession, deprived of the
I just protection or exempted from any of
his duties to the United States. In con
templation of law the reciprocal duties of
protection and allegiance remain unaffect
ed. After the act of secession, the pro
vince and duty of the Government of the
United States are the same, according to
the full measure of its ability, as before,
to enforce, in every part of the Union,
and over every inch of its territory, the
Constitution and laws of the United States.
It is the necessary result of these priuci
pies that no State can abdicate or forfeit
the rights of its citizens to the protection of
the Constitution of the United States, or the
priiileges and blessings of the Union which
that Constituticin secures and makes per
petnal. The primary, paramount allegi
ance of every citizen of-the United States
iS to the nation, and the State authorities
can no more impair that allegiance than a
county court or a village constable. It is
also the plain and necessary conclusion,
from the principles before stated, that a
State cannot commit treason. The persons
who for the time being hold the officers
under a State government, may individ
commit treason, but the acts of the
State officers, transcending their authority
and in conflict with the Constitution of the
United States, involve in their guilt no
Man who hat; not himself levied war against
the United' States Or adhered to then- ene
mies, giving them rid or comfort. As a
State cannot commit the crime of treason
it cannot incur a forfeiture of its powers
acid functions as the penalty of treason.
The punishment prowded for traitors is
the result of judicial trial, conviction and '
judgment.. Bow to indict a State, the
constitution of the court , . the mode of
trial, the form- of judgment, and process
of execution yet exist in gremio aegis.
The Majority of the voters of a State can
not deprive the.minority 'of the rights se
cured' to the Constitution of tfie
United States. *Sonielitthese rights may
be held in abeyance. Their exercise may
be overborne• by superior physical force.
They may sleep, but it is not the sleep of
ileath. They 'are integral parts of the
Constitution, and' can'sonly .peris when
theConstitntion perishes. There •There is noth

How Gen. Prentisi Surrendered.
The Memphis .4ppeaf, of the lith ult.,
says: "General Prentiss surrendered him
self personally to private Simons, of Cap
tain Bethel's company, of the Twenty
second Tennessee regiment, who conduct
ed him to Colonel Freeman. The Colonel,
receiving his sword, turned to introduce
him to the regiment. When the regiinent
discovered the quality of their captiie,
they vociferously cheered him. General
Prentiss graciously acknowledged the com
pliment" by doffing his hat, and in the po
litest manner possible, said: "Boys, you
have a right to shout, for you have fought
like tigers."
Progress of the Tax Bill.
It is stated that the Senate Finance Com
mittee have struck out of the tax bill the
whole of section 75, including the taxes
upon carriages, watches, piano fortes and
other musical instruments, gold or silver
plate, and private billiard tables. The
alleged reason for the change is that these
taxes involved domiciliary visits, more
vexatious than productive. The tax on
billiard tables kept for hire is retained.
The committee had likewise determined to
raise the tax on spirits from fifteen to
twenty cents per gallon.
ELEVEN .Illinois regiments have voted
on the new constitution of that State, and
of the whole number of votes cast there
were only sixty against it.-31". Y. World.
This new constitution prohibits negroes
from entering the State. The experience
of the Illinois regiments in fighting the
rebels does not seem to have had the ef
fect of increasing their attachment to the
ne , rro. As some of the Abolitionists al
ready" deny to the Siates the privilege of
institutions,

Illinois constitution null and void.
Resigned
Lieutenant James G. Bennett, of the
revenue service, who has been "serving
the government" on hoard his own yacht,
the Henrietta, for six months past, at Port
Royal, has surrendered his commission
and. withdrawn from the service. Mr.
Bennett is a son of James Gordon Ben
nett, of the New York Herald.
PAnTos Baowst.ow• says that the Union•
ists in East Tennessee depreciate any rigid
anti-slavery policy on the part of the Gov
ernment as the sure means of driving the
Southern Unionist to despair. He reiter
ates at every point the assurance that at
the next State election. if Tennessee is rid
of rehei soldiers, she will give a Union ma
jority of 50,000.
MR. RUSSELL. of the London Times,
writing to that paper, under date of March
25th, compliments Gen. McDowell as "an
accomplished and well-instructed officer."
but says ho is "surrounded by a number of
young gentlemen, very earnest, gallant and
bard-working, but ignorant for the most
part of the proper duties of•staff officers."
He also states that "the general officers of
the American army know its defects : the
people do not."
