found a verdict of not guilty.
Commonwealth vs. James ScallilJ, indicted
for assault, and battery, on oath of T. J. White.
"DeMndarit pleaded guilty, and was remanded
for sentence.
Commonwealth vs. George W., alias "Shar
per" Smith, indicted for larceny. in stealing a
set of harness from James Patton, Jr., of Alle,
gheny. Verdict guilty, and prisoner remand
ed for sentence.
Commonwealth vs. John Baxter, charged
with larceny in stealing a lot of butter from
the spring-house of George Sharp, in Plum
township. Verdict guilty.
Emily Israel, an English woman, was tried
for selling liquor without license. The evi
dence showed aninformality in the return, and
the jury found a verdict of not guilty.
Commonwealth vs. Philip Beilstein,
charged
with selling liquor to minors at a ball at his
"house in the Fourth ward, Allegheny, where
he kept a beer hail, on oath of Frederick Rid
dle. • For the defence Mr. Beilstein showed
that he had frequently refused to sell to minors,
and kept a notice in his bar stating- that they
would not be furnished with liquor. The case
was submitted without argument, and the jury
found a verdict of not, guilty.
Commonwealth VS. Edward Frowenheitn, in
dicted for selling liquor without' license. The
evidence did not priive the selling, but showed
that defendant kept stomach bitters at his gro
cery in Reisville. No verdict at adjournment.

strains 'still haunt our memory and thrill us
with delight, Frederick Von Schiller, this rep
, ittetion is well sustained. The members of the
German singing societies, who have taken the •
matter in band, are sparing neither time or ex
.pease in perfecting their arrangements for the
anniversary festivaball of which are progressing
_finely. The festival, we have every reason to
believe, will be one worthy of the eminent poet
whose natal.day they honor, and we bespeak
for...its proprietors all proper encouragement.
The day will be commemorated by the Germans
throughout the world in an appropriate man
ner ; in the native land of the poet preperxt
tions are being made, on a magrdflcent scale,
for celebrations in every town •of note ; but
however high a tribute may be paid to the
memory of Schiller in his own country, we
doubt whether his countrymen in our own city
will be behind any in the enthusiasm of their
demonstration. Money 'has" been expended
with a liberal hand ; time and talent have been
actively employed, for weeks, in contributing
to the great end, and if we are not, much mis
taken, Pittsburgh will, on the day of Schiller's
nativity, exhibit such a demonstration 'among
our German population ( and we hope many
others may join with them.) as has seldom peen
witnessed. -

in jail since the 20th august, on a charge of
assault and battery,' was yesterday discharged
by the Court of .Quarter Sessions, the grand
jury having found no bill, in consequence of
the abscence of the prosecutor.
Mrs. Eliza Orr, confined on a charge of
adultery, preferred by her husband, John Orr,
aras,aisa discharged, , the' grand jury havin,g
found no bill. The court held that she could
irk 6e held 'on hei• husband's information, nor
could heappear as a witness against her.
James 'Williams, , colored, imprisoned for
adultery and fornication, on oath of John
Orr, was discharged, the grand jury having ig
nored the bill against

since a son of James Johnston,,riine years obi,
was driving the cows home'fronia farm a mile
distant to that of. bis'fitther in Jefferson town
ship, Butler .county, when he caught ono of
them by the tail. The cow became frightened,
(the tail wrapped tightly about the boy's
wrist) and ran away at full speed, dragging this
boy more than half a mile over a very rough
road. The boy was not relieved until the tail
gave way, when . he was found to be severely
bruised about the head. His escape from
death was considered miraculous.

frightened the horse, which started off, drag

MISS DAVENPORT'S FAREWELL.—]Iies Jean
M. Davenport had a good audience on the oc
casion of her benefit last evening, though the
attendance was not so large as it should have
been, nor indeed has it been during her engage
ment. Her rendition of the arduous part of
Mrs. Haller in the "Stranger" was perfect,
and that of Dot in the "Cricketon the Hearth,"
was equally pleasing, sustaining her high char
acter as the best actress in the country. This
evening she closes her engagement at the
Apollo, and we hope to see an overflowing
house, which she is certainly fully entitled to.
Tho " Cricket on the Hearth" will be repeated,
and it is an admirable drama—which every
one should see, and the popular afterpiece of
" Sketches in India." As the opportunity of
seeing Miss Davenport cannot again occur this
season, the present should be embraced by her
numerous admirers.
Sr. PAULY. 011111Atis' ASYLUM.—The audi
tors of the accounts nt this benevolent institu
tion have made their report. From it we
gather the following statistics: The receipts
of the Asylum for the past year, from all
sources, were $13,738 2S. Of this the recent
fair yielded $4,457 ; the Orphan's pic nie on
the Fourth of July, $2,081 : Bishop Timons'
lecture, $289 52; and a house which was sold
in Lawrence county, $ 1 1 19 5 00—the balance
being contributed in varirous ways. The ex
penses during the same period are given at
$13,164 72, leaving abidance in the treasury
of $573 :IC. The debts of the institution $3,-
859 77.

Arrival of the Steamship America

express having arrived from Halifax, furnishes
Liverpool dates to the 22d ult., brought by
tho•steamer America.
The departure of the steamer Great Eastern
for the United States has been again postponed,
this time sine die. She *ill probably not leave
this year.
The details of the treaty agreed upon by the
Zurich Conference had been published, from
which it appears to be a mere simplification of
the Villafranca agreement of the Emperors.
The rights of the Grand Dukes of Italy are re
served for the consideration of the Congress of
Powers.
Spain was dissatisfied With MoroCco's offer
of pacification, and a war was considered im
minent.
The Sardinian Government had issued a de
cree calling for a loan of one hundred millions
of francs.
The steamers Vanderbilt and City of Balti
more, from New York, and the North America,
from Quebec, bad arrived'out.
Tho Zurich treaty stipulates that the ratifica
tion of the peace treaty shall be exchanged
within fifteen days.
The Paris Pays intimateithat Naples, Spain,
Portugal and Sueden are not likely to bo
members of the projected Congress. The Lon
don 7",re e 4, Pit and Ikrold are averse to
England's joining it. The Post, Lord Pal
merston's organ, regards the Dalian com
plication as very serious, and the situation of
Napoleon very embarrassing. It also thinks
it certain that Romagna will be attacked by
the Papal troops, and that at the first menace
or an armed intervention In the duchies, Gari
baldi's troops will sweep away every vestige of
the Papal rule.
The electricians have commenced, at Valen
cia, experiments on the Atlantic cable, with
some encouraging results.
It is reported at Paris that the Emperor had
refused an audience to a deputation from Bo
logna, and granted one to a deputation from
the' Duchies.

The London 'Meier and liereM are both averse
to England Joining any European Congress on
Italian gram. The London Post, Paltners
ton's organ, asserts that it were an idle trifling
with the influence of England, and the hopes
of Italy, to expect any English statesman at
all worthy of the name, to hazard his own re
putation and the national honor entrusted to
his care, by entering a Congress of which the
basis may be in the execution of toe. Zurich
treaty. The same Journal regards the Italian
COMplications as very serious, and the position
of Napoleon as extremely embarrassing. Ho
has undertaken the special protection of the
Papal government, and also of Italian liberty,
while the Papal power and Italian liberty are
in open warfare.
It is almost certain that the Romagna will be
attacked by the Papal troops ; it ie also certain
that the first menace of armed Intervention in
the duchies, the troops of Garibaldi will sweep
before them every vestige of Papal rule. Lin
der these circumstances the intervention of
Austria will be anticipated. What part would
Prance then play, and what extension would
the Roman question then assume! The Post
concludes by saying that English statesmen
will make efforts to avert the dangers which
threaten Europe.
GREAT BRITAIN.—The directors of the Great
Eastern held a mooting on the 19th, and it is
authoritatively announced that the departure
of the vessel has been postponed sine die, and
orders given that all passage money received
bo returned. No time will be fixed for the
transatlantic voyage untill good progress bas
been made in fitting out the ship in a thorough
sea going condition, and according to Borne
authorities, there is no likelihood of the voyage
being made before spring. The ship would re
main at Holyhead about ten days longer, and
then go to Southampton to complete her fittings,
after which a trip to Lisbon Is spoken of. It
is stated that in her present condition the Direc
tory will not accept the ship from Scott Russell.
Tho Directors of the London 'and North
western Railroad Co. gave a grand banquet at
Holyhead to the Directors of the Great Ship
Co., on the 19th. Tho Marquis of Chandos
presided, and among the 'guests were Mr. Glad
stone, Chancellor of Exchequer, Sir John
Pakinton, and many influential men in com
merce and politics. The speeches were all
hopeful of the success of the ship. Mr.
M'lvor, in the course of his remarks, reiterated
the statement that the Cunard Co. was builds
ing a steamer considerably larger than the
Persia, but not so large as she.
Prince Napoleon after minutely inspecting
the Great Eastern at' Holyhead, paid a flying
visit to Liverpool and then left in his steamer
for parts unknown.
The funeral of Robert Stephenson took place
at Westminster Abby on the 21st, in presence
of a great concourse of people, and with every
demonstration of respect. The Abbey. was
crowded and the attendance included the most
distinguished men of rank and professions.
Mr. Stephenson bequeathed 125,000 to public
institutions at New Castle, Sundabsed, Shield
and other towns in that locality. Bug , •
was suspended during a portion of the as
the funeral, and many demonstrations c'
pect took place.

agement as to the success of the undertaking,
both as regards the resuscitation of the old and
the laying of the new cable, was in the ascen
dant. These gentlemen found room in the
state of the cable to disseminate new courage
among its friends.
The Insurrection.
CHARLESTOWN, November 4.—There has
been a marked abatement in the excitement
here to-day. The town is, however, as full of
people as when the exeitement was at its
height, and strangers are continually coming
and going. Judge Russell and lady, and. Mr.
Hoyt, who first took up Brown's defence, left
here this morning for Boston. Coppee, who
was found guilty yesterday, has not yet re
ceived sentence. Shields Green, one of the
negro prisoners, was put on trial to-day. He
is defended by Mr. Sennett. The evidence is
closed, and the case will be submitted, to the
Jury to-morrow. Copeland is next'for trial,
and on Monday it is expected that the wound
ed man Stephens will be brought up. It is al
most certain that Cook will . plead guilty, first
submitting a written confession or statement of
his connection with Brown. Hie brother-in
law, Governor Willard, of Indiana, is still
here.
Arrival of the Overland Mail
Sr. Louts, November 4.---The Leavenworth
overland express reached Denver City on the
28th, with a consignment of seven thousand
dollars in gold dust, and twenty-three thousand
dollars in the hands of passengers. The weather
continues unusually favorable to miners.
An election bad been held for officers under
the provisional government, the result of which
is not definitely known, but so far as ascertain
ed Steele had a majority for Governor. Efforts
are being made to induce the people to parti
cipate in the election for delegate from Kansas,
which takes place on the Bth inst. The project
is opposed by the local papers, which argue in
favor of non-intervention in Kansas affairs,
having but recently elected a delegate of their
own, who is expected to urge the immediate
organization of the Territory of J 01211113011.
The India Rubber Case Decided
• Cutcaoo, November 4.---Thi; morning in
the U. S.-Circuit Court, the Judge decided the
India Rubber Cases on motions made last
week, against between twenty and thirty firms
in thiacity, affirming the title of Horace H.
Day eta!, uporf the ground that Judge Giles'
late decision on the final hearing entitled the
complainant to an injunction until reversed by
the tiumune Court.
Railroad Accident.
Woos - rEa, October 4.—Joseph P. Miller, a
baggage -master on the Lebanon Valley Rail
road, residing at Harrisburg, was killed this
evening on the Pittsburgh, Fort Wayne and
Chicago Railroad. while attempting to get on
the cars after they had started from the sta
tion.
