City of Pittsburgh was taken up on Tuesday;' The appliCaion is one Mr a per emptory mandamus to oblige tre city councils to levy a tax to 'TM% the-interest on $150,000 worth of bonds, issued by the city to the Char tiers' Valley Railroad Company in payment of subscription to the capital stock. Mr. Her• ding opened the case for the relator, was fol lowed by Periney, Esg, and Thomas Williams, for the city, Mr. Eii K. Price chising for the relator. The ground on which the assessment is refused, is that'when the sub scription was made it was a part of the 'contract that $350,000 was to be first obtained in bona fide subscriptions from individuals, which con dition, it is alleged, was not complied with. They also say that the limit has been reached to which the city is empowered to levy tasci, and that additional legislation will be required before - the tax can be assessed. The cases are attracting much interest. Others are yet to be argued. Bond Cases In the United states Circuit In the United Staten 'Circuit Court, yester day; an application ws. made fur a continu ance of the eases against Allegheny county, involving the liability for Louis issued to the Allegheny Valley Railroad Company, but the Court refused to continue them, and they will accordinglY be tried in a few days. By con sent of counsel, the - sine questions being in volved in the oases where the validity of the §teubenville and Chartiers Valley Railroad subscription is the matter at issue, it has been 4g* - 41.148,t the verdict which decides the for_ cases 'shall also dispose of the latter. AA - eleven o'elocli the case of Henry Amer vs the Mayor, Aldermen and Citizens of Al le.gliny, came hp for trial. The case is an iiii 'portant one, involving the validity of the sub scription of $400,000 by the City of Allegheny to the" Ohio and Pennsylvania Railroad, the plaintiff being a holder of some of the bonds. on which he seeks to recover interaq. Messrs. lbs.:Knox andJ. L. Koethen appear for plain tiff, and Mr. Bell. the Solicitor, represents Al legheny City. The ease occupied the entire day, and was still on trial at adjournment. How WE ABUSE OVE STOMACEIS—No oth er civilized people, probably, are accustomed to abuse their stomachs so badly as the Amer cans of the United Suites. Our food is often badly chosen, still more frequently spoiled in cooking, and almost always eaten in utter dis regard ofidietic rule`. We .set far too much fresh merit., (and especially pork, in its most objectionable form,) and too little bread, vege tables and fruits. Pies are another A-merican abomination, and have no small share of our ill health to answer for. Thet'inlnce-ple; as it is generally made, is the abomination of abominations. Some describe, it as "very white and indigestible at the top, very moist and indigestible at the bottom, and untold horrors in the mid *: 4ven otir } t read is unwholesome. It is of the finest of tionr and fermented till its natural siveetts and a large proportion .Of its nutritive alenients are destroyed or raised with those poisonous chemicals, soda and cream of tartar. In either case, it is unfit to be eaten. The rich cakes our good housekeepers deem so indispensible are still worse, and soon.
