During Friday, afternoon and Saturday
morning, the District. Court. _VMS engaged in
hearing - depositions, affidavits and arguments
in the' matter of 'the lost equity - bill in the le
of Craft vs. the Pittsburgh and Steubenville
BailrOad - Company. George -P. Herat :Am,
Egq., appeared for Mr. Craft, and Thoreas
Howard, Esq., for Mr. Armstrong,' the Pro
thonitaty, on whom a rule was served to show
why the bill was not produced, Sind 'Mr. Barton,
who was suspected of knowing something about
the missing document. The depositions' taken
for the enlightenment of the Court - were read,
but beyond the fact that the bill was seen,
shortly. prior to its disappearance, in Mr. Bar
'• ton's hands, shown by one side, and the depo
sitions of the clerks of the- office that they did
'not know what had become of it, by the other,
nothing new was elicited.
Mr. Howard offered to read two affidavits,
one from Mr. Barton, denying any implication
in the abstraction of the paper, and one from
another party, who set forth that certain pa
pers taken from the Prothonitory's office were
afterwards found in the pocket of one of the
parties now endeavoring to fix the larceny of
this paper on .Mr. Barton.
Mr: Hamilton held that the affidavits were
e-. 2 parte, and should be ruled out. Mr.
.. Bar
ton, though pr , d . nt during the reading of the
testimony, had not offered to testify, and ho
could not now came in with an affidavit, with
out notice to the other side, depriving them of
the privilege of cross-examination. Be de
nouneed, in strong terms, the second affidavit,
as an attempt to injure a worthy member of
the bar. ,

The Court thought the affidavits no part of
the case, and accordingly ruled both out.
Mr. - Howard -then .. proceeded to argue upon
the evidence, remarking that papers were often
lost'or mislaid in the office of the Prothono.
tary, 'end that it was almost unheard of to
chargis,coarisel with purloining them. He
could see ne-motive on the part of the respon
dent for" the removal of the paper ; had it been
an original paper, with a signature attached,
there might have been—but to take away a
bill which could be reproduced would not ben
efit him. He hinted that the only party who
would , have an' interest in the removal of the
document, was the party filing it, who might
have Set forth some facts too broadly, pr not
sufficiently explicit. He thought thel'rothon
otary had done his utmost to find the bill, and
that the rule should be discharged.
Mr:Hamilton followed, in aforeible argu
ment, briefly' detailing the' -facts in the case,
and the proceedings already had, and held that
Mr. "Barton' should have submitted to an ex
tmination before the -Court, to put himself
right on the record. He commented with some
.severity, en Mr. Partnnla part in the matter.
Mr. Hamilton said that Mr. Armstrong should
have been examined—that the evidence did
not show that be had used due diligence in ex
amining into the kiss of the bill, and that. the
ruleshinald not be'discharged.
The.Courtcoineided - With Mr. Halkiillon in
the opinion that the evidence of Mr. Barton
and Mr. Armstrong should have been added
to the rest, and would not- decide until such
evidence was prodrided. An order was ac
cordingly made appointing Hon. Charles
Skater a commissioner 'to take additional tes
timony: ,• :

'NARROW ESCAPE Or A RAILROAD TRAIN.-
A passenger train on the Cleveland and Ma
honing ltailioad had a narrow escape from
destruction the other day. In approaching
Warrenthe souqd-otthe whistle alarmed two
horses, wo were 'feeding near the track, and
Vrlnning directly in fillet of the locomotive,
they dashed.ahead.of the train; which was snow
about entering the bridge. over the Math:Ming
Ri'Ver, and running at rather reduced speed.
The track across the bridge is open, and •the
horses in endeavoring :`to- to crois the structure
fell between the ties. .one of them had his
bead cut otf as nicely as if he'had been guillo
tined, while the other lost two of his legs, and
the carcasses of both were pitched into the
'river. The escape of the train was a most
providential one, as bad the 'poor brutes, fallen
directly in front of the engine,.theLtrain-mast
have been thrown into the stream, with what
consequences may be-easilyimagined.

The Sunday Cae—Testlmoiky to be Retaken
by a Commissioner.
On Saturday morning, in the Supreme
Court, the C 8.90 of Commonwealth vs. James
Nesmith, driver for John T. Logan, convicted
of violating the Sunday law, was up, on the
return'of..Mayor Weater to.a Writ of certiorari
issued by the Court, he having stated that he
could not return the evidence, as he believed
with Judge - Wohtivrard, - that'it`Wits no part of
the record in the case. Mr. M'Knight argued
that the evidence
.does constitute a material
part of - the iwi - ord, and quoted numerous au
thorities to maintain his position. He con
tended, also, that the return was insufficient, as
not setting forth definitely the offence and the
attending', circumatanees; He at- first moved
thatlhe Mayor be attached for contempt in
sending up a deficient return, but afterwards
withdrew it for another asking the appoint
ment of ft commissiener to take the evidence as
given before the. , Mayor ' "-to - be msed in the
hearing of the cause by the Court.
Thomas Howard, Esq., for the 'Mayor,' was
about to argue the legal question as to whether
the evidence was is necessary part of the return,
when the Court intimated that it was not ne
cessary to,eonsider. the question now. Alder
man Steele was then appointed a commissioner
to take the evidence, on twenty-four hours'
notice, the Capri giving no opinion as to, the
legality of the Mayor's return, or the correct.

Margaret Clark, convicted of Felling liquor
on Sunday, was.fined $lll and costs, and corn•
vilified fifteen days in default, having already
been confined some weeks. She was also-com
mitted thirty days for selling without license,

Patrick McLaughlin, Margaret's "partner,"
witi committed fur thirty days each un two
charges, one Uf selling liqUor on Sunday, the
other of selling without license, from hi. twat
at Six Mile Perry, having been convietini un

latter offence.
Valentine Deary, colored; and James Davis,
white, were brought in for sentence, having
been found guilty on two chargesof arson, in
tiring M. M'Cullough's saw mill, 'first in Au
gust, 1858,. on . Wainwright's Island, and
second, in September,' 1859, in Lawrenceville.
They wore sentenced to live years each in the
Western Penitentiary for ouch offence. A
brother of Detry's is now in the Penitentiary
for arson in setting tire to the house of Mr.
Shaw, a butcher in Reserve township.
James &shill, convicted of assault and bat
tery With intent to till on Mrs. Hyde, was sen
tenced to two years in the Penitentiary. The
Court said -he would not be sentenced on a
charge of assault and battery- on an officer, to
which he pleaded guilty.
Abraham Thayer, convicted of assault and
battery with intent to kill on John Dorrington,
at Iron City Park on the Fourth of July last,
was brought in for sentence. Mr. Swartz.
welder produced some evidence as to character.
and asked for a jail sentence. The Court
sentenced Thayer to two years imprisonment
in' the Penitentiary.
John Baxter, found guilty of petty larceny
in stealing a quantity of butter, got six months
in jail.
Charles Woy, for stealing a cow, was COD
signed to the Penitentiary for one year.
The sentencing of Brady. convicted of as
sault and battery with intent to kill, was post
paned until this week. ,

Stabbing Affair at .the Perry Hutel---A
Life in Danger.,
Os Saturday morning about ono o'clock,
John 3.tontague, Daniel - Gallagher, and one or
two other young men went into the bar of the
Perry Hotel on Duquesne Way, drank, but
did not pay for it, .They then seated them
selves and began behaving in a disorderly man
ner. when, the bar-keeper remonstrating with
them, an attack was made upon him by Gal
lagher. Seeing that the bar-keeper was in
danger, Mr. Robert Beatty, a gentleman board
ing in the house, interfered to restore peace,
when Gallagher drew a knife, and plunged it
is his back, below the'shoulder blade. Galla
gher and Montagne:fled, and Dr. Dickson was
called upon to attend the wounded man. He
found an incision live or six inches in depth,
touching no vital part, but rendering recovery
a matter of doubt.
The MaYor was informed of the circumstan
ces, and he at once took measures to arrest
Gallagher, who was found. in the morning, at
his mothers house, in Allender's court, off
Wylie street, hidden between two beds. After
an examination he - was committed to jail to
await the issue of Mr. Beatty's wound. He
is a man of about twentythree, and the same
person who was cut last winter in a fight in the
Neptune engine house. Montague, it seems,
took no part in the difficulty, and has not been
arrested. He will probably be held as a wit•
Mr. Beatty is a salesman in a Market street
dry goods house, and a young man highly es
teemed by his acquaintances. His parents re
side in the Ninth ward. while he, with his wire
and two children, boards at the Perry Hou•e.

New York Items
NEW YORK, November 6.—A despatch to
the Express says that the Pennsylvania oppo
sition State Committee have agreed to call a
State Convention of the whole Union.
Buenos Ayres advices of September 1, states
that the Buenos Ayres squadron had chased
a Uriquizas steamer into Montevideo; that the
government had ordered them to leave, and
the Buenos Ayreslans were waiting outside to
fight thorn. A Paraguayan mediator was daily
expected at Buenos Ayres. .The land forces
were inactive.
The steamer Ocean Queen sailed to-day for
Southampton and Havre, taking out $948,567
in specie and 148 passengers, among whom are
.51r. A. S. Hill of the Tribune, Dr. J. Frazier,
U. S. A,. and Dr. S. IL Elliot of Staten Island,
The Kangaroo also sailed to-day for Liver
pool with $170,000 in specie, 4nd 230 passen
gers.
Found Guilty.
CHARI.):STOWN, Va., November s.—Shields
Green, one of the negro prisoners, was found
guilty this morning. Tho first count for
treason was abandoned upon objection taken
by Mr. Sennett, that it was not proven that
the prisoner was a free person, and therefore
he did not come under the statute which reads
"any free person." Sentence deferred. Cope
land is new on trial—Mr. Sennett defending
him. Tranquility is being restored.
Fall of a Warehouso
HARTFORD, November s.—The four story
brick ;tore of S. Rockwell & Son, on the cor
ner of Morgan and Front streets, in this city,
fell, between six and seven o'clock this morn
ing. It wai nearly new, and contained 1,500
bbls. of flour, and large quantities of grain,
produce, &c. No one was killed, although
one-half of the building is a wreck from cellar
to roof. The loss is estimated at $B,OOO.
