THE REFUNDED RAILROAD TAX.
The (11:.,-te,•, of Wednesday, in it lead
ing editorial, charges most gross dereliction
of duty upon Mr. Jacob Tourer, formerly
one of our County 'ommissioners, and upon
Major J. 11. M'llhenny, at present a mOn
her of that Board.
It will be recollected that, in 15,;7 at
eight mill tax was assessed, four mills of
which was avowedly for the purpose of

tallied is the total amount refunded. From the
Auditor's report, we learn that the solos fol

upon an, county treasury, viz

Showing a total of three thousand dollars,
in round numbers. In addition to this, how
ever, the collectors of the First and Sixth
wards got their money back from the Demo
cratic board of Commissioners, and refunded
the railroad tax themselves; but these Conimis
siorMrs did not, as may be imagined, give back
to these collectors the money they had got :
they borrowed it, on the contrary, from two
of the collectors of lb3M, who now hold UlO
Coinreissioners' receiptS for the same and are
claiming it in the settlement of their accounts.
This would swell the amount considerably ;
how much we cannot say; but in all probabil
ity, taken along with the amount collected
and paid over but never called for, it would run
the total up to $5,000.
The Auditor's, in passing upon these accounts
have re-opened the collector's accounts of 1857.
and charged the sums above enumerated as
balances still due by them. They have pre
ferred this, as the legal course, to the other al
ternative of charging it to the Commissioners.
The collectors, however, have the receipts of
the:. Commis: inners as an offset to whatever
claim may beset up against them by the county,
and if the courts shall say that this is not suf
ficient they have their recourse to the Commis
sioners thern=el veg.
Here, the 1, we have three thousand dollars ?
certainly, and probably tlve,received and pock
eted by the Commissioners and never refunded
while,the 'County has been made to suffer to
the extent of three thousand dollars, in round
numbers, in refunding money never received
by it : and we have, besides, the fact that the
collectors were exonerated, officially, by these
men, fOr the money thus collected and psi.]

no man can attempt to . excuse or palliate
their conduct in this matter. If false, the
charge will redoundupon the heads of those
who have made it. We are not the defend
ers dr - public wrongs. If these gentlemen
have committed this wrong., as tIM qw;ctie
charge's, they deserve public obloquy . in the
severe , t degree. We have but the Gazette's
assertion, unsustained by any proot that
these gentlemen have received and retained
this money. The array of refunding war
rants drawn, proves nothing, except that
the Commissioners paid that amount of
money back to thos, who were legally

tled to receive it. That they retained the
surplus collections themselves is e/uoyof not

iwsday was received by the public with the

has made the charge that Messrs. Tomer
and M'llhenny have put this money hi
the pockets. The public ask for proof
of this fact, if it be a fact.. It is a purely

done by any person but themselves.: Men's

Mr. Howe has made a brilliant and successful
opening of the Pittsburgh Theatre, and his ex
cellent stock company-have won the favor of
the Pittsburgh ploy-goers most largely. Rut
in this city the lovers of amusement demand
constant novelty. This Mr. Howe is deter
mined that they shall have. To-night h r will
commence his "star season, - and the lover:: of
good acting may depend upon a succe lion of
talented artistes, most ailly supported by the
excellent company at the old Theatre.
To-night Mr. Howe repeats the character of
Hamlet, in which he won so much applause on
Monday night. The necy effects which he in
troduces add greatly to the play, and his per
sonation of the character of the Prince is In
all respects a capital ono. Ile is admirably
supported by the company. The Marsh chil
dren had been announced, but after arrivingat
the depot last evening, concluded to go ou di
rectly to the east 'without stopping in this city.
Next week tire " Queens of Comedy," the
Misses Annie and Addie Lonsdale will com
mence a series of the most popular perform
ances. They play such pieces The Queen
of Hearts," "The Hull of the Drum," "The
tioldicr's Daughter," "As You Like lt," and
a great variety of similar excellent plays in
which they will be admirably supported by the
company.
The public 111/N , e already had a taste of the
manner in which Mr. Howe produces his
pieces; and in playine; his stars, nothing will
be found lacking to their porroct artistic repro
sontation.
Cricketers at Kittanning
On Wednesday, eleven of the Olympic flab
of this city, went to . Kittaiining to play with
twenty-two of a new mid: flourishing club of
cricketers which was organized a few months
since in that place. The weather was bad, but
in the intervals of the rain a short match was
played, more for amusement of the parties than
as a contest, in which the Olympics won. They
returned to the city on Thursday, well pleased
with their visit. The Olympics speak in terms
of high praise of the.Kittanning boys. When
they hats• the requisite advantage of sufficient
practice the Kittanning Club will be hard't(i

The Opponents of the State Tleket.:
In his speech in this city, Judge Douglas
emphatically advised all true Democrats to
'rally under the organization of the party."
In speaking of the
. position of a few, who
claim to be the friends of Judge Douglas, and yet
oppose our excellent State ticket, the Harris
burg Patriot and rnion has the following. It
says;
The bolters from the Democratic party in
Pennsylvania aro exceedingly indignant that
the attention of the public should be called to
the radical difference between the position of
Judge Douglas, whose peculiar friends they
claim to be, and their own. The object which
we had in adverting to the subject was undis
guised. We desired to show the admirers of
Mr. Douglas in this State that the conduct of
the Philadelphia Press, and a few others in op
posing, upon the shallowest pretext, the Demo-
crude ticket, is condemned by the individual
whom they wish to advance. This we could
do with great propriety, since we have care
fully abstained from Presidential intrigues,
lauding or denouncing no man with a view to
the action of the Charleston Convention, but
striving to do justice to Democratic stutsmmen
who have the confidence of any considerable
portion of the party. To do justice,to Mr.
Douglas, it was necessary to show that ho has
no sympathy with disorganization and.desires
the success of the Democratic ticket this fall.
We recommend to such papers ix the Thiiicaster
Inquirer, which vents its.vexation at the con
duct of Judge Douglas upon the Patriot and
Uni,,n, to support the Democratic organization
and its nominees. By doing this they will no-
complish much more for Mr. Douglas, and oc
cupy, in the future, a much better position
themselves. Even should the man whom they
admire be nominated and elected, they would
appear before him in the suspected light of
factionistSand traitors to an organization which
he has over yet supported. Upon his next visit
to Philadelphia, let the editor of the Inquirer
ascertain Whether warm words did not pass
between Col. Forney and Judge Douglas at the
house of time latter, in Washington, upon this
very subject of Opposition to the Democratic
Philadelphia Cattle Market.
