Mr. Rippey eetve detailed history of the organization of the rail way, the order of court under which it was built to Cemetery, the injunctions issued by the Supreme and District Courts, and read vOldminuous depositions, showing the miserable condition of the road, and that it was now us goOd, if not better, than before the railway was laid. Ile also stated that the Company had contracted, in conjunction with the borough of Lawrenceville, for the paving with cobble stone of 'Butler street to the Cemetery gate, at a :cost•of $16,000, leaving it in better condition than ever :before. lar..flamilton said the Plankroad Company had filed no answer—thought the taking of testimony was premature. As soon us the ali plication was made on the petition tiled by plaintiffs, a commissioner was at once appoint. ed by the. Court, without giving them an op portuttit:.# Wing:- f answer. He protested against this proceeding and claimed the prig i lego of filing an answer. HORSE STEALING ON A LARGE SCALE.—An extensive gang of horse thieves, having their rendezvous near Ashland, Ashland county, bas been discovered and broken up. A man named William Bailiryr,...whol.s respectably.connected in Ashland county, VMS identified Bathe active leader of the gang, but while Marshal Galla gher, of Cleveland, who engineered the case, was procuring the necessary proof, Bailey es caped, but an officer-has been despatel__2o,Lit4 - suit of him. The gang-lie .•ixa-brmil in operation for a considerable length of time, and over two thousand dollars worth of stolen property, con sisting-of horses and buggies, was recovered near Ashland: -. g . ,X_PLOSION7:—An explosion of tire damp oc curred On Tuesday last, in the mines of Baker & Dravo, on the .Monongaliela river. William Morgan, who Was the first to 'enter the mines that morning, and from whoselamp thegas ig nited, was seriously injured by the tire. His lace, neck, hands arid arms were badly burned. The attending physician says that his recovery depends upon the injury done to his lungs. Ho is at present lying very ill. INJURED. — On lust Monday, William Coats worth, a boy about sixteen years of age, was se verely injured in the coal bank of Pogers & Ray. near Monongahela city, by slate falling upon his skull, which it fractueed, making alarm . out upon his-forehead, about fourincnes long, and' one of correspondingsizoretite baclupart of his 'head.. Market Quotattous. We frequently hear complaints as to the in correctness of quotatiiins in the market reports of the city papers, and the error is frequently attributed to the carelessness of commercial re porters. Yet we know from investigation, that the fault does not lie with them. it is in the desire of unprincipled men, of whom there are some in the commercial circles of every com munity, to make money too fast, by giving quotations, when they have full stocks, alio% e the outside rates, thus inducing other more honest merchants to advance , their prices, and by this means eventually raising the market, to the advantage of their own pockets, and at little or no expense to their conscience. It cannot lie denied that this abuse is practiced in this city, and however honest may be the in tentions of a reporter, his integrity is liable at all times to be impeached, from the imposi tions thus practiced upon him. A. commercial cotemporarv, alluding to the subject, sayii " have known shipments made on the strength of quotations in the papers, to the very houses front which the figures originated, with orders to sell at market rates, and the consignees have been obliged to close out to complete instructions at from ci to 7 per cent. less than the rate given by themselves, upon which the shipment was made, when there had been no change in the market." Parallel cases have fallen within our own em perienee, and this abuse of confidence, (for until a party is detected in giving false quota tions, his figures are taken as reliable,) results not only in creating a general want of faith in tire: market' _reports of 'newspapers, but in arousing a suspicion in the mind of the con signor that lie has not been fairly dealth with. Thus this evil recoils non its originators in a certain degree, but still leaves the innocent newspaper reporter to feel its had effect. A singular lack of confidence prevail:, among those in the same business here, -which is prob ably at the foundation of the discrepancies to which we have referred, and we think. might be dissipated by the daily meeting of the merchants on 'Change, friendly consulta tions, which mutual interest and unswerving, honesty should govern, and an agreement upon priCes, based upon actual sales, by- sample, which should govern the market for the day. Some of our business houses have long been struggling, with little encouragement, to this end, but ie only a dozen dealers - would attend daily ut the Merchants' Exchange azd tit upon prices for leading articles, with a derkrmi nation to adhere to them strictly, they would not only find it to accrue to their interest, but boor. c o te - jeil others M join with - them in the establish. inent of a regular tariff of prices, thus restor ing confidence, and obviating the imaginary necessity of giving false quouitions, to the great detriment of trade and the credit of the city. During the run from Portland, she showed only moderate speed, and doubts are ex pressed f her boingdespatched on the proposed American trip this season. The peace negotiations in the Zurich confer ence are said to he making but little progress. Tie. promulgation ot the conference is anti cipated. The difficulties that hinder adjust ment have not been settled, and it is considered doubtful when the treaty will be signed. The three Plenipotentiaries held n conference on the the 9th inst., after which couriers were des patched to Vienna and Turin. The eorrespondent of the London Times' says the delay is attributed to Austria, and that the Vienna Cabinet is doing all it can to win France to it; view::, while at the same tirne it reported as preparing a Coalition against Napoleon, in Germany. The greatest speed attained was 141 li . nots:, or nearly seventeen miles per hour.— This was accomplished without any special ex ertions by the engines, but there was consider able canvass spread. It is reported that if he would re main at Holyhead ten or twelve days, and then proceed to Southampton. The Late Powder Explosion at Wil mington. W I I.M I NGTON, DEL., October -Tho ex plmion of Duponts powder mills on the Bran dywine, yesterday, occurred while the men in the lower or Hegley yard, were employed ldino powder duet at the press room, to be conveyed to one of the other mills, to go through another process. A one horse cart stood Opposite the press room door, partly load ed, when the press room blew up with a load crash. The composition house immediately followed a minute or two later. The glazing room went off, and the rolling mills followed instantaneusly, being five in all. Seven men were killed. Another man had his arm broken. The wind, nearly K.N., and high at the time, deadened the sound in the immediate vicinity so much that the men in the upper yard did not cease work on the instant. Two of the men wore blown into the Brandywine, one in to a tree, and the headless trunk of another on the opposite of the creek. Of others nothing could be miuertained. A strange feature In the explosion is, that the horse was not killed, although standing in proxilnity to the press room when it went off. The cart to which he was attached, and which was partly loaded with powder dust, was thrown about in fragments. The horse was entirely stripped of his harness, his hair singed off, one eye put out, and one leg broken. Yet after the smoke and dust cleared away, ho was found limping about the yard, exhcbiting all the signs of painful agony which 4e suffered. To relieve him, he was knocked in the head and killed. 'lite coroner visited the scene of the explo sion, to look after his interests, but could learn nothing, as the witnesses were all killed. Their names are William Moran, E. Doughertr e Swany, Jacob Zebnr, John Welsh and Michael Revolt in the Maryland Penitentiary. BA LTImoRE, October 22.—At noon, to-day, in the 31 aryiand Penitentiary, a convict refus ed compliance with the orders of the deputy warden, who while enforcing the roca r aitind, wasseized by the convi,:t and stabbed twice in the Immediately Oregon Barrett, an other officer of the Penitentiary, tired two AoLs at the prisoner, inflicting a fatal wound, causing his death almost immediately. It is thought the deputy warden will die of his wounds. Lemma.—The convict shot at the Penitenti ary is not dead, as was at first reported, and the warden's injuries are not considered fatal: MEDA LLION PENS.-- se9 J. R. WELDIN Arrest of One of Capt. Cook's Men. CARLISLE, PA., October 22.—A man sup posed to be Capt. Cook, of the Harper's Ferry inurreetion, was arrested hereto-day at noon. He answer:: the description, and is the same man seen in Chambersburgh talking, with 'lire! Cook yesterday. He was armed heavily. He is now having a hearing. The man arrested on the charge of murder as being a participant in the insurrection at Harper's Ferry,is now supposed not to he Cook, but to be one of his party. He is the man from whom a Sharp's rifle was yesterday taken at Chamber, burgh, and who was with Mrs. Cook. Upon arresting him, he endeavored to resist, but was overpowered. lie had on his person three revolvers and two bowie knives. He has been committed for further hearing. This man is taller than the published description. He refused to answer any questions. CARLIsLk, October 23.—The man arrested yesterday on the supposition that he was Capt. Cook, gives his name as William Harrison. Ho is still in custody. It is reported that he will be brought before the Court to-morrow on a writ of habeas corpus, with the view of effect ing his discharge. WA,nuoiroN, October 23.—During the last week, the Postmaster General discontinued Tr. small post offices, many others having previous ly been abolished. The New Orleans'Piraynae of Tuesday last, received by mail, says a number Ai' private letters from Vera Cruz„ allude to the threaten ed expedition against that city, Alvorado and other places on the Gulf coast, but none of the writers appear to entertain any fears. The Constitutional Government would be able to afford them but little protection. From the well known jealousy of the opposing party, the argument appears to be this, that even in case Miramon really contemplated such an ex pedition, he would not dare set out on it, lest during his absence Marquez should seize upon the government.
