DEO. 30
PITTSBURGH, MONDAY MORNING, DECEMBER 30, 1861.
SELECT TALE.
THE PHANTOM WITNESS.
AN ENGLISH STORY.
LcoHnsoxD raoM ova list.j
The Attorney General arose. The
court was hushed. I never took my
eyes off his for one monient while ho
spoke:
“My lord and gentlemen of the jury,
the prisoner st the bar, Anna Dermer
Heritage, is on her trial for the murder
of Earnest Seaton. If she be guilty, if
is a guilt which casts the shadow of its
terrible atrocity over every hearth in
England; if innocent, she is a piece of
-uffsiing virtue whioh I implore
Heaven to protect. I,am here to per
form a duty, not to advocate a oause.
God forbid that by one word, one look,
one tone, or gesture, I should seek to
color or inflame your passions. I wish
to he the mouth piece of a narrative
merely, you are the jndges. The pres
ent respected High Sheriff of the oounty
is Sir Ralph Heritage, of . Heritage
Hall. He had a brother who marriedand
went to reside in Ceylon with his wife
and two infant daughters. One ol
those daughters, in the courst of years,
was married to Mr. Seaton, a young
merchant. He died leaving her a
widow with a child—the murdered Er
nest Seaton, mentioned ia the indict
ment against the prisoner now on trial.
The brother of Sir Ralph Heritage died
at Ceylon, so after the death of bis wife,
and the two daughters were alone, one
a widow with her infant sou —the other
the prisoner at the bar. They cotn
muDioated with their nnole, Sir Ralph
Heritage, who sent them a kind invita
tion to come to him, intimating, at the
same time, that he would make his
grand-nephew Ernest Seaton, his heir.
They oame—the mother and
the young aunt. They reached Liver
pool in the ship Alceste, and took a
post chaise to Northamptonshire. The
abase broke down at a place named
Dallington Flats, aDd the party were
compelled to take refuge from the rag
ing storm, at.d to pass the night at an
inn named the Wheatsheaf. The i hild.
the mother and the aunt, retired early
to a double-beaded room. The child
slept with its mother, tho prisoner at
the bar in the other bed. At five min
utes past one o’clock on that night the
landlord and his wife were awakened by
load soreams, and they hurried in the
direction of the sound, which led them
to the room in question. Mrs. Seaton
was lying in the door-way; the prisoner
at the bar was sitting up in bed, and
mnch disfigured; on her hands was
blood. The body of the child Ernest,
was found between the bed and the wall,
with a kniio in its heart. Now, gen
tlemen of the jury, these are the promi
nent faots, but there are some collateral
ones, which it is my duty to mention.
The landlady of the Wheatsheaf will de
posethat,as she was passing the room oo
oupied by the sisters.she heard them con
versing, and with an incidental onrios
ity,she paused to listen, when she heard
the prisoner say, “I shall go to the wall,
and no tget a husband, ail on account
of your little Ernest, when I intended
to make our UDole Ralph take to me,
or make me his favorite, and leave me
all his money.” These the landlady
will tell you, may not be the exact
words used, but she will Bwear to you,
as she has already sworn to the justice,
that they are very near,'and contain
the sentiment that was uttered. Col
lateral fact the seoond, then, my lord,
and gentlemen of the jury, is, that the
knife that done the deed belonged to
the prisoner, and was bought by her at
Columbo, in Ceylon Gentlemen, God
aid and help us all to get at the truth
of this matter. I have nothing more
to say.”
The Attorney General then sat down,
not adding one word to his bare state
ment of these faots, on whioh the case
rested.
A cold perspiration sat on my brow.
How fearfully strong was the ease, and
what had Ito rebut it with? Nothing
—nothing! What if Brown had • ab
sconded? What if Brown had been
swallowed up by an earthquake ? His
absenoe or presence would make but
little account in such case. He bad
only seen what others saw—he could
add nothinejto the evidence of the land
lord and landlady of the inn.
I felt as if my very heart paled, as I
saw the blank, half terror stricken coun
tenances of the jury, and fancied that
in every whisper they indulged in to
eadppther, be
fcraffji. ~
The junior counsel for the- prosecu
tion now rose and called “Jacob Witts ”
There was a slight bustle, and the
landlord got into the witness-box. He
merely deposed to the coming of the
sister? and the child to the “Wheat
sheaf,” and the alarm in the night, and
the finding of the dead body of the
child as stated.
The Attorney-General then glanced
at me, and I rose to cross-examine.
“Had yon any other guests at the
“Wheatsheaf ’on the night in ques
tion r
“Yes, sir; a Mr. Brown.
“When did he come.
“About an hour after the ladies/’
“Was he a stranger to you.”
“Qnite, sir.” .
“Where did he Bleep?”
“At the efid hf the gallejy, about
fifty paoes off the lac’iies’ room.
‘ You can go down now but I shall
want'you" again.”
iHartha Witts fcJj© landlady was the
Wfitoess examined, and she con
luroed* whai the Attorney-General had
already stated. Her account of
Anna had said made a strong i°*P rc, £l
sion on the j’Ary, and 1 roaa
cross-examine her, I fait that was the
point to attend to.
“Now, Mrs. Witts,” said I, “you
have said man; a thing in jest to your
husband, no doubt ”
“Lord bless you, yes sir.”
“And meant no harm?”
“Not the least, sir.”
“Of course not. Now, can you xec
colleot anything you may haye said of
him, or to him, in that harmless way
lately?”
“Oh dear, yes, sir ! When he takes
a drop too much I am very apt to say
that I hope the next will choke him,
■ mt I no more mean it than you do,
“And of course by the tone in
which you say it he knowß it is only a
joke.”
‘To be sure.”
“You speak it in something of the
tone of the prisoner at the bar when
she said she should not get a husband?”
. “Just so, sir.”
“That will do. You can go down.
Mr. ILown was the next witness call
ed, and no one appeared.
